AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO
AMENDING THE ZONING REGULATIONS AND ZONING MAP
TO ESTABLISH HISTORICAL PRESERVATION DISTRICTS
AND AMENDING THE DEMOLITION REGULATIONS AS THEY
AFFECT HISTORICAL RESOURCES
WHEREAS, the Cultural Heritage Committee (CHC) has prepared recommendations for
establishing a historical preservation program in San Luis Obispo; and
WHEREAS, the CHC has recommended that the zoning regulations be changed to establish
historical preservation districts and that the demolition regulations be amended to
foster the preservation of historical resources; and
WHEREAS, the Planning Commission and City Council have held public hearings to
consider the proposed Municipal Code amendments in accordance with Section 65800 et. seq
of the Government Code; and
WHEREAS, a negative declaration of environmental impact has been granted; and
WHEREAS, the Planning Commission has recommended approval of the Municipal Code
amendments and the City Council finds that the proposed regulations conform with the
general plan and promote the public health, safety and general welfare.
BE IT ORDAINED by the Council of the City of San Luis Obispo as follows:
SECTION 1. That Chapter 17.54 of the Zoning Regulations be amended by the addition
and deletion of provisions fully contained in Exhibit A, which is attached to and a part
of this ordinance.
SECTION 2. That Chapter 15.36 of the Building and Construction Regulations
(Demolition and Moving of Buildings) be amended by the addition of the provisions fully
contained in Exhibit B, which is attached to and a part of this ordinance.
SECTION 3. That the Official Zoning Map be amended to establish Historical
Preservation Districts (H) for the area shown on Exhibit C, which is attached to and a
part of this ordinance.

SECTION 4. After review and consideration, the granting of a negative declaration is
affirmed.
SECTION 5. A summary of this ordinance, approved by the City Attorney, together with
the ayes and noes, shall be published at least five (5), days prior to its final passage
in the Telegram- Tribune, a newspaper published and circulated in said city, and the same
shall go into effect at the expiration of thirty(30)days after its said final passage.
A copy of the full text of this ordinance shall be on file in the office of the City
Clerk on and after the date following introduction and passage to print and shall be
available to any interested member of the public.

HISTORICAL PRESERVATION (H) ZONE

17.54.010 Purpose and Application
A. The H zone identifies parcels, areas or structures that (1) are architecturally or
historically important, and (2) may be eligible for benefits offered through the City's
Historical Preservation Program.
B. The H zone may be applied to areas with any of the following characteristics:
1. The property is within an area -where buildings with pre -1941 architectural styles
create a recognizable character.
2. The property or area contains structures which (a) are good or excellent examples
of pre -1941 architecture, or (b) were designed by eminent architects or designers, or (c)
are community architectural landmarks.
3. The property or area contains structures that are included in the city's Master
List of Historical Resources.
4. The property, area or structure was owned or occupied by someone who had a
significant role in the history of the city, region, state or nation.
17.54.020 Allowed Uses.

Amendments to the Demolition Regulations
15.36.150
C. Procedure for Processing Application for Demolition Permits.
Upon receipt of a demolition permit application for a primary structure located on a
property listed on the Inventory of Historical Resources, as may be amended from time
to time by council, the building official shall inform the applicant that provisions
of Chapter 15.36.150 D. shall apply.
Upon receipt of an application for a demolition permit for structures on properties
not listed on the Inventory of Historical Resources, the building official shall
refer the application to the architectural review commission for placement on their
next open agenda.

15.36.150 D. Demolition of Historical Resources
1. ARC Review Required.
A complete application for the demolition of a primary structure located on a
property listed on the Inventory of Historical Resources shall include architectural
plans for a replacement structure or structures. The Demolition Permit Application
and the plans for the replacement structure or structures shall be reviewed and acted
on by the Architectural Review Commission (ARC).
2. Public Notice
Within ten days of receipt of a complete demolition permit application, the City
Clerk shall place an advertisement in a newspaper of general circulation in the city,
announcing the proposed demolition. The ad shall show the location of the structure
on a vicinity map with the street address. The city clerk shall also, within the
aforementioned ten days, notify by first -class mail, any persons or organizations
that have asked to be notified of application for demolition permits.
3. Findings Required
To approve the demolition permit, the ARC must determine that:
a. The proposed replacement structure is as, or more, compatible with neighboring
development than the existing structure consistent with ARC guidelines; and
b. (1) The condition of the structure to be demolished poses a threat to the health,
safety or welfare of community residents or people living or working on or near the
site, or (2) the applicant has demonstrated that it is financially infeasible to
rehabilitate the structure or preserve the historic nature of the site.

Exceptions to this section shall be as presented in Chapter 15.36.150 CA.
