ORDINANCE NO. 10881. (198:7-- ;Series)
AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO
AMENDING THE ZONING REGULATIONS TO REQUIRE
AN ADMINISTRATIVE USE PERMIT FOR NON - RESIDENTIAL
PROJECTS IN THE "O" ZONE
WHEREAS, in 1985 the City Council reviewed an office study work program that
identified as a concern, the development of office buildings near to housing areas in the
downtown; and
WHEREAS, the Planning Commission and City Council held meetings in the summer and
fall of 1986 to evaluate a broad range of options for addressing this urban design /land
use concern; and
WHEREAS, at a meeting in October 1986 the City Council directed staff to initiate
amendments to the zoning regulations that address the issue of office development near to
residential areas; and
Whereas, at a public hearing on January 28, 1987 the Planning Commission reviewed the
proposed amendments, could not reach a consensus, and forwarded the item to the City
Council without a majority recommendation; and
WHEREAS, a negative declaration of environmental impact has been granted.
BE IT ORDAINED by the Council of the City of San Luis Obispo as follows:
SECTION 1. The Zoning Regulations be amended by the addition of provisions fully
contained in Exhibit A, which is attached to and a part of this ordinance.
SECTION 2. After review and consideration, the granting of a negative declaration is
affirmed.

SECTION 3. A summary of this ordinance, approved by the City Attorney, together
with the ayes and noes, shall be published at least five (5) days prior to its final
passage in the Telegram- Tribune, a newspaper published and circulated in said city, and
the same shall go into effect at the expiration of thirty (30) days after its said final
passage. A copy of the full text of this ordinance shall be on file in the office of the
City Clerk on and after the date following introduction and passage to print and shall be
available to any interested member of the public.

the 17th day of March , 198:', on motion of
Councilman Settle ,seconded by Councilwoman Rappa
and on the following roll call vote:

3. Amend Section 17.22.010, Table 91 to include the following new footnote:
11. An administrative use permit is required for the construction of
nonresidential structures or the conversion of residential structures to
non- residential uses in the 0 zone. In order to approve a use permit the
director must make each of the following findings:
A. That the location, orientation, height, and mass of new structures will
not significantly affect privacy in nearby residential areas.
B. That the project's location or access arrangements will not
significantly direct traffic to use local streets in nearby residential
areas.
C. That the project includes landscaping and yards that adequately separate
parking and pedestrian circulation areas from sites in nearby residential-
areas.
4. Amend Section 17.34.020'C.to read as follows:
C. Maximum height: Twenty -five feet; thirty -five feet with the approval of
an administrative use permit in compliance with Section 17.22.010, Table 9,
Footnote 11 (Also see Sections 17.16.020 and 17.16.040.)
