HomeMy WebLinkAbout1089a_ t ORDINANCE NO. 1089 (1987 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO ADDING CHAPTER 13.07 (WATER CONSERVATION PROGRAM) TO THE SAN LUIS OBISPO MUNICIPAL CODE WHEREAS, the City Council finds that all municipal purveyors of water should encourage voluntary water conservation and prohibit certain domestic water uses inconsistent with water and energy conservation. WHEREAS, the City Council finds that approximately forty -two percent (42X) of the household water delivered and treated by the city water system is used for domestic irrigation purposes. WHEREAS, the City Council finds that maximum water demands are during the summer months with domestic irrigation demands exceeding all other demands. WHEREAS, the City Council finds that with increasing costs for personnel, electrical energy, equipment and chemicals, it is desirable to reduce water waste. WHEREAS, The City Council finds it desirable to initiate a water conservation program whose primary goals are education and compliance with regard to prevailing water conservation requirements and with enforcement to be considered only when appropriate to gain compliance after administrative methods have failed; NOW, THEREFORE BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Chapter 13.07 (Water Conservation) of the San Luis Obispo Municipal code is hereby added to read as follows: 13.07.010. Substandard Water Fixtures Prohibited. No person shall cause or allow any water received by such person from the city water system to be wasted due to substandard, leaky or faulty water fixtures or water -using or distributing devices. n inQQ • 13.07.020. Water Runoff Prohibited. No person shall cause any water delivered by the city water system to flow away from property owned, occupied or controlled by such person in any gutter, ditch, or in any other manner over the surface of the ground, so as to constitute water waste runoff. Water waste runoff shall mean water flowing away from property and which is caused by excessive application(s) of water beyond reasonable or practical flow rates, water volumes or duration of application. 13.07.030 Violations A violation of this Chapter shall constitute a misdemeanor and may be prosecuted as provided for by law. SECTION 2 This Ordinance, together with the ayes and noes, shall be published once in full, at least (3) days prior to its final passage in the Telegram- Tribune, a newpaper published and circulated in said City, and the same shall go into effect at the expiration of thirty (30) days after its said final passage.
