HomeMy WebLinkAbout1097ORDINANCE NO. 1097 (1987 Series) AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO AMENDING SECTION 13.12.040 OF THE SAN LUIS OBISPO MUNICIPAL CODE TO MODIFY THE DISTRICT BOUNDARY OF UNDERGROUND UTILITY DISTRICT 11 AND TO ESTABLISH NEW DATES FOR REMOVAL OF OVERHEAD FACILITIES WHEREAS, the City of San Luis Obispo wants to improve the image and appearance of the city by placing all overhead utilities (for electricity, telephone and cable TV) underground in various highly visible land use zones; and WHEREAS, the city's adopted management policies focus on major entryways, streets scheduled for widening, and large new developments as prime locations for placing overhead utilities underground; and WHEREAS, Higuera Street from Madonna to Marsh is a major entryway and a portion is scheduled for widening; and WHEREAS, the city's underground utilities coordinating committee has recommended that the boundary of the district be modified to meet available funds and that the conversion schedule be modified to best correspond with the street widening; BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 2. The following subsection 11 of section 13.12.040 of the San Luis Obispo Municipal Code is hereby amended in order to modify the district boundary of Underground Utility District 11 and to establish a new date for removal of overhead facilities; "11. Beginning at the northeasterly corner of Lot 1, Block 147 of the Harford Addition to the City of San Luis Obispo, as recorded in 0 1097 Ordinance No. 1097 (1987 Series) Page 2. Book A, at Page 123 of Maps recorded in the office of the San Luis Obispo County Recorder; said point lying on the westerly line of Higuera Street right -of -way per said map and being the True Point of Beginning; thence easterly along the prolongation of the northerly line of said Lot 1 to a distance of 30.3 feet more or less, to a point on the centerline of said Higuera Street right -of -way; thence southerly along the centerline of Higuera Street a distance of 172.3 feet more or less to a point; said point being 25 feet northerly of the easterly prolongation of the northerly line of Lot 3 of said Harford Addition; thence, easterly at right angles to the centerline of Higuera Street a distance of 55 feet to a point; thence southerly along a line parallel with, and distant 25 feet easterly from the easterly line of Higuera Street to a point that is 750 feet southerly of the intersection of the southerly line of South Street and the easterly line of Higuera Street per said Harford Addition; thence westerly at right angles to the last described parallel line to a point that is 45 feet westerly of the westerly line of Higuera Street; thence northerly parallel with and distant 45 feet westerly from the westerly line of Higuera Street and its prolongation to a point on the northerly line of Lot 1, Block 147; thence easterly along said northerly line of Lot 1 a distance of 45.5 feet, more or less, to the True Point of Beginning. "Property owners shall be ready to receive phone service by December 1, 1987 and electric and CATV service by June 1, 1988. "Phone facilities shall be removed from public property by April 1, 1988 and electric and CATV facilities by August 1, 1988." 0 1097 Ordinance No. 1097 (1987 Series) Page 3. SECTION 3. This ordinance, together with the ayes and noes, shall be published once in full, at least three (3) days prior to its final passage, in the Telegram- Tribune, a newspaper published and circulated in the city and shall go into effect at the expiration of thirty (30) days after its final passage.
