HomeMy WebLinkAbout1289t Y ORDINANCE NO. 1289 (1995 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING SECTION 13.12.040 OF THE SAN LUIS OBISPO MUNICIPAL CODE TO ESTABLISH UNDERGROUND DISTRICT 12. WHEREAS, the City of San Luis Obispo wants to improve the image and appearance of the City by placing all overhead utilities (for electricity, telephone and Cable TV) underground in various highly visible land use zones; and WHEREAS, the City's adopted management policies focus on major entryways, streets scheduled for widening and large new developments as prime locations for placing overhead utilities underground; and WHEREAS, the "Railroad Square" area is a highly visible land use zone as well as a gateway -to the City for train travelers WHEREAS, the-City has a CIP project to build a pedestrian/ bicycle bridge over the railroad track within the Jennifer /Osos.street right -of- way; and WHEREAS, the existing overhead utilities will need to be relocated to facilitate the proposed bridge design; and WHEREAS, the City's ARC recommends that unsightly overhead utilities be concealed as part of this project to improve the aesthetics of the historic district and, WHEREAS, staff recommends conversion to underground utilities along aforementioned portion of Jennifer /Osos Street, BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. The following subsection 12 of section 13.12.040 of the San Luis Obispo Municipal Code is hereby amended to establish Underground District 12: 0 -1289 , 0 =1289 (1995 Sep �) Page 2 0 1112. Beginning at the southerly corner of Lot 9 in Block 3 of the Buena Vista Addition to the City of San Luis Obispo as recorded in Book A, Page 47 of Maps recorded in the office of the San Luis Obispo County Recorder, said point also being the intersection of the easterly right -of -way line of - Osos Street (now called Jennif er. Street) and the northerly right -of -way line of George Street, thence, northerly along said easterly right -of -way line a distance of approximately 55.5' to a point which intersects the easterly boundary of the Southern Pacific Railroad right -of -way, said point being the True Point of Beginning, thence, continuing northerly along said easterly right -of -way line of Osos Street approximately 304.51, thence, westerly at right angles to said easterly line of Osos Street to a point on the westerly right -of -way line of said street, thence, southerly a distance of approximately 360' along said westerly line to a point, thence, easterly at right angles from said westerly line a distance of 54', thence, northerly along a line 6' from and parallel to the northerly right -of -way line of Osos Street a distance of approximately 51.4' to a point which intersects the prolongation of the easterly boundary of the Southern Pacific Railroad right -of -way, thence, northerly along said prolongation a distance of approximately 7.3' to the.True Point of Beginning. "Facilities shall be removed from Underground District by June 30, 1996."
