HomeMy WebLinkAbout1292ORDINANCE NO. 1292 (1996 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING SECTION 13.12.040 OF THE SAN LUIS OBISPO MUNICIPAL CODE TO ESTABLISH UNDERGROUND DISTRICT 13. WHEREAS, the City of San Luis Obispo wants to improve the image and appearance of the City by placing all overhead utilities (for electri- city, telephone and Cable TV) underground in various highly visible land use zones; and WHEREAS, the City's adopted management policies focus on major entryways, streets scheduled for widening and large new developments as prime locations for placing overhead utilities underground; and WHEREAS, Santa Rosa Street (State Highway 1), Foothill Boulevard and Santa Rosa Park are highly visible land use zones, and /or gateways to the City; and WHEREAS, this district is the City's next highest priority of proposed underground conversion projects. NOW THEREFORE BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. The following subsection 13 of Section 13.12.040 of the San Luis Obispo Municipal Code is hereby amended to establish Underground District 13: 1113•. (see attached boundary description, "Exhibit A")" "Property owners shall be ready to receive service by July 15, 1997." "Overhead electric wire facilities shall be removed from public property by October 15, 1997. "Overhead telephone and cable television facilities shall be removed by December 15, 1997." 0 -1292 Ordinance No. 1292 (1996 Series) Page Two SECTION 3. This ordinance, together with the ayes and noes, shall be published once in full, at least three (3) days prior to its final passage in the Telegram- Tribune, a newspaper published and circulated in the City and shall go into effect at the expiration of thirty (30) days after its final passage. W'ly of the. southeasterly corner of said ,Tract No. 34; THENCE, northerly along a line parallel with and distant 10 ft. from the easterly boundary of said Tract No. 34, to the NW'ly boundary of said Tract No. 34; THENCE, southwesterly along the northwesterly boundary of said Tract No. 34 to the northwest corner of said Tract No. 34, said point also being the northeast corner of Parcel B of that certain map filed in Book 29 of Parcel Maps at page 7 in the office of the aforesaid County Recorder; THENCE westerly along the N'ly line.of said Parcel B, to the NW'ly corner of said Parcel B; THENCE, N'ly along the E'ly line of Parcel A of said Parcel Map filed in Book 29 of Parcel maps at Page 7, and its N'ly prolongation, to the S'ly R/W line of Murray Street; THENCE, W'ly along said S'ly R/W line to a point distant fifty (50) feet E'ly from, and at right angles to, the present E'ly R/W line of Santa Rosa Street (State Hwy. 1) ; THENCE, .NW'ly along a line parallel with the said E' ly R/W line of Santa Rosa Street, to the common line between Sections 22 and 27, Township 30 S, Range 12 E, M.D.M.; THENCE, NW'ly to a point distant 50 ft. NE'ly of, and radial to, the PRC at the NE corner of Foothill Blvd. and Santa Rosa St., as shown.on Book 8 of Records of Surveys at page 60 in the office of the aforesaid County Recorder; THENCE, NW'ly along a curve having a radius of 2090 ft., concentric with that certain curve having a radius of 2040 ft. shown on said Record of Survey (being the NE'ly R/W line of Santa Rosa St.) to a point on a radial line which intersects the centerline of Santa Rosa St., 300 ft. NW'ly from the intersection of Santa Rosa St. and Boysen Ave., measured along the centerline of Santa Rosa St.; THENCE, SW'ly along said radial line to a point distant 50 ft. SW'ly of the SW'ly R/W line of Santa Rosa St.; THENCE, SE'ly along a line concentric with the SW'ly R/W line of Santa Rosa St. (and its prolongation) and having a radius of 1910 ft. to a point distant 90 ft. N'ly from the current centerline of Foothill Blvd.; THENCE, W' ly along a line parallel with the aforesaid centerline of Ordinance No. 1292 (1996 Series) FINALLY PASSED this 20th day of February , 1996, on motion of Vice Mayor Williams , seconded by Council Member Romero , and on the following roll call vote: AYES: Vice Mayor Williams, Council Members Romero, Roalman, Smith, and Mayor Settle NOES: None ABSENT: None ATTEST: Assistant City Clerk Mayor Allen K.
