SECTION 1. That part 2 shall be and is hereby added to Chapter 2. Article
VIII of the San Luis Obispo Municipal Code to read as follot,.7s:

One of our most costly and disagreeable problems is the continuing periodic
sewer main back -ups into a few houses within the city. These are caused by
houses set too low for the main, root infiltration, or some peculiarity of
terrain which permits the main to back into the house the moment there is
the slightest restriction. Our crews are called out to clean up the mess
and pacify the citizen, and our insurance company quite often pays off the
claim. In several cases the flooding has occurred 4 or 5 times, the city
has continued to clean up the mess, but the property owner has still made
no effort to protect his property.
Although we recognize the same property will have the same problem again in
the future, we have no means at present to insist that the property owner
take steps to protect himself (and the city).
The City of Long Beach has had a similar problem and has passed an ordinance
which requires that a property owner who has a potential backflow problem
can be required to install a back -water trap in his sewer lateral. The
ordinance provides further that if the owner fails to install the back-
water trap the city may disconnect the house service and cap it.
I believe it would be well worthwhile for the city to adopt a similar ordi-
nance, and if it is the wish of the council, Mr. Houser and I can draft a
study copy for the next council meeting.

Dear Sir:
Re: Backflow Valves for Sanitary Sewer Lines
Reference is made to your letter of request of February 16, 1960 for
information regarding City of Long Beach requirements for installation
of backflow prevention valves on sanitary sewer lines. Sections Nos.
7570.55 and 7570.56 of the Long Beach Municipal Code, covering the
Cityts requirements for the installations of these valves, are trans-
mitted herewith for your information.
The City requires that property owners install backflow valves wherever
there is danger of flooding building floors. It is not the policy of
the City to permit the property owner to waive his rights for any dam-
ages caused by flooding due to sewage backing into the property and
thereby avoid installation of the required backflow valves. However,
in a few instances on major buildings where the upper floors are inter-
connected through fixtures on the lower floors to the City sewer, we
have permitted the owners to leave the high fixtures connected through
the low fixtures if the cost of separation is extensive. However, the
owner is still required to install a backflow valve in his sewer con-
nection between the building and the City sewer. In these instances,
the City has required that the owner furnish a letter accepting full
responsibility for any damages resulting from interconnection of high
and low fixtures in the building.
On all new structures a careful review is made to determine the need
for this type of protection and in all cases, the City requires that
low fixtures be separated from high fixtures and that a backflow valve
be installed in the low lines.
Essentially the backflow valve requirement was included within the
Municipal Code due to flooding problems which arose in conjunction
with the cleaning of City sewers.
