HomeMy WebLinkAbout0172NORDINANCE No. 1112 (New Series) AN ORDINANCE AMENDING SUBDIVISION c of SECTION 2 AND SECTION 4 OF ORDINANCE No. 166 (New Series). Be it ordained by the Council of the City of San Luis Obispo, as follows: SECTION 1. That Subdivision c of Section 2 and Section 4 of Ordinance No. 166 (New Series) entitled, It An Ordinance of the City of San Luis Obispo providing for the Registration of Contractors, Fixing the Fees Therefor and Providing Penalties for the Violation of this Ordinance??, are hereby amended to read as follows: Section 2, Subdivision c. No person shall be deemed a contractor under the provisions of this ordinance who furnishes no labor save his own and who furnishes no material used in the perform- ance of such contract at a profit to himself, and where such material so furnished does not exceed the value of $ 50.00; provided, however, that any person who actually engages in work as a contractor, but who claims to be exempt under the provisions of this subdivision, shall file with the City Clerk a sworn affidavit stating that he is not a contractor within the meaning of this ordinance, together with an agreement that in the event such person engages in business as a contractor within the meaning of this ordinance, he will promptly comply with all of the provisions of this ordinance. Section 4. Every contractor, before he shall be permitted to register under the terms of this ordinance, shall furnish a bond, to be approved by the City Council, or a certified check, and file same with the City Clerk. Said bond or certified check shall be in the sum as follows: Class ? ?A?? contractors $ 51000.00 Class ? ?B?? contractors $ 3,000.00 Class TIC11 contractors $ 21000.00 Class ? ?D?? contractors $ 12000.00 Class ? ?E?? contractors $ 500.00 Class ??FI? contractors $ 200.00 Where a certified check is furnished, such check shall remain on file with the City of San Luis Obispo for sixty days following /1� completion of the last contract entered into by the person furnishing such check. The conditions under which such check shall be furnished and held by said City, shall be the same as those hereinafter specified for bonds. The condition of said bond shall be that the principal shall faithfully perform all work entered upon or contracted for in conformity with the terms and provisions of all ordinances of the City of San Luis Obispo, as said ordinances now are or may be hereafter enacted or amended, which in any way regulate the work as entered upon or contracted for. Also, that the principal shall, during construction and during the period of sixty days following completion, without additional charge, remedy any defect due to faulty workmanship, incorrect construction and /or defective or unapproved materials, devises, appliances and the like, installed, furnished or used by said principal or his agent or employee, to the satisfaction of the Building Inspector of the City of San Luis Obispo, within 15 days after notice thereof is given to said principal by said Building Inspector. Also, that the said principal and sureties expressly agree that the City of San Luis Obispo may, for itself or for the use and benefit of any person injured or damaged by reason of the failure of the said principal to comply with the provisions of said bond, sue and maintain an action at law on the said bond in any Court having jurisdiction thereof. SECTION 2.
