Re: Side Yard Easement
Lot 25 Block B Tract 169
The subject lot is the end lot in the subdivision. An easement 15 feet
in width was created with the recording of the subdivision map. This
width was believed necessary in the preliminary preparation of the map
as it was then believed that a drainage line would be installed in the
easement in addition to the sewer line.
Subsequent engineering studies showed it best to install two drainage
lines further north and not run a drainage line through this easement.
It has been called to my attention that we have a slight encroachement
of the garage on this easement. In view of the fact, that the easement
contains only a sewer line which is placed approximately four feet from
the property line, we respectfully request that the City abandon the
northerly five feet of this easement, retaining a ten foot easement along
the property line. If this is acceptable to the City, we will be pleased
to prepare the necessary documents.
Cordially yours,
Ray Skinner
