ORDINANCE No. (New Zeries)
An Ordinance Regulating the Height of Fences within the City
of San Luis Obispo, and the Erection and Maintenance of Barbed
";ire Fences within the said City.
Be it ordained by the Council of the City of San Luis
Obispo, as follows;
Section 1. It shall be unlawful for any person, firm or
corporation to construct, erect, build or maintain, or cause
or permit to be constructed, erected, built or maintained, any
fence or wall greater than five feet in height without first
ob9taining a permit from the Council of the City of San Luis
Obispo so to do.
. Section 2. That no permit shall be issued for the cons-
truction, erection, building or maintaining of any fence or wall
greater than five feet in height where the same shall be located
within ten feet of any window of any dwelling house intended for
occupancy by h?unan beings.

Section 3. Nothing in this ordinance contained shall arrly
to any wall which is a part of any building for the construction
of which a. permit shall have been issued in accordance with the
ordinances of the City of San Luis Obispo, or to any retaining
wall that is constructed for the purpose of preventing the falling
or caving of soil, or to any wall constructed along the bank of
any creek within said City to protect the bank of such creek
from being washed away.
Section 4. It shall be unlawful for any person, firm or
corporation to erect or maintain upon his premises situated
within the corporate limits of the City of San 'Luis Obispo any
barbed wire fence, or cause or permit the same to be constructed
or maintained upon or enclosing said premises, without first
obtaining a permit from the Council of the City of San Luis
Obispo, provided. no permit shall be granted to any person, firm

br corporation to erect or maintain any barbed wire fence aling
any public street, lane or alley in the City of San Luis Obispo.
Section 5. No permit required, to be obtained under the
provisions of this ordinance,shall be granted by the Council
at the same meeting on which the application therefor is received
duo
section 6 Any pe son firm or corporation violating any
of the provisions of this ordinance shall be deemed' guilty of a
misdemeanor, and upon conviction thereof shall be punishable by
a fine of not less than five dollars nor more than one hundred
dollars, or by imprisonment for a period of not less than five
days nor more than one hundred. days, or by both such fine and
imprisonment.
Each person, firm or corporation shall be deemed guilty of
a separate offense for every day during any part of r7hich any
violation of any provision of this ordinance is committed, con-
tinued or permitted by such person, firm or corporation, and
shall be punishable therefor as provided in this ordinance.
Section 7. This ordinance is hereby declared to be urgent,
and immediately necessary to preserve the public peace, health
and safety, and shall take effect from and after its final passage.
Section B. This ordinance shall, together with the ayes and
noes, be published for two days in Jne \ 1 a daily
newspaper printed, published and..circulated in the City of San
Luis Obispo, before its final passage.
