City Hall San Luis Obispo, Calif. Gentlemen, A Committee from this Association has met with official of the San Luis Obispo City Planning and Building Department relative to the proposed adoption of the Uniform Plumbing Code, 1958 - edition, for use by the City of San Luis Obispo. It is the feeling of this Association that the adoption of this code is imperative as at the present time we are operating under an obsolete code to the detriment of the safety and welfare of the citizens of this dity. Our committee meetings with the officials from the City of San Luis Obispo have met with agreement on the adoption of the 1958 code with the following exceptions that the committee from this Association feel should be made in order that the code be acceptable to the general public. These exceptions are in addition to the changes that the committee and the officials of the city have agreed on should be made in the code. 1) Sec. 1.8(c) The wording of this section is such that it encourages violation of the code by taking away the right of a person to help.his neighbor. 2), Sec. 1.9. Makes a permit required for any work entailing replacement of any part of a plumbing system. Almost completely un- enforceable would not allow home- owner to replace even a simple fitting without permit and inspection. 3) Sec. 406(g) This, section is unneccesary as provision for placement and number of access (crawl) holes is made in uniform building code now in force. 4) Sec. 504(a)l. In order to comply with this section every dwelling would have to be planned with one wall constructed with 611 studs. It is the opinion of this committee that the 211 Vent is sufficient in the event-provided for by this section. 5) Sec. 703(b), 804(c). Prohibit use of "slip jointstt on outlet side of any trap. There is no logical reason for this prohibition. Would work hardship on most homeowners in doing simple repairs on their own property. tX13 (F) 6) Sec. Prohibits use of ttuniontt joint on gas lines, with exceptions. Committee feels that ground contact union is good connection, as evidenced by exceptions to this section and should be allowed. 8) Sec. 1303. Prohibits replacing Water Heater without permit. Committee feels that this section is unenforceable and unrealistic. A4 I ORDINANCE NO. /'%e'(1961 Series ) AN ORDINANCE ADOPTING THE "UNIFORM PLUMBING CODE" 1958 EDITION and APPENDIX "A►', ► ►B", and ► ►C► ►. BE IT ORDAINED by the Cmuncil of the City of San Luis Obispo as follows: SECTION 1, That Sections 8200. through and including Section 8200.17 shall be and are hereby repealed and amended to read as follows:. Section8200. That a certain document, three copies of which are on file in the office of the City Clerk, being marked and designated as "Uniform Plumbing Code, 1958 .Edition ", and, which copies may be identified by the seal of the City of San Luis Obispo appearing thereon, be, and the same is hereby adopted at the "Plumbing Code" of the City of San Luis Obispo to provide for the protection of the public health and safety and for regulating and licensing of persons engaged in the business of plumbing;; providing for the issuance of plumbing permits and the collection of fees therefor; requir- ing a permit for the installation or alteration of plumbing or drainage systems; creating the office of "Plumbing Inspector" and prescribing the duties therein; defining certain terms; establishing minimum regulations for the,alteration, installation or repairs of the plumbing and drainage systems and the inspection thereof; providing penalties for any violation of the plumbing code; and each and all of the regulations, provisions, penalties, conditions and terms of the "Uniform Plumbing Code ", 1958 Edition including Appendix A, B and C contained therein are hereb referred to, adopted and made a part hereof as if fully set out in this Chapter except such provisions as are modified by the provisions of this Chapter. Section 8200.1 The following sections of the 1958 Edition of the Uniform Plumbing Code are hereby amended to read as follows: Section 1.1 - ADMINISTRATIVE AUTHORITY AND ASSISTANTS - Whenever the term "Administrative authority" is used in this code it shall be construed to mean the Building Inspector or his authorized representative. Section 1.2 - ASSISTANTS - Whenever the term "assistants" is used in this code it shall be construed to mean the Assistant Building Inspector. Section 1.3 - DEPART?IEN T HAVING JURISDICTION - Unless otherwise provided for by law, the office of the Administrative Authority shall be a part of the Planning and Building Department. Section 1.4(10) - DUTIES OF THE ADMINISTRATIVE AUTHORITY - Maintain an,official register of all persons, firms or corporations lawfully entitled to carry on or engage in the business of plumbing or to labor at the trade of plumbing. Section 8200.2 The first paragraph of Section 1.7 of the Code shall be amended to read as follows: Any person, firm or corporation violating any of the provisions of this code shall be deemed guilty of a misdemmanor and upon conviction thereof shall be punishablg by a fine of not toexceed $300.00 of�by imprisonment in the City oil County Jail for not to exceed three (3) months, or by both such fine and imprisonment. Each separate day or any portion thereof during which any violation of this code occurs or continues shall be deemed to constitute a separate offense, and upon conviction thereof shall be punishable as herein provided. f ollows : of the Code Section 8200.3 Sections 1.10(a) and 1.10(b) /are hereby amended to read as (a) No permit shall be issued to any person to do or cause to be done any plumbing or drainage work regulated by this code, except to a person holding a valid unexpired and unrevoked State of California Plumbing Contractors License, except when and as otherwise hereinafter provided in this section. (b) No permit shall be issued to any person to do orcause to be done any sewer or private sewage disposal system work regulated by this code, except to a person holding a valid unexpired and unrevoked Sewer or Sewage Disposal Contractor's License issued by the State Contractors License Board. Section 8200.4 Section 1.12 shall be amended by adding the following at the end of said section: Schedule of Investigation of Fees - When work for which a permit is required under this Code is begun or carried on without a permit, then no permit shall be issued in such cases without a special investigation and the payment of a special investigation feelp in addition to the double fee set forth in this section above, to be determined by the following schedule: For work which would have required a permit fee of $10.00 or less . . . . . . . . . . . . . . $10.00 over $10.00 to $15.00 . . . . . . . . . . . . . .$15.00 over $15.00 to $20.00 . . . . . . . . . . .x$20.00 over x$20.00 or more . . . . . . . . . . . .$25.00 Payment of these fees shall not relieve any person from fully complying with the requirements of this code nor from any penalty. Section 8200.5 Part Two of the Uniform Plumbing Code is hereby amended by being deleted in its entirety, and the following Sections inserted in its place; PAR T WO QUALIFICATIONS OF PLUMBERS Section 2.1 A valid plumbing contractor's "license, issued by the State Contractors License Board of the State of California, shall constitute proof of qualifications for any person to Engage in the business of plumbing. Section 2.2 It shall be unlawful for any person tocnnduc t, carry on or. engake in the business of plumbing in the City of Jan Luis Obispo without first obtaining a license to do business in said Oity as provided in Section 6210 of the San Luis Obispo Municipal Code. Section 8200.6 Table 4 -1 of Chapter 4 of the Code shall be amended to allow a single stall shower to be installed with a minimum trap size of one and one -half inches (1 1/2"). `Section 8200.7 Section 804(c) is amended to re4d as follows: Slip Joints - In drainage work, slip joints may be used only on exposed traps a in water piping only on the du exposed fixture supply. Please be advised that the proposed ordinance for the adoption of this code as prepared by City Planning and Building Director Jean Abraham meets with the approval of the committee from this Association. Definitions -Igor purposes of this sections the terns used herein shall have the following meanings: 1. The term "architect" sball mean a person holding a valid and unrevoked certificate to practice architecture issued by the State of California, 2,. The teft "professional engineer" shall mean a person holding a valid and unrevoked certificate of registration as a professional engineer issued by the State of Calif- ornia. 3, The terra "in responsible charge of design" shall mean the architect or professional engineer who is legally authorized to, and has and assumes responsible and independent control and direction., by the use of initiative,, skill and independent judgment,, of the investigation and design of the plans and specifications for the construction, alter- ation or repair of a building or structure„ B The provisions of this Code are not intended to prevent the use of any materiaa,. or any method of construction not specifically prescribed by taxis Code,, provided any such alternate design is satisfactory and complies with the provisions of this Code with respect -to Loads; and the material, method and work offered is9 for the purpose intended,, at least the equivalent of that prescribed in this Code in quality., strengthp effectiveness, time period of fire resistance, durability., and safety. C. That he is an architect or professional engineers and specifies his California Certificate number, 2. That he is in responsible charge of design. 34 That the plans and specifications contain certain alternate designs which he has identified it his certification of Approval. 4. That with respect to them, he ium made an adequate investigation and based upon substantial knowledge, information and data, he finds they comply with the requirements of subdivision "B" of this section, and that he approves of, and authorizes their use, ,, That he agrees to supervise and inspect the construction of such alternate design 6. That a copy of his written Certification of Approval has been delivered to the owner,,: D, In the event the owner of a building or structure built in accordance with the provisions of this section sells such building or structure within one year of the date of completion thereof;, at least 60 days before such sale such owner shall file with the office of the appropriate County recorder a certificate that the building or structure described therein was built according to the provisions of this section and that any prospective buyer will be notified thereof. E. Where the Superintendent of Building shell find that the plans and specifications submitted under the provision of this section do not comply with the provisions of this section_, than the Superintendent of Building may instruct the City attorney to apply to the proper court for injunctive relief. (Explanatory Note: Procedurally' it is anticipated that in practice the above amend - ment would function by the Department making its usual plan check and notifying the architect or engineer of the Department's exceptions.
