HomeMy WebLinkAbout0191ORDINANCE N0. 191 (1961 Series) AN ORDINANCE ESTABLISHING SETBACK LINES ON BOTH SIDES OF BROAD STREET FROM MONTEREY STREET TO THE SOUTHEAST CITY LIMIT LINE WHEREAS, Broad Street from Monterey Street to the Southeast City limit line is rapidly becoming congested because of increased vehicular traffic; and WHEREAS, the City Planning Consultant and City Engineer have determined that Broad Street will be subjected to an increasing number of vehicular traffic as the southern portion of the City develops; and WHEREAS, The City Planning Commission has recommended that an additional ten (10) foot setback line be established on both sides of said portion of Broad Street; and WHEREAS, some property owners are planning immediate construction of large structures which would be built on the existing property lines; NOW THEREFORE, BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTIONI. Article VIII, Chapter 1, Part Two of the San Luis Obispo Municipal Code shall be and is hereby amended by adding Section 8120.5, and shall read as follows: SECTION 8120.5 - BROAD STREET FROM MONTEREY STREET TO THE SOUTHEAST CITY LIMIT LINE. A. The Council finds and determines that the public safety, convenience and welfare require, and it is ordered that the minimum distance back from the street line for the erection of buildings, walls, fences or structures along both sides of Broad Street from Monterey Street to the Southeast City limit line shall be forty (40) feet from the centerline of said Broad Street. B. No building, wall, fence or other structure shall be erected or constructed or caused to be erected or constrcuted, and no person shall erect or construct, or begin or engage in the construction, or erection of any building, wall, fence or other structure within the space between the setback lines described and;' established in Section 8120.5 (A), and the line of the street in front of the property on which said setback line exist. SECTION 2. Council hereby determines that the public peace, health and safety would be adversely affected if the contemplated structures were built along the exisiting property lines inasmuch as the large structures immediately adjacent to a congested heavily traveled street would add to the congestion and seriously hamper 191 the ability of the City to handle the heavy traffic flow thereby interfering with the proper flow of traffic as well as the rapid movement of emergency vehicles. The Council of the City of San Luis Obispo herey determines that this ordinance shall be enacted as an emergency ordinance, to go into effected immediately and shall be published once in the Telegram- Tribune, a newspaper published and cir- culated in the City of San Luis Obispo.
