An Ordinance Relating to-Jater Ser-
vice and Rates in the City of
San Luis Obispo,
BI!,' 1T ORDAINED by the Council of the City of San Luis Obispo, ar. follows:
Section le The City of San Luis Obispo will place and maintain meters
on water supply pipes at such points and on such premises as the Council
of said City by order on its minutes may determine,
Section 2* That the following rates are hereby established and shall
be collected for water furnished through meters by the City of Zan Luis
Obispo, namely:
1. For water furnished churches and all Institutions declared by
resolution of the Council to be. charitable Institutions, 'no charge shall be
made; provided, that If the water is wasted by any such institution, the meter
rate shall thereafter be-charged,
2* For water furnished for any use or purpose whatever, where rates
therefore are not otherwise specified in this Ordinance.. the monthly rates
shall be as follows:
For the consumption between 1200 and 2500 cubic feet, at the rate of
12 cents per 100 cubic feet;
For the sunsumotion between 2500 and 5000 cubic feet, at the rate of
11 cents per -100 cubic feet;
For the consumption between 5000 and 10,000 cubic feet, at the rate of
9 cents per lOG cubic feet;
For the consumption between 10,000 and 20,000 cubic feet,'at.the rate of

5 cents per 100 cubic feet-,
For the consumption above 50,000 cubic feet, at the rate of 5 cents
per 100 cubic feet.
Provided, that if the amount; of any bill .shall not be an exact multiple
of five cents, such bill shall be reduced or increased to the next nearest
multiple of five cents, and that the minimum monthly rates for water consumed
through metels shall be,, as follows:

Provided further, however, that whore dater is furnished through a 5/8
inch meter to a dwelling house not located near enough toa public seder

first 900 cubic feet or less; provided farther , that where such a house is
furnished with cater through. a 5/4 inch meter, the minimum rate shall be
$1.00 for the first 900 cubic feet or lessi
Section 3. All rates, except meter rates, are due and payable in
advance; meter rates are due and payable at the end of the month, excepting
that a deposit may bo required Cher -eon in an amount not exceeding the
estimated quantity of crater consumed, but in no case shall the deposit be
loss than X2.00. Bills bocome delinquent on and after the 10th of each
month and if not paid within said time a penalty of one dollar shall be
added and tho l st- of delinquents shall be delivered inmediatoly thereafter
to the Superintendent of the City Viat er Works, who shall cause the water to be
shut off from .the rem ses upon which the payment is dolinquOnt and the crater
shall not again be turned on until arrearagess� and -penalties have-
been paid.
Section 4. In addition to any other remedy provided herein for the
t or co llection of any cry or rate or charge, all rates provided

Section 6. Before water shall be supplied to any premises from the City
Mains, the owner shall make application to the City Collector of said City,.
who shall thereupon have the Superintendent of the City Jater V3orks install
a supply pipe from the City main to a point inside the curb line. The City
Collector shall make a charge for said work equal to the cost of water and
service connection$ as estimated by the Superintendent of the City water
forks, which charge shall be paid upon application for service; provided,
that to comply with the foregoing the Superintendent of the City iaater
Jorks shall not be required to extend the water mains of the City without
the order of the City Council.
Section 7. There replacements, repairs or adjustments of any meter are
rendered necessary by the act, neglect or carelessness of the owner or occupa;
of any premises, any.expenses caused to the City thereby, shall be charged
against and collected from the owner of said premises.
Section S. All City water used on any premises where meters are in-
stalled must pass through the meter. No by -pass or connection between
the meter and the main shall be made or maintained.
Section 9. Any consumer shall have the right to demand that the water
through which water is being; furnished be examined and tested by said
Superintendent of the City slater Works, for the purpose of ascertaining
whether or not it is registering correctly the amount of water which is being
delivered through it by said City to said consumer; provided,; that when any
consumer desires to have said meter so examined and tested, said consumer sha
.make application therefor in writing to the City Collector and shall deposit
with said application :thee sum, of X1.00.
Upon said application being made, it shall be the duty of the Superinten -;\
dent of the City eater Uorks to cause said meter to be examined and tested

for the purpose OS ascertain /whether or not it is registering; correctly the
water being delivered through it.
If on such examination and test the meter shall be found to register
over three per e,�:nt more water than actually passes through-: it, another ;\�

meter will be substituted-therefore and the fee of one dollar will be repaid
to the person making the application, and the water bill for the current
period adjusted in such a manner as the City Collector may deem fair and
Just.
Section 10. That if a meter gets out of order and fails to register
correctly, the consumer shall be charged with an average daily consumption
as shown by the meter when in order and registering correctly.
Section 11. That the property owner or person making application for
water service where there are sidewalks, the whole vjidt# of which are
paved with brick, asphalt, concrete or other paving, shall be required
to pay the sum. of 525.00 for the installation of a cast iron cover, or frame,
25 inches by 25 Inches, outside measurements, and to provide a vrater tight
boa of brick or concrete therefore, as shall be determined by the Superin-
tendent of the City ater Viorks for the purpose' of enclosing and protecting
the curb cook and meter after one is'in place.
Section 12. Consumers are required to shut off lawn sprinklers or any
steady flow of water they may be using whenever a fire occurs in the City.
Section. 13. It shall be unlawful for any person or persons to dray
water from any City pipes direct into any stationery steam boiler within
the corporate limits of the City of San Luis Obispo, and any person violating .
the provisions of this section shall be deemed guilt of a misdemeanor, and up(
conviction thereof shall be punished by'a. fine in a sum not exceeding one
hundred dollars, or by imprisonment in the City jail of said City for a perio(
not exceeding fifty days, or by both such fine and imprisonment.
Section 14* if the City water is used to supply a steam engine boiler,
of
its owner must provide a tank /sufficient capacity to afford a supply for
at least twelve hours, into which the service pipe will be discharged,
Section 15. It shall be unlawful for any person other than the
authorized agents or employees of the said City of San Luis Obispo to
turn on water after same shall have been turned off as herein provided,
without the consent of the Superintendent of the City Uater Uork$•, also-
for any person, excepting as above mentioned, or proprietor of any j
grading outfit, to take or use water from said system of water works, without
the writteh consent of the Superintendent thereof, and al.l owners and
occupants of property are hereby prohibited from f 3jishing water for such

purposes until the Superintendent has given permission to do so.
Section.16, That upon the application of the owner or occupant
of a building or premises,, to have the water shut off on the supply
side of a meter, the City Collector will shut the water off and at
the same time record the reading of the meter.
Section. 17. It shall be unlawful for any consumer to supply water to
any person, company or corporation other than the occupant or occupants
of the premises of said consumer, or to knowingly permit leaks or wastage
of water, or for any person, company or corporation to tap, open or
connect with any water maim or pipe which forms any part of the system
of the water works of the City of San Luis Obispo, -:.Athout first Ob-
taining written permission so to do from the City Collector of said
City,.
tam That any person or persons violating any of the provisions
of this section and section 15, shall be deemed guilt/ of a misdemeanor,
and upon convivtion thereof shall be punished by a fine in a sun not
exceeding one hundred dollars, or by imprisonment in the City jail for a,
period not exceeding fifty days, or by both such fine and iDT- risonment.
Section 16. All grater systems laid within the corporate limits
of the City of San Luis Obispo, and connecting with or supplied with
water from the water mains of said City, shall be constructed under the
superthsion and in accordance with plans and specifications approved
by the Superintendent of the City Vater Viorks. All water mains laid in
the streets within the corporate limits of the City of San Luis Obispo
shall becos -e the property of the City of San Luis Obispo.
Section 19. Inspectors, foremen and employees of the City Grater
Vorks,vrhose duty it may be to enter upon private premises to make in-
spection and examination of the pipes, fixtures, or attachments 11sed in
connection with the City water su_lply, will be provided with proper
credentials to identify them as authorized agents of the City.
Section 20. Any officer, inspector, foreman or authorized employee
of the City Water Uorks shall upon presentation of his credentials,
have free access ht all reasonable hours to any premises supplied with
City 'mater, for the purpose of making any inspection thereof of the
entire water supply upon said premises.
In case any authorized employee he refused admittance to any premises
or being admitted shall behindered,or prevented in raking such examina-
tion, the ,Superintendent-'of the City 'Water 1.7orks may cause the water to
be turned off from said premises after giving twenty four hours notice
to the ovmer or occupaut of said premises.
Section 21. The refusal or neglect of the owner to equip the
,qremises with service pipe connections, utilities or fixtures of approved
ch4i,aote"r and quality shall be*sufficient ground for the refusal of the
city Ba'tl er "'jorks to connect the premises with the city viater supply, or to
turn on,the City water after such connections have been nade.
Section 22* That no water service pipe connected with said system
of ;:eater works shall be placed nearer than two feet to any server pipe
or sewer ditch in said City.
Section 23, The City Council may prohibit the use of water for irriga-
tion of all kinds durir4� the months of July, August, September, October
and hovember, and may designate and fix the hours, during-, said months,
when water may be used for irrirjation purposes. In ease of a elation of
this nrovision the viater shall be shut off and shall not be turned on
main until a penalty of one dollar is paid for the first offense and
double the amount for each subsequent offense; the said penalty to be
collected by the City Collector.
Section 24, That all Ordinances and parts of ordinances in conflict
with this Ordinance are hereby repealed.
Section 25. This ordinance shall take effect on the 30th day of
; June, 1912.
Section 26. This ordinance is declared to be urgent and necessary

to carry out the form of government provided for by the Charter of the
City of San Luis Obispo, and is pzzxJ:zg passed in order to establish and
maintain without intermission an effttive City Government, and to Umediate-
ly preserve the public peace, health and safety.
Section 27, This ordinance toGether with the ayes and noes shall be
published for two days before its final passage in the Daily TeleA,�?'ram, a
daily newspaper, printed, published and circulated in the said City
of San Luis Obispo.

AN ORDINANCE RELATING TO WATER SERVICE AND RATES
IN THE CITY OF SAN LUIS OBI SPO.
BE IT ORDAINED by the Council of the City of San
Luis Obispo, as follows: —
Section 1. The City of San Luis. Obispo will place and
maintain meters on water supply Pipes at such points and
on such Premises as the Council of said City by order
on its minutes may determine.
Section 2. That the following rates are hereby establish-
ed and shall be collected for water furnished through
meters by the City of San Luis Obispo, namely:
1. For water furnished churches and all institutions
declared by resolution of the Council to be charitable
institutions, no charge shall be made; provided, that

Provided, that if the amount'of any bill slv ll not be
an exact multiple of five cents, such bill shall be
reduced or increased to the next nearest mmiltiple of
five cents, and that the minimmun monthly rates for
water consumed through meters shall be as follows:
For 5/9 inch meters, 01.15;
For 3/4 inch meters, $1,40;
For 1 inch meters, $2.00;
For 1 1/2 inch meters,$2.50;
For 2 inch meters, $3.50;
For 3 inch meters, $5.00;
For 4 inch meters, $6.00;
Provided further, however., that where water is furnished
through a 5/9 inch meter to a dwelling house not located
near enough to a public sewer so as to connect therewith,
the minimum rate shall be 75 cents for the first 900 aa;bie
feet or less; provided further., that where such a house
is furnished with water through a 3/4 inch meter, the
minImun rate shall be $1,00 for the first 900 c►ubie feet
or less.
Section 3. All ratds, except. meter rates, are due and
payable in advance; meter rates are due and payable at
the end of the month, excepting that a deposit may be re-
quired thereon in an amount not exceeding the estimated
quantity of water consumed, but in no coase shall the deposit
be less than $2.00. Bills become di.elinquent on and after
the 10th- of each month, and if not paid within said time
a penalty of one dollar shall be added, -fie Superintendent
of the City dater Works aaW cause the water to be shut off
from the premises upon wKeh the payment is delinquent
and the water shall not again be turned on until arrearages
and penalties shall have been paid.

Section 4.. In addition to any other remedy provided
herein for the enforcement or collection of any water
rate or charge, all rates provid ®d for° in this Ordinance,
shall be a lien against the premises to which any water
may be supplied, and a charge against the owner thereof
and the occupant thereof using the water, and such property
owner and occupant shall be severally responsible to the
City in an action waged by the City in any Court of
@ompetent jurisdiction for the amount of all such rates
as may be clue and unpaid, together with all penalties
provided herein acid costs.
Section 5. As to consumers not supplied through a meter,
the rate per month to be paid by them to said City for
water furnished them by the City shall be as follows;
For every dwelling house occupied by not more than three
Persons, f5 cents.
For every dwelling house occupied by more than three
persons, 10 cents for each additional person.
For irrigating or sprinkling lawns and gardens 1/4 of
a cent per square yard. water used for sprinkling or
irrigating mustT be taken for the whole year.
For stock, other than livery stock, for one horse, DXl.e
-or cow, 10 cents, and for each additional animal, 5 cents.
For bath tubs in private residences, 20 cents for each tub.
For °water closets in private residence, 20 cents for each
closet.
For boarding houses of not exceeding ten persons, $1.50,
and for each additional person, 10 cents; for each bath
tub, 50 cents; for each water closet, 50 cents, and
for each urinal, 25 cents.
For lodging houses of not over ten rooms, $1.00, and tour
each additional room, 10 cents; for each bath tub,- 50 cents;
3 for each water closet, 50 cents, and for each urinal, 25 cents.

For offices of one room or suite, other than those occupied

section 6. Before water shall be supplied to any premises
from the City mains, the owner shall make application to
the City Collector of said City, who shall thereupon
have the Superintendent of the City ;?Ater Works install
a supply wine from the City main to a. point inside the
curb line. T_he City Collector shall make a chargV
for said work equal to the cost of the water and service
connection as e:s timated by the Superintendent of the City
Water Works, which. charge shall be paid upon application
for service; provided, that to comply with the foregoing
the Superintendent of the City dater Works shall not be
required to extend the water mains of the City without
the order of the City Council.
Section. 7. Where replacements, repairs or adjustments of
any meter are rendered necessary by the act, neglect, or
carelessness of the OvMer or oc(u.Dant of any premises,
any expenses caused to the City thereby, shall be charged
against and collected from the owner of the premises.
Section g. All City water used on any premises where
meters are installed must pass through the meter. No
by -pass or connection between the raeter and the main

such consumer; provided, that when any eo4mmer desires
to have said meter so examined and tested, such consumer
shall make application therefor in writing to the City
Collector and shall deposit with said application the
sum of $1.00.
S, Upon said application being made, it shall be the
duty of the Superintendent of the City Water Works to cause
said meter to be, examined end tested for the purpose of
ascertaining whether or not it is registering correctly
the water being delivered through it.
If on such examination and test, the meter shall be
found to register over three per cent. more water than
actually passes through it, ernother meter will be substitut-
ed therefor and the fee of one dollar will be repaid to
t'r'ee person making the ap plication, and the water bill
for the curreet period adjusted in such a manner as the
City Collector may deem fair and just.
Section 10. That if a meter gets out of order, and
fails to register correctly, the constuner shall be
cha 3ged with an average daily consimiption as shown by
the meter when in order and registering correctly.
Section 11. That the property owner or person making
application for water service where there are didewalks,
the whole width of which are paved with brick, asphalt,
concrete or other paving, shall be required to la..y the
sum of s15-00 for the installation of a cast iron cover
or frame, 25 inches by 25 inches, outside measurements,
and to provide a witer tight box of brick or concrete
therefor, as shall be determined by the Superintendent
of the City Mater Works for the purpose of enclosing and
protecting the curb cock and meter after one is put in
place.

Section 14. If the City Viater is used to supply a steam
engine boiler, its Owner must provide a tank of sufficient
capacity to afford a supply for at least twelve hours,-into
whieh.the service pipe will be'diseharged.
Section 15. It shall be unlawful for any person other
than the authorized agents or employees of the said City
of San Luis Obispo to turn on water after same shall have
been turned off as herein provided, without the consent
of the Superintendent of the CitytWat.er Works; also for
any person, excepting as abov-e mentioned, or proprietor
of any grading outfit, to tare'.or use water from said
system of water works, without the written consent of the
Superintendent thereof, and all owners and occupants of
property are hereby prohibited.from furnishing water for
such purposes until the said Superintendent has given per-
mission 6o to do.
Section lb. That upon the application of the owner or
occupant of a building or premises, to have the water
shut off on the supply side of a meter, the City Collector
will shut the eater ofd' and at the same time record the
reading of the meter.
Section 17. It shall be unlawful for any consumer to

than the occupant or occupants of the premises of said
consumer, or, to knowingly W permit leaks or wastage
of water, or for any person, company or corporation to

City of San Luis Obispo, without first obtaining written
permission so to do from the City Collector of said City.
That any person or persons violating an..y of the
provisions of this section and section 15, shall be
deemed guilty of a misdemeanor, and upon conviction
thereof shall be punished by a fine in a sum not exceeding
one hundred dollars, or by imprisonment in the City jail
for a period not exceeding fifty days, or by both such
fine and imprisonment.
Section 19. All water systems laid within the corporate
limits of the City of San Luis Obispo, and connecting
with or supplied water from the water mains of said
City, shall be constrw.cted under the supervision and
in accordance with plans and specifications approved by
the Superintendent of the City water works. All water
mains laid in the streets within the corporate limits
of the City of San Luis Obispo shall become the property
of the City of San Luis Obispo.
Section 19. Inspectors, foremen and employees of the City
Water works, whose duty it may be to enter upon private
premises to make inspection and examination of the pipes,
fixtures or attachments used in connection with the City
water supply, will be provided with proper credentials
to identify them as autYWrized agents of the City.
Section 20. Any officer, inspector, foreman or authoriz-
ed employee of the City water Works shall upon presentat-
ion of his credentials, have free access at all reasonable
hours to any premises supplied with City water, for the
purpose of making any inspection thereof of the entire
water supply upon said premises.
In case any sa-thorized employee be reftsed admittance
to any premises, or being admitted shall be hindered or
preventedin m&.ing such examination, the Superintendent
of the City Water Works may cause the water to be turned
off from said premises after riving twenty four tours notice
to the owner or occups.nt of said premises.
Section 21. The refusal or neglect of the owner to equip the
premises with service pipe connections, utilities or fixtures
of a.pproveO character and quality shall be sufficient ground for
the refusal of the City s.'dater Torks to connect the premises with
the city cater supply, or to turn on the City dater after such
connections have been made.
Section 22. That no water service pipe connected with said
system of water works shall be placed nearer than two feet to
any sewer pipe or sewer ditch iii. said City.
Section 23. The City Council may prohibit the use of water for
irrigation of all kinds during the months of July, August, Sep-
tember, October and November, and may designate and fix the hours,
during said months, when water may be used for irrigation. In
case of a violation of this provision the �;ater shall be shut off
and shall not be turned on again until a penalty of one dollar is
paid for the-first-offense and double the amount for each subs e-
onent offense; the said penalty to be collected by the City Collector
Section 24. That all ordinances and parts of ordinances in conflict
with this ordinance are hereby repealed.
Section 25. This ordinance shall take effect on the 30th day of
June, 1912.
Section 26. This ordinance is declared to be urgent and necessary
to carry out the form of government provided for by the Charter of
the City of San Luis Obispo, and is passed in order to establish
and maintain without intermission an effective City Government,
and to immediately preserve the public peace, health and safety.
Section 27. This ordinance together with the ayes and noes shall
be published for two days before its final passage in the Daily
Telegram, a daily newspaper, printed, published and. circulated in
the said City of San Luis Obispo.
