A CIVIL DEFUSE SHELTER BOARD AND PRO71DING REG-
ULATIONS PERTAINING TO THE STRUCTURAL DESIGN AND USE
OF CIVIL DEFENSE SHELTERS IN.THE CITY OF SAN LUIS OBISPO.
VMEREAS, The President of the united States has pubiically declared the,
world situation is such that the citizens of the.United States must be prepared
for nuclear attack; and
WHEREAS, The State and Federal Civil Defense Departments have urgently re-
quested that all cities take whatever steps necessary to provide public and
private bomb shelters; and
WHEREASa The existing lags of the City of San Luis Obispo would prohibit the
construction of }private or public bomb shelters; and
WHEREAS, The Council of the City of San Luis Obispo has determined that this
ordinance is an 3%RGE = ORDINANCE to be introduced, passed and to go into
effect on the date,. of its passage;
NOWo THEREFORE, BE IT OItUAI ED by the Council . of the City of San Luis Obispo
as follows:
SECTION 1. That Section 8100.1 of Chapter 1, Article VIII of the San Luis Obispo
Municipal Code shall be and is hereby amended'by adding Section 8100.1(a), to read
as follows;
Section 8100.1(x) I„A&.TB EM ZM BidILDIDIG CODE.
1. All buildings and structures which are designed exclusively as civil defense
shelters are exempt from the provisions of Section 301 through and including 6004
and the Appendix of the Building Code of the City of San Luis Obispo, except as
such provisions may be'adooted by the Civil Defense Shelter Board, or upon
appeal, the City Council under Section 2430.6(a)..
2. Definitions "Civil. Defense Shelter" and 'Disaster,,.
As used herein, the terms "Civil Defense Shelter" and "Disaster" shall have the
same definition as prescribed under Section 2430.6(8).
SECTION 2. That Section 2430.6 of Chapter 4, Article II of the San Luis Obispo
Municipal Code shall be and is hereby amended by adding Section 2430.6{x), to react
as follows;

`here is hereby established a Civil Defense Shelter Board to be appointed by
the City Council. The board shall consist of five (S) members who small be
representative of each•of the following departments of the City of San Luis Obispo:

one (1) member from the Office of the Director of Civil Defense and Disaster;
two (2) members from the Department of Planning & Building (one member from
each division thereof); one (1) member from the Fire Department; and one (1)
member from the City Council.

The Civil Defense. Shelter Board is hereby empowered to:
a. Establish minimum civil defense standards for all civil defense
shelters regardless of area..
b. Establish the maximum capacity of all civil defense shelters.
c. Establish minimum standards for the structural design of civil
defense shelters under 300 square feet in area.
d. Review and approve the structural design of civil defense shelters
in exc6ss of 300 square feet in area.
e. Review, approve or deny all requests for permission to construct
and /or occupy civil defense Shelters within the City of San Luis
Obiepo.
f. Maintain a record file of all requests considered by said Board.
S, Adopt rules and regulations for the applieatiou and enforcement of
the powers and duties described under this Section.
h. Consider and adopt any additional aiUJ== standards for civil defense
shelters. Said standards shall be adopted by resolution of the
majority members of the Board.
i. Adopt resolutions delegating authority to various city departments
for the control and appsaral of requests for the construction and
occupancy of shelters, providing certain minimum standards shall
be complied with.
2. APPEALS FROIf Cili'IL DBF$HSB_ _SHBLS$!�_ �,BQA�D�
a. Any person affected by a decision of the Civil Defense Shelter Board mays
within five (S) days, appeal such deeisionsto the City Council of the City
of San Luis Obispo. Such appeal shall be in writing and filed with the City
Clerk of said City in duplicate. Upon receipt thereof, the City Clerk-.
shall give notice of such appeal to the Civil Defense Shelter Board, and
said Board shall submit a report to the City Cosncil setting forth reasons
for the action taken by the Board. The Council shall render a decision on
any appeal within thirty (30) days after the filing thereof.
3. DBFIATiTIOtiS
a. "CIVIL DSFIMSE SHSL?BS"; As Used In this parts the term "Civil Defense
Shelter" shall mean any building or structure which is designed to be
used exclusively for the purpose of providing protection to the occupants
therof from the effects of blasts, fire., heat, and radiological fallout
resulting from a disaster.
b. "DISASTER ": As used in this part, the term "Disaster" shall meaa actual
or threatened enemy attacks sabotages extraordinary fire, flood, storm,
epidemic, riot, earthquake or other similar public calamity.

a. All shelters constructed within any yard requirement as set forth under
the applicable land use zoning district shell be completely below the
surrounding grade level. 8xception: Inlet or outlet vents only may
project not wre than two feet (20) above the surrounding grade level.,
S. RIGF1'T OF ENTRY._
a. upon presentation of proper credentials., members of Civil Defense
Shelter Board or their representatives may enter, between the hours of
8 :00 A.M. and 6:00 P.I., any building, structure or premises in the City
of San Luis Obispo for the purpose of inspecting any civil defense shelter
erected@ constructed or maintained under the provisions of this section.
6. 9Wi SU.
a. It shall be unlawful for any person, firm or corporation to erect.,
construct., enlarge, alter, repair, moves improves remove, convert, demolish,
use or occupy any building or structure which is designed exclusively as a
civil defense shelters or cause or permit the same to be done, without re-
ceiving a permit from the Civil Defense Shelter Board or agents thereof,,or
Wfxho:tt fully complying with the provisions of this section of the.*'Micipml
Code of the City of San Luis Obispo*
b. It shall also be unlawful to use, occupy or maintain or cause or permit
the same to be done in violation of any conditions of the permit
approved and issued by the Civil Defense Shelter Board or agents thereof.
c. Any violation of this part shall be punishable by fine and imprisonment
as set forth under Section 1200* of Chapter 2, Article I of the San Luis
Obispo Municipal Code.
SECTION 3. This ordinances together with the eyes and noes, shall be published once
In full in the Telegram - Tribunes a newspaper published and circulated in said City,
and the sane shall go into effect 88 of the date of its final passage.
