Notice is hereby given that the City Council of the City
of San Luis Obispo will hold a Public Hearing on the recommenda-
tion of the Planning Commission to rezone certain properties
in the City as shown on sketch map marked Exhibit "A ".
Said Public Hearing will be held on Tuesday, September 5,
1961, at 8:00 P. M. in the Council Chambers of the City Hall,
990 Palm Street, San Luis Obispo, California.

SUEJECT: Recommending a Change in the Land Use Districts
Attached herewith is a copy of Planning Commission Resolution No„ 108-61,
recowending the City Council adopt an ordinance rezoning certain property
described therein,
The Pl.ani3i.ng Commission has hold two public. hearings on this matter as re-
quired by law and in addition has, had many informal public discussions on
this matter.
Over 230 notices were sent to property okmers of the property inv•slved as well
as those owning property within 300 feet of any portion of the property proposed
to be rezoned. These notices stated the time and place of the hearing and in-
cluded.a map and the description repeated in the body of the resolution of
intention to rezone.
Also attached is a copy of a map of the proposed change and copies of com-
munications received thereon and excerpts from the mutes of the Planning
Commission meetings with reference to this proposal.

Mr. Phillips of 1906 Henry Street and Mr. Fred McMaster, 2353 Blvd. Del
Campo; appeared, stating that they had received notices of the proposed
rezoning and that their property was not affected but wanted to know
what was happening„
After a brief.discussion, the first public hearing on this matter was
closed, with Chairman Cole reminding the Commission that there would be'.a
second public hearing on this proposed amendment on August 15, 1961.

Second Public Hearing for consideration to emend the Zoning Ordinance by

of the Southern Pacific right-of-way and portions of property being used
by Southern Pacific R. R.
The secand public hearing on this proposed ant was opened by the Chairman.
The Planning Director read a letter from go F. Viddas, manager of the Southern
Pacific Company Real Estate Department, dated July 280 1961s a portion of which
reads as follows:
"Southern Pacific Company is endeavoring to attract industries to the San
.Luis Obispo area and in order to do this it is necessary that industrial
property be timWily available.
"The proposed rezoning to an unclassified district dill reduce-the industrial
acreage available in the immediaete San Luis Obispo area and as a result request
that the City Planning Commission give consideration to eliminating Southern
Pacific Company property from the proposeo rezoning program, allowing the
existing IWI industrial land use district to m.mat4n In effect."
.The Planning Director then read the follows letter from Herbert C. Grundell,
attorney at law:
"This is in response to your form letter of July 71p 1961, addressed to my
clients P. J. and S. L. Zoiderveg regarding rezoning in the area of Broad
Street and an each'sidi of the railroad vighi- of -way.
Illy clients desire to go on record as to their position, as follows:
121. If the individual progeny owners near t$e railroad rightaof -way
have initiated this move and are In favor of same, my clients
will go along.
112. if the individual property oars .neat the railroad rights- of -v�ay
have not initiated this move and are not In favor of same, my
clients ask that the record indicate their oppma.UAaa to-the
proposed rezoning."
The Planning Director re -read the letter from Lars Basstad. Superintendent
of City Schools WAch stated than the Board of Education had considered the
proposed rezoning at their mating of July ilg and had determined that no
action would-be taken to.oppose the change of tone.
Commissioner Longer stated that Southern Pacific Campauy should be informed that
unless they can show saL6.particuler use for their property, that the Commission
propose to classify their right -of"W in a "U" zone and make it clear to Chem
what a "U" classification is.
The PJlaanitng Director re- iterated what had transpired between himself and the
Southern Pacific representative, stating that he had not spoken to Mr. Widdas
personally.
Commissioner Wholchel stated that he was opposed to stoning residential property
along the railroad trade however, he would personally approve a buffer strip
of commercial, C•3 or something lime that, of a 200 or 300 foot buffer strip
:along the railroad tracks.
Commissioner Schwartz reminded the Commission that the character of the land use
in -that area to date was essentially residential and that the characteristics
of the terrain and development of the area to this date most be considered.
Commissioner W'helchel made a motion to award the proposed resolution of intention
by adding a 300 foot strip along the railroad tracks be rezoned to C -3. The
motion died for lack of a second.
After a brief disuessi.on, on motion of Commissioner Langer, seconded by Commissioner
Whelchel, and the unanimosts decision of the C+ovsAssion, it was decided to continue
the second public hearing to the meeting of August 152 1961.

In view of comments contained in your above mentioned letter
regarding existing limitations under the present I'M" zone
classification, desire to withdraw my letter of protest dated
July 28, 1961.
With regard to the proposed truck terminal to be constructed
on Southern Pacific Company property, understand P14TCo representatives
have contacted your office and made application to the Planning
Commission for .use permit.
Copy-of zoning ordinance was not attached to your above mentioned
letter and would appreciate your forwarding copy of same at your

Dear Sir:
As property owner of record representing a group of some
fifteen citizens owning approximately five acres of property
:South of Terrace Hill between the Gold Tree.Tract and the
Southern Pacific'Rail:Road, I hereby request that rezoning
of this property be post -poned pending study of a proposed
multiple housing project for this area.
The group purchased the property fully aware of its.,composite
zoning with the idea of presenting a more unified land use
proposal to the Planning Commission for approval. Rezoning
at this time to restrictive R -1 usage would seriously impair
tentative financing for.-the project.
