HomeMy WebLinkAbout0210NORDINANCE NO. 210 (New Series) AN ORDINANCE ORDERING THE CLOSING UP..OF.A.POR- TION OF PARK STREET, IN THE CITY OF SAN LUIS OBISPO AND DIRECTING THE EXECUTION OF A DEED CONVEYING SAID PORTION OF PARK STREET TO C. M. LONG. WHEREAS, the City Council of the City of San Luis Obispo did on the 4th day of December, 1939, pass its Resolution of Intention (New Series) No. 476/ to order the closing up and abandonment of that portion of Park Street lying between Monterey Street and Palm Street, in the City of San Luis Obispo. AND WHEREAS, said resolution described the work or improve- ment and the land necessary to be taken therefor, specified the ex- terior boundaries of the district of the land to be affected or bene- fited by said work or improvement and to be assessed to pay the dama- ges, costs and expenses thereof, and designated the Telegram - Tribune, a. daily newspaper published and circulated in said city as the news- paper in which the notice hereinafter referred to was to be published by the Superintendent of Streets of said City of San Luis Obispo. AND WHEREAS, said Superintendent of Streets did. on the 8th day of December, 1939, cause to be conspicuously posted along the line of said contemplated work or improvement, at no more than three hundred feet in distance apart, but not less than three in all, notices of the passage of said Resolution of Intention No. 476 (New Series), which said notices were in the form and set forth all the matters and things required by law to be therein set forth. AND WHEREAS, said Superintendent of Streets caused a notice similar in substance to be published for a period of ten (10) days in said Telegram- Tribune. AND WHEREAS, more than ten (10) days have elapsed since the expiration of the time of publication of said notice as aforesaid and no objection whatever to said proposed work or improvement or to the extent of the district of lands to be affected or benefited by the - 1 - -7) x "n work or improvement has been filed with or delivered to the Clerk of said City Council, or made to or received by said City Council. AND WHEREAS, the said City Council has given full and com- plete consideration to the facts and evidence upon the question as to whether or not the public interest and convenience require that the above described portion of Park Street be closed up and abandoned. AND WHEREAS, the public interest and convenience require that the above described portion of Park Street be closed up and abandoned. AND WHEREAS, said proposed work is for the closing up and abandonment, and it appears that no.assessment is necessary. AND WI3EREAS, the owner of the lands adjacent to and' front- ing on both sides of said portion of Park Street is C. M. Long, and said City Council deems that equity requires the conveyance to said C. M. Long of whatever title the City of San Luis Obispo may have in and to said portion of Park Street. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. That the public interest and convenience require that Park Street between Monterey Street and Palm Street be closed up and abandoned as a public street. SECTION 2. That the above described portion of Park Street be and it is hereby ordered closed and abandoned as a public street. SECTION 3. That said City Council deems that equity re- quires the conveyance to C. lei. tong of whatever title the City of San Luis Obispo may have in and to said portion of Park Street. SECTION 4. The Mayor of said city is hereby authorized and directed to make, execute and deliver to said C. M. Long a deed con- veying to said C. M. Long whatever title the City of San Luis Obispo may have in and to said portion of Park Street, which deed shall be attested by the City Clerk of the said city. - 2 - l SECTION 5. This ordinance, together tiuith the ayes and noes shall be published for two days before its final passage in the Telegram - Tribune, a daily newspaper printed, published and circulated in said city, and the same shall take effect and be in force thirty (30) days after its final passage.
