ORDINANCE NO. 212 (New Series)
AN ORDINANCE APPROVING THE ANNEXATION OF THE
CAUDILL TRACT AND PART OF THE IMPERIAL ADDI-
TION TO THE CITY OF SAN LUIS OBISPO
WHEREAS, after procee ings duly had and conducted by the
City Council of the City of San Luis Obispo for that purpose, pur-
suant to the «Annexation Act of 191311 (Statutes of 1913, page 587),
as amended, an election was held on the 20th day of February, 1940,
within the territory hereinafter described, at which election the
question whether said territory should be annexed to, incorporated
in, and made a part of the City of San Luis Obispo, and that the
property within said territory, after such annexation, be subject
to taxation equally with the property within said City of San Luis
Obispo, to pay for all of the bonded indebtedness of said city for
the acquisition, construction and completion of various municipal
improvements, incurred and outstanding at the time of such annexa-
tion, and all bonded indebtedness heretofore authorized and to be
represented by bonds of said city hereafter to be issued, was sub-
mitted to the qualified electors residing within said territory.
AND WHEREAS, said election was duly and regularly held
and conducted, the.ballots counted, and the ballots, tally sheets
and returns delivered to and deposited with the City Clerk of the
City of San Luis Obispo.
AND WHEREAS, said City Council at its';meeting next after
the expiration_of three days from and after the date of said election,
did meet and proceed to canvass said returns, and upon the completion/
thereof did cause a record thereof to be made and entered upon its
minutes, stating the proposition submitted and showing the whole
number of votes cast thereon in the territory proposed to be annexed,
the number of votes cast therein in favor of annexation, and the
number of votes cast therein against annexation.

AND WHEREAS, upon the completion of said canvass it was
determined that more than a majority of the votes cast at said
election were cast in favor of said question of annexation and that
the proposition of annexation carried, NOW THEREFORE
BE IT ORDAINED by the Council of the City of San Luis
,Obispo as follows
SECTION 1. That the City Council of the City of,San Luis
Obispo, being the legislative body of said city, does hereby approve
such annexation.
SECTION 2. That the territory herein referred to, and
within which said election was held, is situated in the County of
San Luis Obispo, State of California, is contiguous to the City of
San Luis Obispo and the exterior boundaries thereof are specifically
described as follows:
Commencing at the intersection of the center line of
Broad Street, in the City of San Luis Obispo, with the center
line of Mutsuhito Avenue in the Imperial Addition to the City
of San Luis Obispo, according to the official maps of said
City and said Imperial Addition on file in the office of the
County Recorder of San Luis.Obispo County, and running thence
Northeasterly along the center line of Mutsuhito Avenue to
its intersection with the Westerly line of the Pacific Coast
Railroad Company's right of way, if extended; thence Norther-
ly along the Westerly line of the Pacific Coast Railroad
Companyls right of way to its intersection with the Southerly
boundary line of the City of San Luis Obispo; thence Westerly
along the Southerly boundary line of said City of San Luis
Obispo to its intersection with the Westerly line of Story
Street in said City; thence Southerly along the Westerly line
of Story Street to its intersection with the Southerly line
of Mitchell Drive in Caudill Tract, if extended, according
to the official map of said Caudill Tract on file in the
office of the County Recorder of San Luis Obispo County;
thence Westerly along the Southerly line of Mitchell Drive,
if extended, to its intersection with the Westerly line of
Lot or Block 9 in said Caudill Tract; thence Southerly
along the Westerly line of said Lot or Block 9 to the South-
west corner of said Lot or Block 9; thence Easterly along
the Southerly line of Caudill Tract to its intersection with
the Westerly line of Broad Street, Bence Northeasterly at
right angles to the line of Broad /�f, ��She center line of
Broad Street; thence Southerly a3.ong the center line of
Broad Street to its intersection with the center line.of
Mutsuhito Avenue, the place of beginning.

SECTION 3. This ordinance, together with the ayes and
noes shall be published for two times before its final passage in
the Telegram - Tribune, a daily newspaper printed, published and
circulated in said city and the same shall take effect and be in
force thirty days after its final passage.
INTRODUCED AND PASSED to print this 26th day of February,
1940, by the following vote:
