HomeMy WebLinkAbout0220NORDINANCE 110. 220 (New Series) AN ORDINANCE PROVIDING FOR THE REGISTRATION OF BICYCLES IN THE CITY OF SAN LUIS OBISPO AND PROVIDING A PENALTY :FOP, THE VIOLATION THEREOF. BE IT ORDAINED by the Council of the City of San Luis Obispo, as follows: SECTION 1. It shall be unlawful for any person to operate or use a bicycle propelled wholly or in part by muscular power upon any of the streets, alleys or public highways in the City of San Luis Obispo, without first obtaining from the Police Department a license therefor; provided, however, that where a bicycle is to be used in said city for a temporary period, not exceeding ten days, no license shall be required for such bicycle, and upon application therefor the Police Department shall issue a temporary permit for such bicycle. SECTION 2. The Police Department is hereby authorized and directed to issue upon written application, bicycle licenses which shall be effective from the effective date of this ordinance, to and including December 31, 19/,1, and thereafter said licenses shall be issued for the calendar year, commencing on the first day of January of each of said calendar years and ending on the thirty -first day of December of each of said calendar years. Said licenses when issued shall entitle the licensee thereof, or any other person with the per- mission of the licensee, to operate such bicycle for which said license has been issued, upon all the streets, alleys and public high- ways, exclusive of the sidewalks thereof, in the City of San Luis Obispo. SECTION 3. The City of San Luis Obispo shall provide each year metallic license plates and seals, together with registration cards and such other material as may be necessary. Said metallic license plates and registration cards shall have numbers stamped thereon in numerical order, beginning with the number 1, indicating the year for which the same are issued., and the letters SLO. Said metallic license plates shall be suitable for attachment upon the frames of.bicycles, and it shall be the duty of the Police Depart- ment to attach one such metallic license plate to the frame of each bicycle and to issue_a corresponding registration card to the licensee, upon the payment of the license fee herein provided for. Said metallic license plate shall remain attached during the exis- tence of such license. The Police Department shall keep a record of the date of issue of each license, to whom issued, and the number thereof. SECTION 4. All persons engaged in the business of buying or trading in second -hand bicycles, and all persons engaged in the business of selling new or second -hand bicycles are hereby required to make a report to the Police Department, which report shall specify: (a) The name and address of the person from whom each second hand bicycle is purchased, or traded -in; or (b) The name and address of the person to whom a new or second -hand bicycle is sold. (c) The description of each bicycle purchased, traded -in or sold. (d) The frame number thereof or other identification number. (e) The number of the metallic license plate attached there- to, if any. All reports required by this section shall be in writing and shall be filed with the Police Department within twenty -four hours after each purchase or trade -in of a second -hand bicycle, and within twenty -four hours after each sale of a new or second -hand bicycle. SECTION 5. It shall be the duty of every person who sells or transfers ownership of any bicycle, to report such sale or trans- fer by returning to the Police Department the registration card issued to such person as licensee thereof, together with the name and address of the person to whom said bicycle was sold or transferred. Such report shall be made within five days after the date of said sale or - 2 - transfer. It shall be the duty of the purchaser or transferee of such bicycle to apply for a transfer of registration thereof within five days after the date of said sale or transfer. SECTION 6. It shall be unlawful for any person to wilfully or maliciously remove, destroy, mutilate or alter the number of any bicycle frame licensed pursuant to this ordinance. It shall also be unlawful for any person to remove, destroy, mutilate or alter any license plate, seal or registration curd during the time in which such license plate, seal or registration card is operative; provided, how- ever, that nothing in this ordinance shall prohibit the Police Depart- ment from stam. ping numbers on the frcai.ies of bicycles on which no serial number can be found, or on i,:rhich said ntn,lber is illegible or insufficient for identification purposes. SECTION 7. The annual license .foe to be paid for each bicycle shall be twenty -five cents (25¢) and shall be paid in advance; and pursuant to Section 5 of this ordinance, such license may be transferred t�rhen the ownership of said bicycle is transferred, and a fee of twenty -five cents (25V) shall be paid for the registration of such transfer. All license fees collected under this ordinance shall be paid into the General Fund of the City of San Luis Obispo. SECTION 8. Notwithstanding anything to the contrary in this ordinance, all bicycle licenses issued on or after the lst day of October of any year shall be effective for the balance of such year and for all of the year following, and the license fee shall be the same fee as herein provided for an annual license. The metallic license plates issued on or after the lst day of October of any year shall bear the date of the following year. V.1here the ownership of a bicycle is transferred on or after the lst day of October of any year, no fee shell be cr.arged for the first transfer of such bicycle. Upon such first transfer a new license shall be issued as provided in the preceeding paragraph. Should a further transfer of ownership be made, the fee provided by Section 7 shall be paid. - 3 - SECTION 9. Every person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a mis- demeanor, and upon conviction thereof shall be punishable by a fine of not more than Fifty Dollars, or by imprisoiz_ent in the County Jail of the County of San Luis Obispo for a period of not more than thirty days, or by both such fine and imprisonment. In addition to the penalty here - inabove provided, the Police Departilent of the City of San Luis Obispo or any of the members thereof, may impound and retain possession of any bicycle operated in violation of any of the provisions of this ordinance, and retain possession of the same until the license provided for herein is obtained by the oimer of said bicycle. SECTION 10. This ordinance, together i��!ith the ayes and noes, shall be published for two days before its final passage in the Tele grams- Tribune, a daily newspaper printed, published and circulated in said city, and the same shall take effect thirty days from and after its final passage..
