BE IT ORDAINED by the Council of the City of San Luis Obispo as fol10 *i8m SECTION 1. That Section 9200.11 of the San Leis Obispo Municipal Code shall be and is hereby amended to permit the use of printing shops in a Cpl zone with a use permit. The maximum allowable height shall be thirty five (35) feet and the minimum building site required on a corner or interior lot shall be five thousand (5.000) feet. SECTION 2. This ordinance, together with the ayes and noes, shall be pub- lished once in full, at least three days before its final passage, in the Telegram=s Tribune, a newspaper published and circulated in said City and the same shall go into effect at the expiration of thirty days after its final passage. ALEX QUAGLINO TO A.LLM PRINTING AS A PERMITTM USE IN A C -1 ZONE* Back o The C-1 Neighborhood Commercial District has been established to serve as a convenience shopping area for the adjacent neighborhood„ The objective is to allaw only uses which provide such day to day needs as food and drug items, as well as the most frequently used service facilities such as laundromatsy beauty and barber shop; and similar uses. The uses allowed in the C -1 zone should be limited to convenience goods and personal services so that they rill not become a catchall for business activities which are unrelated to serving the immediate neighborhood. As well as allm:11ng all uses permitted in the R-A land use classifica- tion., the following uses are presently permitted in the C -1 zone; Bakeries (retail only), food stores, hardware stores, barker shops,. beauty parlors, book stores, liquor stores (off-sale only), variety stores, shoe shops, drug stores, florist chops, parking lots (rtu.st be approved by City Engimoer), personal service establishments, de- partment stores, cleaning agencies, restaurant's, banks and office buildings. In addition, the following uses are permitted, subject to securing a use permit. Drive -in restaurants., service stationi, launderettes, mortuaries, theaisers, illuminated (non - flashing) signs appurtenant to mw per- mitted. use, bowling alley, skating rinks—roller and ice, miniature golf course, swimming pool (commercial), driving range and nurseries other tahn wholesale nurseries, including open air sales. During the past months, the Commission, working with thePlanning Consultant, has been outlining proposals for a new Zoning Ordinance and has determined that. many gees now - permitted in the C -1 zone have no relationship to the neighborhood service function. Those uses considered for elimination included mortuaries, bowling allies, skating rinks --- roller and ice, miniature ;golf courses and driving ranges. The propdsed amendment was to include printing as a pevxvitted use in the C--1 land use district. Public hearings were held on July 17, 1962 and August 7, 1962. The action of the Co= &ssion was to deny the ap,:lication. Resume Several members of the Cormi.ssi n are of the belief thLt the particular printing establishment involved could be located at the particular location. All Commissioners, however, are of the belief that a printing establishment,is not a proper C..l land use. In considering the operation of a printing establishment as a C -1 land use, consideration must be given to the fact that the traffic generated to and from the plant has an origin and destination other than that of the sur- rounding neighborhood. This would be particularly true of a print plant located in the outlying area of town... The area in which the Quaglino property is located is comprised of many uses, as indicated on the attached map. It should be noted that maiV are nonconfomring uses but these are consolidated and located more distant from the Quaglino property than are the conforming C®1 uses. BE IT ORDAINED by the Council of the City of San Luis Obispo as follows; SECTION 1. That Section 9200.11 of the San Luis Obispo Municipal Code shall be and is hereby amended to permit the use of printing shops in a. C -1 zone with a use permit. The maximum allowable height hall' be thirty -five (35) feet and the, mini- mum building site required on a cor- ner or interior lot shall be five thou- sand (5,000) feet. SECTION 2. This ordinance, to- gether with the ayes and noes, shall be published once in full, at least three days before its final passage, in the Telegram- Tribune, a newspa- per published and circulated in said City and the same shall go into ef- fect at the exonation of thirty days after its final passage. Fitzpatrick City Clerk Re: Application of Philip and Alex Quaglino to include "printing" within Classification C -1 Gentlemen: The undersigned as the attorney for Philip and .Alex Quaglino, petitioners, hereby appeals the decision of the San Luis Obispo Planning Commission with reference to their application to include the business of "printing" within the classification of C -1 wherein said application was denied on August 7th. The denial of said petition was four in favor of grant= ing thereof and two adverse to the variance or amendment. The petitioners respectfully state that the form of the application was indicated at the original hearing to be either a petition to change the zone from C -1 to C -2 or to add the business of printing in the classification of C -1. Petitioners feel that said variance should be granted The Honorable Mayor and Members of the City Council August 9, 1962 Page Two and respectfully petition this Honorable Council to consider the matter on its merits in the manner and form prescribed by law.
