HomeMy WebLinkAbout0242N�i grey ORDINANCE N0. 242 (New Series) AN ORDINANCE AMENDING SECTIONS 6 AND 7 OF ORDINANCE NO. 47 (NEW SERIES) ENTITLED "AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO REQUIRING AND PROVIDING FOR THE REMOVAL.FROM PROPERTY, LANDS, OR LOTS, OF WEEDS, RUBBISH AND OTHER MATERIAL WHICH MAY ENDANGER OF INJURE NEIGHBORING PROPERTY OR THE HEALTH OR WELFARE OF RESIDENTS OF THE VICINITY, AND PROVIDING FOR THE ESTABLISHMENT OF LIENS FOR THE COST OF SUCH REMOVAL AND FOR THE ENFORCEMENT OF SUCH LIENS." BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Section No. 6 of Ordinance No. 47 (New Series), the title of which is set forth in the title of this ordinance, is hereby amended to read as follows: Section No. 6. Between the 1st and 15th--day of August of each year the Street Superintendent shall cause to be published a notice to the effect that any person affected or aggrieved by any act or determination of the Street Superintendent or of the City Council hereunder, during the preceding year ending July 31., may at any time prior to the lst day of September next succeeding, appeal therefrom to the City Council. Said notice shall be published for two times in a daily or weekly newspaper, published and circulated in the City of San Luis Obispo. At any time prior to the 1st day of September next succeeding, any person affected or aggrieved by any act or determination of the Street Superintendent or the City Council made hereunder during the preceding year ending July 31, may.appeal therefrom to the City Council. Such appeal shall be in writing and shall be filed with the City Clerk. At the next meeting of the City Council after the 1st day of September it shall proceed to hear and pass upon such appeal, and its determination thereupon shall be final and conclusive. Such hearing may be continued from time to time. The Street Superintendent shall carry out any directions of the City Council made upon appeal, and he shall cause appropriate corrections and entries to be made in his said record book to conform therewith. - I - e/:: �) SECTION 2. Section No. 7 of Ordinance No. 47 (New - Series, the title of which is set forth in the title of this ordinance, is hereby amended to read as follows: Section No. 7. At the expiration of the time for appeal as- herein provided, or upon the determination of the City Council upon appeal and on compliance with the requirements of any determina- tion so made, the Street Superintendent shall deliver to the City Clerk and City Collector an abstract of the entries in the record book herein provided to be kept for the preceding year ending July 31. Such abstract shall show the property affected, the name of the owner thereof, if known, and the amount charged there against. The City Clerk shall thereupon note the amount of such charge on the assess- ment books of city taxes against the respective lots charged and there - after the amount of such charge shall be a lien against the respective property charged therewith of the same character and effect, and shall be collected in the same manner and at the same time as city taxes. Such notation of the amount of such charge shall be made irrespective of the fact that such assessment books may then have been completed, in so far as city taxes are concerned. The provisions of this section shall not apply as to any piece of property.or land or lot, the charge against which has been paid prior to the delivery to the City Clerk of said abstract, but in such case an appropriate entry shall be made.in said record book by the said Street Superintendent, showing that such charge has been paid. Such charge may be paid to the City Collector separately from city taxes at any time prior to the date of delinquency of the first installment of city taxes. Upon such payment the City Collector shall note the fact of payment on the notation of the charge on the assessment books, and the lien shall thereupon cease. SECTION 3. This ordinance, together with the ayes and noes shall be published for two days before its final passage in the Telegram- Tribune, a daily newspaper printed, published and circulated in said - 2 - city, and the same shall take effect and be in force thirty days after its final passage.
