HomeMy WebLinkAbout0258NORDINANCE No. 258 (New Series) AN ORDINANCE DESIGNATING K PORTION OF THE ROADWAY OF MONTEREY STREET AS A PASSENGER LOADING KND UNLOADING ZONE FOR THE FXCLU- SIVE USE OF TAXICAHS DURING CERTAIN HOURS; PROVIDING REGULATIONS FOR THE USE OF SAID ZONE; PROVIDING PENALTIES FOR ThE VIOLATION ThEREOF AND DECLARING THIS ORDINANCE TO BE AN URGENCY ORDINANCE. 3E IT ORDAINED by the Council of the City of San Luis Obispo as follo�Ars: SECTION 1. That portion of the roadway of Monterey Street in the City of San Luis Obispo, described in Section 2 of this ordinance, is hereby determined to be and designated as a passenger loading and unloading zone for the exclusive use of taxicabs licensed by the City of San Luis Obispo, during the hours and at the time and times hereinafter 'set forth, and subject to the regulations contained in this ordinance. SECTION 2. Said portion of the roadway of Monterey Street is described as follows: That portion of said roadway seven (7) feet wide, adjacent to the curb -line, and extending from the easterly curb -line of Osos Street, as it now exists, to aline parallel'to and twenty (20) feet westerly from the easterly property line of the San Luis Obispo County Court House property, produced southerly, and being the area in said roadway, adjacent to the curb -line and in front of the San Luis Obispo County Court House property. SECTION 3. The hours and times during which said portion of said roadway is determined to be and designated as a passenger loading and unloading zone, for the exclusive use of such taxicabs, are as follows: From five - thirty (5:30) o'clock P. M. of any day to seven ( 7:00) o' clock A. M. of the following day. During the entire twenty -four (24) hours of every Saturday, Sunday and legal holiday. a o . r SECTION During the hours and at the time and times that said portion-of said roadway is designated as a passenger loading and unloading zone, the driver of any vehicle, other than a taxicab licensed by the City of San Luis Obispo, shall not stop, stand or park such vehicle in said portion of said roadway. SECTION 5. During the hours and at the time and times that said portion of said roadway is designated as a passenger loading and unloading zone, the driver of any vehicle, other than a taxicab, shall not use said portion of said roadway as a passenger loading or unloading zone. SECTION. 6. Except for the hours and. during the times hereinbefore set forth, during which said portion of said roadway is designated as a passenger loading and unloading zone, said portion of said roadway shall not be a passenger loading and un- loading zone, but may be used for parking purposes by any vehicle, subject to such regulations as may be prescribed by other ordinances of the City of San Luis Obispo. SECTION 7. No taxicab shall use said passenger 'Loading and unloading zone for any purpose other than the loading and un- loading of passengers, except that the driver of a taxicab may stop and stand such taxicab in said zone while awaiting passengers, but, in such event, the driver of such taxicab shall remain seated therein. In no event shall such passenger loading and unloading zone be used by the driver of a taxicab for the purpose of parking such taxicab and leaving the same unattended. SECTION 8. In entering such passenger loading and unloading zone; each taxicab shall enter at the most easterly end thereof and shall continue along the length of said zone as far as possible. In no event shall any taxicab enter said zone ahead of or to the front of any other taxicab, but must take its place behind and to the rear of any taxicab which may then be in said zone. SECTION 9. The Chief of Police of the City of San Luis Obispo is hereby authorized to place the following curb markings to indicate such passenger loading and unloading zone: white. (a) to paint the top ..of the curb and the curb face (b) To- stencil with black letters "Taxicab Loading Zone" upon the top of the curb, in not less than three places at convenient intervals along the length of said zone. SECTION 10. The Chief of Police of the City of San Luis Obispo is hereby authorized to erect or place appropriate signs giving notice of the general provisions of this ordinance and to indicate the hours and times during which said area is designated as a passenger loading and unloading zone. Such signs shall be either permanent signs erected along the curb -line or movable signs placed along the sidewalk. SEC`T'ION 11. Any person vialating any of the provisions of this ordinance shall be guilty of a middemeanor and, upon conviction thereof, shall be punished by imprisonment in the County Fail of the County of San Luis Obispo for not exceeding thirty (30) days or by a fine of not to exceed One Hundred Dollars ($100), or by both such fine and imprisonment. SECTION 12. All ordinances and parts of ordinances in conflict with the provisions of this ordinance are, to the extent of such conflict, hereby repealed. SECTION 13. This ordinance is required for the imme- diate preservation of the public peace and safety. The following is a statement of the facts constituting such urgency: Due to wartime conditions and the need for a large number of taxicabs to transport military and naval personnel to and from the City, a serious parking and traffic condition has arisen in the City, affecting the public peace and safety. Such problem will be remedied when this ordinance becomes effective. SECTION 14. This ordinance, together with the Ayes and Noes, shall be published for two days before its final passage in The Telegram- Tribune, a daily newspaper printed and circulated in said City and shall take effect and be in force immediately upon its final passage and approval.
