HomeMy WebLinkAbout0261NORDINANCE NO. 261 (New Series) AN ORDINANCE AMENDING SECTIONS 5, 6-and YO OF ORDINANCE NO. 208 (NEW SERIES) ENTITLED "Ai'V ORDINANCE REGULATING ThE COLLEDTION AND DISPOSAL OF REFUSE, GARBAGE, WET GARBAGE AND RUBBISH IN THE CITY OF SAN LUIS OiBISPO, FIXING RATES TO BE CHARGED FOR SUCH COLLECTION, AUTHORIZING AND PROVIDING FOR THE ENTERING INTO A CONTRACT WITH SOME PERSON, FIRM, CORPORATION OR ASSOCIATION FOR THE COLLECTION AND DISPOSAL OF REFUSE, GARBAGE, WET GARBAGE AND RUBBISH Ile THE CITY OF SAN LUIS OBISPO, AND FIXIivG TERMS AND CONDITIONS UNDER ,,,jHICh SUCH CONTRACT ShALL BE LET, PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH" FINALLY PASSED AND ADOPTED DY THE CITY COUNCIL ON THE 11TH. DAY OF DECFAiBER, 1939 BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Section 5 of Ordinance No. 208 (New Series) of the City of San Luis Obispo the title,-of which is quoted in the title of this ordinance, is hereby amended to read as follows: Section 5. (A) The 'Contract Agent shall provide a parcel of land known as the City Dump, situate without the City limits of said City. All garbage, refuse and rubbish collected within the City of San Luis Obispo shall be delivered to the City Dump and disposed of in accordance with the regulation of the City Dump and in accordance with the instructions of the Custodian in charge of the City Dump. (b) No garbage, refuse or rubbish shall be dumped at the City Dump except between the hours of 8:00 o'clock A. M. and 6:00 o'clock P. M. of any week day, and except between the hours of .4.!!Q0 A. M. and 1::00 P. Drj. of any Sunday or legal holiday; provided,hmvever, that no garbage, refuse or rubbish shall 1 .211-1 be dumped on Christmas Day or on New Yea's Day. (c) The City Council of the City of San Luis Obispo is hereby authorized to adopt by resolution all necessary rules and regulations for the efficient and sanitary maintenance of the City Dump, and to change or amend the same. (d) wet garbage need not be delivered to the City Dump, but shall be transported to some point beyond the city limits. SECTION 2. Section 6 of Ordinance No. 208 (New geries) of the City of San Luis Obispo, the title of which is quoted in the title.-,6f this ordinance, is hereby amended to read as follows: Section 6. (a) Households- -For the service of collecting all refuse, garbage, wet garbage or rubbish ordinarily produced in and about the hoursehold, but not including dead animals, or the refuse from the construction, demolition or alteration of buildings each separate household having refuse containers shall not be required to pay more than the following rates: Quantity per 1 Collection 30,gallons or less 31 to 40 gallons 41 to 50 gallons 51 to 60 gallons Rates Per Month for. the fol owing Number of Collections weekly: - 1 2* 3 6 .75 $1.00 $1.20 $2.10 .:.$5 1.45 1.95 3.60 .95 1.70 2.35 4.35 1.05 1.90 2.70 5.00 Where the regular accumulation of garbage exceeds sixty (60) gallons per collection the excess garbage shall. be removed at the rate of ten (10) cents for each ten (10) gallons or fraction thereof, for one collection each week; for more frequent collections the rate shall increase at the same ratio as set forth in the above schedule. The above schedule of rates for collection and renewal 2 of garbage shall include the collection removal and disposal of rubbish where the accumulation of said rubbish does not exceed one (1) barrel of fifty (50) gallons capacity per collection. (b) Business Places or Establishments- -For the service of-collecting all garbage and rubbish ordinarily produced in and about business places or establishments, but not including dead animals, or the refuse from the construction, demolition or alteration of buildings, each separate business place or establishment having refuse containers shall not be required to pay more than the following rates: Quantity, per Rates Per Month for the following Collection Number of Collections ;Veekly:- 1 2 3 6 7 Less than 10 gallons $ .50 $1.00 $1.35 $2.40 $2.75 The above schedule of rates for collection and removal of garbage shall include the collection, and removal and disposal of rubbish where the accumulation of said rubbish does not exceed seven (7) cubic feet per collection. Where the regular accumulations of rubbish per collection exceeds seven (7) cubic feet the excess rubbish shall be removed and the charge for said excess shall not exceed the following rates: Quantity Per Rates Per Month for the following Collection Number of Collections Weekly: - 1 2 3 6 7 For each 15 cubic feet over 7 cubic feet or fraction thereof $ .50 $ .75 $1.00 $1.75 $2.00 Provided, however, where there is accumulated wet garbage in eX-cess of ten (10) gallons or more per day at any place of business or establishment (said garbage to have a fluid content not to exceed 250), it shall be removed free of charge by the collector and shall be deemed of sufficient value to compensate the collector in full for the removal thereof. 3 For said wet garbage the accumulator must furnish the necessary container, and said containers shall meet all requirements of the Health Department as to sterilization and sanitation, said collector shall remove wet garbage and rubbish from places now used for the purpose of storing such ,:1Tet garbage, rubbish and /or garbage, or from such place as may be designated by the City Health Officer or City Engineer, and shall not remove garbage and rubbish from hotels and restaurants between the hours of 10:30 P. M. and 6:00 A. M. (c) Office buildings, Place of Business - -For the regular collection removal and disposal of rubbish from any office building using a cordon container of from any.permises"or place of busin-;ss producing said refuse (excepting those premises for which rats are hereinabove specified) the rate per month for said collection shall not exceed the following: Quantity Per Collections Per Week Collection 1 2 3 6 5 or less cu. ft. $ .50 $ •75 $1.00 $1.7.5 6 to 15 cu-ft- 1.00 1.75 2.25 4.00 16 to 30 cu. ft. 2.00 3.50 4.50 7.00 For each 15 tuft. over 30 cu. ft. .50 •75 1.00 1.75 (d) Irregular Collections- -For the occasional or irregular collection of refuse for which rates are not herein - before fixed the refuse collector shall be entitled to charge at the rate of sixty cents (.60) per cubic :yard, or fraction thereof. It shall be the duty of the refuse collector to make such collection upon being properly notified. SECTION 3. Section 10 of Ordinance No. 208 (Yew Series) of the City of San Luis Obispo, the title of which is quoted in the title of this ordinance, is hereby amended to read as follows: 4 Section 10. Nothing in this ordnance contained shall be construed to prohibit any producer of refuse, garbage, wet garbage, or rubbish from personally hauling in producer's vehicle, through the streets of the City of San Luis Obispo, and disposing of same at the,City Dump, provided that such hauling and disposal shall at all times be subject to the approval of the City Health Officer. The person in charge of any vehicle used to haul refuse, garbage, wet garbage or rubbish under the permission granted by the provisions of this Section shall, on request from the custodian of or person in charge at the City Dump, exhibit satisfactory evidence showing that such refuse, garbage, wet garbage or rubbish accumulated in, and was hauled from, the City of San Luis Obispo, and that the producer thereof is a resident of the City of San Luis Obispo..H The permission granted by the provisions of this Section shall not include the right to haul and, dispose of dead animals, the refuse from the construction, demolition or alteratic.n of buildings, old automobile bodies or frames, nor any refuse or rubbish originating in a comiriercic:l- '.establishment where the quantity exceeds one cubic yard. The City Council is hereby authorized, by resolution duly adopted by said City Council, to provide that any person, firm or corporation who shall haul his own refuse, garbage, wet garbage or rubbish and dispose of the same at the City Dump shall pay to the contractor holding a contract from the City of San Luis A' Obispo, a fee for such dumping privilege. The rate or rates of such fee shall be established by such resolution and may be changed from time to time by the City Council, by resolution duly adopted 5 by said City Council. SECTION 4. This ordinance, together with the ayes and noes shall be published for two days before its final passage in the Telegram- Tribune, a daily newspaper printed, published and circulated in said City and shall take effect thirty days after its final adoption.
