HomeMy WebLinkAbout0270NORDINANCE NO -270 _(New Series) AN ORDINANCE PROHIBITING THE PRESENCE OF MINORS IN ANY ESTABLISHMENT PRIMARILY ENGAGED IN' THE ON -SALE OF INTOXICATING. LIQUORS; ALSO PROHIBITING THE PRESENCE OF' LEWD OR DISSOLUTE OR INTOXICATED OR BOISTEROUS OR UNRULY PERSONS IN SAID ESTABLISH - MENTS; ALSO PROHIBITING A MINOR FROM FALSIFYING. AS TO HIS OR HER AGE, OR TO REQUEST, OR USE, OR PERMIT HIMSELF OR HERSELF TO BE SERVED INTOXICAT- ING LIQUORS; AND PROVIDING PENALTIES FOR THE VIOLA- TION THEREOF. BE IT ORDAINED by the Council of the City of San Luis Obispo, as follows SECTION 1. It shall-be unlawful for any person conducting, managing, operating or maintaining any establishment primarily en- gaged in the on -sale of beer, wine or spirituous liquor, or any ad - \`, mixture thereof, to harbor, admit, receive, or to permit to be or remain in or about such place.any persons under the age of twenty - one years. It shall likewise be unlawful for any person-who primarily devotes any portion or part of. any establishment or premises to the purposes'enumerated above, to harbor, admit, receive or permit to be or remain in or about such portion or'part, any person under.the age of twebty -one, years. SECTION 2. It shall be unlawful for any person conducting, managing, operating'or maintaining any establishment or business up- on a premises where beer, wine.and /or spirituous liquor or admixture thereof, is sold, to harbor, admit or receive, or to. permit to be or remain in or about such place, any lewd or dissolute person, of. either sex, an intoxicated or boisterous person, or any person under the influence of intoxicating liquor, or.any person whose conduct while present in such.,place tends to create a violation of any of the provisions of this ordinance, or of any of the laws of the City of San Luis Obispo or:of the State of California, or which tends in any way to corrupt the good morals of any person or persons in said establishment, or in any way - interferes with the proper management ,=V'>1 0 or control of said establishment. SECTION 3. It shall be unlawful for any person under the age of twenty -one years to falsely represent state or declare, in any establishment or business upon a premises where beer, wine and /or spirituous liquor or any admixture thereof is sold, that he or she is of age of twenty -one years, in order to be served the same, and it shall be unlawful for any person under twenty -one years to demand, order, request, use or consume or permit himself or herself to be served with any beer, wine and /or spirituous liquor, or an admixture thereof, in any such place. SECTION 4. Any:person2 firm or corporation, violating any of the previsions of this ordinance shall be deemed guilty of a mis- demeanor, and upon conviction thereof shall be punishable by im- prisonment in the County Jail for not more than six months, or by a fine not exceeding $500.001) or both such fine and imprisonment. SECTION 5. This ordinance, together with the Ayes and Noes, shall be published for two days before its final passage in the Telegram- Tribune, a daily newspaper printed, published and circula- ted in said City, and the same shall take effect and be in force thirty days .after its. final passage.
