BE IT ORDAITTLU by the Council of the City of San Luis Obispo
as follows:
SECTION 1. That the public necessity and convenience requires
that the real property hereinafter described as Parcel To. 1, now
owned by the City of San Luis Obispo, be sold and exchanged for the
real property hereinafter described as Parcel No. 2, now owned by
Vera E. I iossi, Arthur vE. l iossi and Emelia Mossi, plus the pay-
ment by the latter parties of the sum of $75.00 to the City, and
under the terms and conditions hereinafter set forth.
SECTION 2. The parcel of real property hereinabove desig-
nated as Parcel lo. 1 is .described as follows:
All that certain lot, piece or parcel of land in Section
24, Township 30 :mouth, 'range 12, East, Yount Diablo
Feridian in the County of San Luis Obispo, State of
California, being a portion of the land conveyed to the
City* of San Luis Obispo by Prank Tate and recorded in
Vol. 87 of Deeds, at Page 191, in ;3ecords of said County,
bound and particularly described as follows: Commencing
at a point on the Hortherly line of the above, mentioned
conveyed tract on the line between states R. 2 and R. 11,
as set forth in, said conveyance, which said point is dis-
tant 7.69'451 W. 239.6 feet from said corner R. 2; thence
running from point of commencement S.690451 E . 239.6 feet
to said corner R. 2; thence S. 20030' E. 446.8 feet, more
or less, along; the Easterly line of- said conveyed tract to
its intersection with the i ortherly right -of -way line of
California State Highway as it now exists,; thence N.37 016'
7. 629.9 feet, more or less, across a` portion of said con-
veyed tract to point of commencement, and containing 0.931
acres of land, more or less.
SECTION 3. The parcel of land hereinabove designated as
Parcel No. 2 is described as follows:
All that certain lot, piece or parcel of land in Section
24; Township 30 South, Range 12 East, Mount Diablo Tier=
idian, in the County of San Luis Obispo, State of Cali -
forniq,, bound and more particularly described as follows:
Commencing at a stake marked 2. 7 set on the Southerly
line of that certain tract of land conveyed by Frank Tate
to City of San Luis.Obispo and recorded in Vol. 87 of
Deeds, at Page 191, in records of said County, and running
thence from said point of commencement S. 74 °34' E. 215.7
feet, more or less, along the Southerly line of said con-
veyed tract to its intersection with the Northerly boundary
line of the California State Highway right -of -way as it
now exists; thence along said Northerly right -of -way line
in a 7esterly direction to its intersection with the
boundary line of the above conveyed tract between corners
R. 6 and R. 7 as set forth in said conveyance; thence
running N. 63 °E. 100 feet, more or less, along the line
between said corners R. 6 and R. 7 to the point of com-
mencement and containing; 0.198 acres of land, more or
less.

SECTION 4. The transfer of the title of the real property
described as Parcel No. 1 shall reserve to the,-City of San Luis
Obispo an easement in and over said-Parcel No l'to install and
maintain water pipe lines, and power lines, under, over and
across said property, together with the right to erect, maintain
and operate on said property structures and other works as may
be necessary to said City for the operation of its water reservoir.
and facilities, located on the property adjacent to said Parcel
No. 1.
SECTION 5. Said transfer of the title of the real . property
described as Parcel No. 1 shall also provide that said Vera E.
Miossi, Arthur E.'`Miossi and Emelia Miossi at their own expense
shall construct, and they and their heirs, successors and assigns
shall maintain a substantial fence such as is used in that vicinity
for the enclosure of cattle on ranches, on and along the boundary
line..between the said Parcel No. l and the-immediately adjoining
land owned by the City of San Luis Obispo, fore so long as said land
is owned by said City; and, the transfer to' said City of said Parcel
No. 2 shall also include and contain a release to said City by the
said Vera E. ,Miossi, Arthur E. Miossi,* and Emelia Miossi of all
liability and obligation to accrue after the date of said transfer
for or with reference to the maintenance or operation of any fence
or gate, as contained in Subdivision III of that certain deed,
dated, December 2, 1910, made by Frank Tate to said City, recorded
in Book 87 at Page 191 of Deeds in the Office of the County Re-
corder of the aforesaid County, which said liability and obliga-
tion is by said Subdivision III made a condition of the convey-
ance to said City of that certain real property situated in said
County of San Luis.Obispo, described as follows:-
Commencing at a stake marked R. 1 on the Northerly line of
the County road from the City of San Luis Obispo, California,
to the Town of Santa Margarita, over the Cuesta Grade, from
which said stake the corner to Sections 19 -24 -25 and 30,
Township 30 South, Rnages 12 and 13 East, Mount Diablo Mer-
idian, bears S. 78 deg. E. 1189.7 feet distant. Thence
running along the Northerly line of said road on the follow -
ing courses and distances, to wits -N. 74 de-9. 341W. 215.7
.feet to stake R. 7;'thenee S. 63 deg. W. 18`i.8 feet to Stake
R. 6; , thence S. 39 degrees 37' W.0 58.5 feet to stake R.5;
U leaving the Northerly line of above mentioned road
N. 69 de.g. 45' W..196.6 feet to stake R.-14; thence N. 24
—delA. 45' W. 199.8 feet to stake R. 13; thence N. 20 deg.
15' E. 417.2 feet to stake R. 12; thence N. 65 deg. 15'
E. 199.8 feet to stake R. 11; thence S. 69 deg. 45' E. 558.9 '
feet to.stake R. 2; thence S. 20 deg: 301 E. 483.4 feet to
fence post marked R. 9. on the Northerly_lne of said County
Road; thence along the Northerly line of said County Road on
the foliowing courses and distances to wit: S. 66J deg. W.
151.1 feet to fence post marked R. 8; thence N. 74 3/4 deg.
W. 207.1 feet to stake R. 1, the point of beginning and
containing 11.42 acres more or less and being part of the
South East quarter of Section 24, Township 30 South, Range
12 East, Mount Diablo Meridian.
SECTION 6. This ordinance, together with the ayes and noes,
shall be published for two days before its final passage in the
Telegram - Tribune, a daily newspaper printed and circulated in said
City, and the same shall take effect and be in force thirty days
after its final passage.
