HomeMy WebLinkAbout0296ORE ANCE NO. 296 (1964 Ser. ) AN ORDINANCE AMENDING SECTION. 8900.6 OF THE SAN LUIS OBISPO MUNICIPAL CODE PERTAINING TO ENC.LOSUr,.ES AROUND SWIMMING POOLS BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1, That Section 8900.6 of the San Luis Obispo Municipal Code, as set forth in Ordinance No. 292 (1964 Series) shall be and is hereby amended to read as follows: SECTION 8900.6 ENCLOSURES A. All swimming pools shall be enclosed with a continuous wall or fence, designed to discourage access by children and animals, not less than 4'6" in height, measured from the adjoining grade. Glass, if used, must be safety glass or wired glass not having exposed sharp edges. Gates or doors opening through such enclosures shall be self - closing and self - latching with the latching device not less than four (4) feet above grade. Such gates or doors shall be kept closed at all times when not in actual use. B. Enclosure shall be made of substantial materials capable of with- standing a wind load of fifteen (13) pounds per square foot or a horizontal load of twenty (20) pounds per square foot applied at the top of the fence, whichever is greater. C. The walls of a building may be used as part of the enclosure provided that the requirements set forth in Subsection (A) above pertaining to self - closing and latching gates or doors and glass requirements shall not apply to such walls. D. That it is hereby determined that existing swimming pools as de- fined in this Chapter that do not have enclosures as set forth in this section constitute a hazard and a danger to the health, welfare and safety of young children and are hereby declared to be a nuisance. That the owner or person in possession of land within the City upon which is situated any existing swimming pool not so enclosed shall, within thirty (30) days after the effective date of this ordinance, commence or cause to be commenced the construction of the required enclosure and complete same with due diligence. SECTION 2. This ordinance together with the ayes and noes, shall he published once in full, at least three days before its final passage, in the Telegram- Tribune, a newspaper published and circulated in said City, and the same shall go into effect at the expiration of thirty days after its said final passage, INTRODUCED AND PASSED TO PRINT this 19th day of October, 1964 by the following roll call vote: AYES: Clay P.
