ORDINANCE NO .(New Series) .
AN ORDINANCE OF THE CITY OF SAN LUIS - OBISPO CREATING
THE OFFICE OF CHIEF ELECTRICAL INSPECTOR AND PRESCRIB-
ING THE DUTIES THEREOF; PROVIDING FOR THE ISSUANCE OF
PERI:iITS FOR THE INSTALLATION, ALTERATION, ADDITION OR
REPAIRS OF ELECTRIC 1IRING, APPLICrtNCES, DEVICES OR
EQUIPMENT, AND FOR THE COLLECTION OF FEES THEREFOR;
ESTABLISHING REGULATIONS FOR SAID INSTALLATIONS, ALTERA-
TIONS, ADDITIONS OR REPAIRS, AND THE INSPECTION THEREOF;
PROVIDING PENALTIES FOR ITS VIOLATION; AND REPEALING
ORDINANCE No .188 (New Series) .
BE IT ORDAINED by the Council of the City of San Luis Obispo, as
follows:
SECTION 1. CHIEF ELECTRICAL INSPECTOR. There is hereby created the
office of Chief Electrical Inspector. The person chosen to fill the office
of Chief Electrical Inspector shall be a competent electrician of good moral
character, shall be possessed of such ability as is requisite for the effi-
cient performance of his duties and shall have a thorough knowledge of the
standards, materials and methods,used in the installation of electric wiring
devices, appliance and equipment; he shall be well versed in approved
methods of electrical construction for safety to life and property, the
statutes of the State of California relating to electrical work, and the
National Electrical Code, as approved by the American Standards Association.
The Chief Electrical Inspector shall be appointed by the City Council.
The Council may at any time, consolidate and place in charge of any other
official of the City, the functions and duties of the Chief Electrical In-
spector. He shall receive a salary as determined by resolution of the
City Council and before entering upon the discharge of his duties shall
file, a bond in the sum of One Thousand Dollars ($1,000.00), payable to the
City of San Luis Obispo, said bond to be approved by the City Council, and
conditioned that said Chief Electrical Inspector will well, truly, honestly
and faithfully perform the duties of his office; provided, however, that
where the office of the Chief Electrical Inspector is consolidated and
placed in charge of another official of the City who has given a bond as
such official, no separate bond shall be required of the Chief Electrical
Inspector.
The City Council may appoint assistants to the Chief Electrical In-
spector to assist him in the discharge of his duties.
SECTION 2. DUTIES OF CHIEF ELECTRICAL INSPECTOR. It shall be the
duty of the Chief Electrical Inspector to enforce the provisions of this
ordinance, hereinafter termed Code. He shall upon application grant per-
mits for the installation or alteration of electrical wiring, devices,
appliances and equipment, and shall make inspections of all new electrical
installation and reinspection of all electrical installations, all as
provided in this Code. He shall keep complete records of all permits
issued, inspections and reinspections made and other official work
performed in accordance with the provisions of this code. He shall also
keep on file a list of inspected electrical appliances issued by or for
Underwriters' Laboratories, Inc., which list shall be available for public
information during regular office hours upon application to the Chief
Electrical Inspector.

The Chief Electrical Inspector, or other designated authority acting
as such, shall pay all moneys collected by him pursuant to the provision
of this Code into the Treasury of said City.
SECTION 3. AUTHORITY GRANTED TO CHIEF ELECTRICAL INSPECTOR. The
chief Electrical Inspector shall have the right during reasonable hours
to enter any building in the discharge of his official duties, or for the
purpose of making any inspection, reinspection or test of the installa-
tion 'of electric wiring, device, appliance and equipment contained there-
in., except that the inspector is not empowered to enter any dwelling while
the same is occupied as a dwelling without the consent of the occupant
thereof. The Chief Electrical Inspector shall have.the authority to cut
or disconnect any wire in case of emergency where necessary for safety
to life or property or where such wire may interfere with the work of the
fire departVt. Said Chief Electrical Inspector is hereby authorized to
disconnec7 4her discontinuance of .electrical service to any electric
wiring, device, appliance or equipment found to be dangerous to life or
property because they are defective or defectively installed until such
wiring, device, appliances and equipment and their installation have been
made safe and approved by said Chief Electrical Inspector.
The Chief Electrical Inspector may delegate any of. his powers or
duties to any of his assistants.
SECTION 4 PERMITS. No electric wiring, devices, appliances or
equipment shall be installed within or on any building, structure or pre -
mises nor shall any alteration or addition be made in any such existing
wiring, devices, appliance or equipment without first securing a permit
therefor from the Chief Electrical Inspector, except that:
A. No permit shall be required for maintenance repair work, the
replacement of lamps or the connection of portable appliances to suitable
receptacles which have been permanently installed.
B. - No permit shall be required for the installation, alteration
or repair of wiring, devices, appliances or equipment for the operation
of signals or the transmission of intelligence, where such wiring, devices,
appliances or equipment operate at a voltage not exceeding 50 volts be-
tween conductors and do not include generating or transforming equipment
capable of supplying more than 50 watts of energy.
C. No permit shall be required for the installation, alteration or
repair of electric wiring, devices, appliances and equipment installed by
or for an electrical public service corporation for the use of such a cor-
poration in the generation, transmission, distribution or metering of
electrical energy, or for the use of such a corporation in the operation
of signals or the transmission of intelligence.
D. No permit shall be required for the installation of temporary
wiring for testing electrical apparatus or equipment.

Applications for permits shall not be accepted unless the correct
building number is given and the type of occupancy in which electrical
work is to be installed conforms with Ordinance No. 292 (New Series) -
(Zoning Ordinance). In order:to assure proper inspection, permits shall
be marked: READY and NOT READY. For permits marked NOT READY it shall
be the responsibility of the applicant to notify the Chief Electrical
Inspector when such work is ready for inspection; preferably this
notice shall be in writing. Permits 120 days old and on which no work
has been completed shall automatically be cancelled, and new permits
required when the installation is commenced. Permits must be on file
and reported ready before 3:30 P.M. of the day previous to that on
which inspection is requested.
Permits shall be refused to applicants whose license has expired
or who have not corrected wrong addresses, or.who have not corrected
violations within ten (10) days of date of first notice.
Application for permits shall be filled out plain and legible,
location shall be printed, the correct full name of the owner as well
as owner's correct address shall be given; otherwise permit shall be
refused.
Temporary permits shall be issued only in the following manner.- -
For temporary connection to be used for building construction or port -
able power for floor finishing, pipe cutting,ete., connected to a
temporary service tap but not a permanent service.
Application for such permit, describing the work to be done, shall
be made in writing to the Chief Electrical Inspector by the person, firm
or corporation installing the work. The application shall be accompan-
ied by such plans, specifications and schedules as may be necessary to
determine whether the installation as described will be in conformity
with the requirements of the Code, provided it is any one of the fol-
lowing types of buildings: Amusement, Commercial, Industrial, Educa-
tional,- Manufacturing, Multiple Dwelling and /or Religious.
If it shall be found that the installation as described will in
general conform with the requirements of this Mode, and if the applicant
has complied with all provisions of this Code, a permit for such in-
stallation shall be issued; provided, however, that the issuance of the
permit shall not be taken as permission to violate any of the require-
ments of this Code.

each installation or alteration, an annual permit shall, upon applica-
tion therefe,r,tbe,issued to any person, firm or corporation regularly
employing one or more electricians for the installation and maintenance
of electric wiring, devices, appliances and equipment on premises oVMed
or occupied by the applicant for the permit. The application for such
annual permit shall be made in writing to the Chief Elec #rical Inspector

and shall contain a description of the premises within which work is to
be done under the permit. Within not more than fifteen (15) days follow-
ing the end of each calendar month, the person, firm or corporation to
which an annual permit is issued shall transmit to the Chief Electrical
Inspector a report of all the electrical work which has been done under
the annual permit during the preceding month. Each annual permit shall
expire on December 31. of the year in which. it is issued.
Special Owner's Permit. The Chief Electrical Inspector may issue
to an individual a special owner's permit authorizing said individual
to install, alter, change or repair electrical equipment in, on or about
a single dwelling of,which said individual is owner and occupies, or
intends to occupy, but not elsewhere. If this or any other provision
hereof shall be violated by the holder of such special owner's permit,
such permit shall be subject to immediate cancellation by the Chief
Electrical Inspector, and the holder thereof shall be liable to the
penalty hereinafter provided for violation of this Code.
The requirements of this Code are hereby specifically- declared to
'govern and control the.in.stallation, alteration or repair of any elec
trical wiring, devices, appliances or equipment in any building or
structures ovmed or controlled by any public or quasi- public or political
corporation or body, except as to such electrical wiring as is specifi-
cally exempt under this Code.
SECTION 5. FEES FOR PERMITS; INSPECTION, AND CERTIFICATES. Every
applicant for a permit under the terms of this Code shall pay to the
Chief Electrical Inspector, or his assistants, at the time of the issu-
ance -;•t a fee in accordance with the following schedule:
A. For a complete installation of circuits involving receptacle
or lighting outlets; appliances; lighting fixtures; gas -tube lighting;
signs; shop inspection; inspection of electric apparatus; heating.; re-
frigerating or ventilating equipment; alterations, changes or repairs:

D. Where several motors of less than HP capacity are properly
connected, to the same 1200 watt circuit, the'fee charged shall be based
on the number of such circuits as shown for the wiring and fixtures.

included on permits issued for motors, wiring, etc., the Power Duct fees
will be waived.

I. For the inspection of temporary installations for decorative
advertising and theatrical purposes, a fee not exceeding $'2.00 per hour
or fraction thereof shall be charged.
J. Minor changes or repairs to Electric Service Equipment for
Residential Buildings:

K. A fee of($10.00) ten dollars shall be paid for each annual
Maintenance Electrician permit at the time when such permit is issued.
Fees for all new work installed under such a permit since the date of
the last previous inspection shall be paid, according to the above
schedule, at the time when such work is inspected; these fees shall be
in addition to the fee paid at the time when the annual permit is issued.
No permit shall be issued t.o any person, firm, corporation or
political sub - division unless all fees due are paid in full.
SECTION 6. FAILURE TO TAKE OUT PERMIT VIOLATION. Failure to take
out a permit and pay the fees therefor before commencing work shall be
deemed evidence of violation of the provisions of this Mode.

SECTION 7. CONTRACTOR'S LICENSE AND BOND. Each Electrical
Contractor shall have a California State Electrical Contractor's
License (C -10) and also a San Luis Obispo City Contractor's License,
as provided in Ordinance �Io
T . 166 (New Series), and shall pay to said
City such contractor's license fee, and post such Contractor's bond,
as provided in said Ordinance No. 166 (New Series), as the same now
stands or as it may hereafter be amended.
SECTION S. INSPECTION AND CERTIFICATES.. Upon the completion of
the work which has been authorized by issuance of any permit, except
an annual permit, it shall be the duty of the person, firm, or corpor-
ation installing the same to notify the Chief Electrical Inspector, who
shall inspect the installation within 48 hours, exclusive of Saturdays,
Sundays and holidays, of the time such notice is given or as soon there-
after as practicable.
,Where the Chief Electrical Inspector finds the installation to be
in conformity with the provisions of this Code, he shall issue to the
person, firm, or corporation making the installation a certificate of
approval, authorizing the use of the installation, and connection to the
source. of supply, and shall send notice of such authorization to the
electrical utility furnishing the electric service.
If upon inspection the installation is not found to be fully in
conformity with the provisions of this Code, the Chief Electrical In-
spector shall at once notify the person, firm or corporation making
the installation, stating the defects wJ�ieh have been found to exist.
All defects shall be corrected within ten days after inspection
and notification, or within other reasonable time as permitted by the
Chief Electrical Inspector.

SECTION 9. CONNECTION TO INSTALLATION =. Except where work is
done under an annual permit, it shall be unlawful for any person,
firm or corporation to make connection from a source of electrical
energy or to supply electric service to any electric wiring, devices,
appliances or equipment for the installation of which a permit is
required, unless such person, firm or corporation shall have ob-
tained satisfactory evidence that such wiring, devices, appliances or
equipment are in all respects in conformity with all applicable legal
provisions.
It shall be unlawful for any person, firm or corporation to make
connections from a source of.electrical energy or to supply electric
service to any electric wiring, devices, appliances or equipment which
has been disconnected or ordered to be disconnected by the Chief Elec-
trical Inspector or.the use of which has been ordered by the Chief
Electrical Inspector, to be discontinued until a certificate of approval
has been issued by him authorizing the reconnection and use of such
wiring, devices, appliances or equipment.
SECTION 10. STANDARDS FOR INSTALLATION AND MI TERIALS.
A. All installations shall be in conformity with the provisions of
this Code. and with the approved standards for safety to life and property
B. In addition to the requirements of this Code, and except as
specifically modified by the provisions of this code, the requirements
of the Electrical Safety Orders shall apply to all installations coming
under the jurisdiction of the Industrial Accident Commission (in general
all industrial and commercial installations) of the State of California.
C. In addition to the requirements of this Code, and except as
specifically modified by the provisions of this Code, the requirements
of the National Electrical Code, as approved by American Standards Asso-
ciation, shall apply to all installations not coming under the jurisdic-
tion of the Industrial Accident Commission (in general all residential
installations) .
D. The National Electrical Code (1947 Edition) and subsequent
issues as approved by the American Standards Association is hereby
adopted "by reference's as the Electrical Code referred to in Paragraph..
C above, three printed copies of said National Electrical code being
on file in the office of the City Clerk.
E. All electrical materials, devices, appliances and equipment
installed or used in this City shall be in conformity with the pro-
visions of this Code and with approved standards for safety to life
and property.
F. Listings or labeling, as conforming to the Standards of 'the
Underwriters Laboratories, Inc., the United States Bureau of Standards,
the United States Bureau of Mines, or other similar institutions of
recognized standing, shall be prima facie evidence of conformity with
the approved standards for safety to life and property.

G. The maker's name, trademark, or other identification symbol,
shall be placed on all electrical materials, devices, appliances and,
equipment used or installed under the Code.
SECTION 11. INSTALLATION REQUIREnENTS. A. All electrical wiring
installations in or on buildings or structures in Fire Zone No.l shall
be installed in one or combination of'the following approved methods
of types of wiring:

B. All electric Wiring installations in or on buildings or
structures other than dwellings, flats., or apartment houses of not
more than six (6) apartments, not located in Fire Zone No. .l, shall
be installed in accordance with Paragraph 1 of this section.
C. Electrical wiring installations in dwellings, flats or apart-
ment houses of six (6) or less apartments may be installed in wiring
methods permitted by the National Electrical Code; provided, however,
that the wiring methods not having metal protection over conductors
shall.be entirely concealed within the building structure to prevent
tampering. Wiring without metal protection over conductors installed
in private garages, sheds, or minor buildings which are accessory to
dwellings may be installed without concealing same in the building
structure.
D. Previously used material shall not be reused in any.work
without the written approval obtained in advance from the Chief Elec-
trical Inspector.
SECTION 12. ALTERATIONS AND ADDITIONS. Additions or.extensions
to; and alterations and renewals of existing installations shall be
made in compliance with the provisions of this Code.
SECTION 13. SERVICES. A. No open wiring requiring more than
one set of knobs or insulators to each service shall be installed on
outside of buildings. Ymobs or insulators shall be the solid type,
and nails or spikes shall not be considered as adequate.support for
such knobs or insulators.
B. Service brackets shall not be located on chimneys, fire or
parapet walls extending above the roof. line. A suitable support shall
be provided at all locations,
C. Two and three wire services. All single phase lighting loads
of two (2 Circuits or.less may be served with a two (2). wire'service.
Three (3) services shall b.e provided for all single
phase loads of three (3) or more circuits. Where an installation
has been wired and arranged for three (3) wire service, no two
(2) wire energy supply or two (2) wire service drop shall be con-
nected thereto without the written approval obtained in advance
from the Chief Electrical Inspector.
D. T;AIN SWITCH. A main sja =rvice switch having overcurrent pro-
tection shall be installed for each set of service conductors. The
main service switch and overcurrent protection may be omitted in
dwellings and apartment houses, when the voltage to ground does not
exceed 150 volts and each subdivision of load not exceeding six (6)',
is protected by non- tamperable circuit breakers installed in a
single deadfront panel or in separate enclosures, or by externally
operated switches with non - temperable fuses. Such equipment shall
be grouped at the nearest readily accessible point to where the
service conductors enter the building. Thirty ampere switches shall
not be used for a two (2) wire service supplying more than two (2)
branch circuits, nor for a three (3) wire service supplying more
than four branch circuits.
E. Size of Service Conduit or Raceway. For residential in-
stallations of four circuits or less, the minimum size service
raceway shall not be less than three quarter inch (3/4). For
residential installation of four circuits or more, the minimum
size raceway shall not be less tha -L one inch (1 ").
F. Service head shall be brought to the outside of the
building served and shall be located at a point most convenient to
the source of power supply. This location shall be such that
service drops have one point of attachment only on the building
served. Service head shall be so located that the elevation and
clearance of service drops required by the Electrical Safety Orders
of the Industrial Accident conmission of the State of California
shall be maintained on all installations.
G. Every service shall be installed in rigid conduit or
electrical metallic tubing. Replacement services may be made with
unarmored service drop cable, which shall be continuous from dis -,
tribution pole to meter location.
H. Service conductors shall be not smaller than #8 wire
from the service head to the service switch, except that where
a service supplies only a single branch circuit, the service con-
ductors shall be not smaller than the branch circuit conductors,
and in no case smaller than #12 wire.
SECTION 14. VOLTAGE DROP. Every system of wiring for light
and heat installations shall be so installed as not to exceed three
percent (3%O) voltage drop over all and power installations not to
exceed five percent (5f) voltage drop over all.
SECTION 15. 10TERING REQUIRELIENTS. The meter shall be placed
on the line side of service equipment where the supply does not ex-
ceed 300 volts or 100 ampere between conductors. Height to be from
54 to 78 inches above ground level. Meters and metering equipment
should be installed as required by serving agency.

SECTION 16. DE1.QkND FACTORS. Permitted Demand Factors for
Services and Feeders. The following demand factors may be applied
to reduce the size of conductors, switches, overload protective
devices and other equipment for services and feeders supplying the
following types of load:
A. For dwelling flats and apartments the demand factors for
water heater space heaters and air conditioning devices of 1650
watts or over shall be allowed as follows:

SECTION 17. BEATING APPLIANCES. A. Portable electrical heating
appliances installed in residential occupancies shall not be used on
circuits operating at more than 250 volts between conductors and shall
not exceed 150 volts to ground.
B. No appliance rated at more than 1650 watts shall be supplied
by a branch circuit operating at 125 volts or less.
u. Portable electrical heating appliances which have bare elements
or bare current carrying parts exposed to accidental contact shall not
be used on any circuit operating at more than 150 volts to ground.
SECTION.18. CONDUCTORS. The provision of the National Electrical
Codes is hereby specifically declared to be the Rules and-Requirements
of this Code in all installations as follows:
A. For conductors, installed, whether Rubber covered, Synthetic,
Small diameter building wire, Varnished Cambric, Asbestos Covered,
Weatherproof or Lead Covered w:1res or cables, with respect to allowable
carrying capacities, number and size permitted in the various sizes
and types of conduit raceways and similar equipment.

SECTION 19. T"VIRING DETAILS. A. For Reneral illumination in
stores or sales rooms, display rooms, working rooms, offices and similar
places, capacity of not less than two (2) watts per square foot shall
be provided for each square foot of floor area. Each ceiling outlet
shall be rated as requiring not less than 200 watts.
B. For general illumination in school and class rooms, capacity•
of not-less than three (3) watts per square foot shall be provided for
each square foot of floor area.
C. For show window ill�nination, a load of not less than 200
watts shall be included for each linear foot of show window, measured
horizontally along its base...
D. Unless a complete sign circuit is installed at the time of
the original installation in industrial or commercial structures, there
shall be provided, in addition to other requirements,, a' circuit cap-
acity at thecenter of distribution for a sign and other exterior
lighting and a raceway shall be provided from such center to a point
accessible for connection to such sign or exterior lighting.
E. Bell or furnace transformers shall be installed on either a
receptacle circuit or a separate circuit. Such equipment shall not
be counted as an outlet. It shall be mounted in or on a metal box in
a readily accessible location.
F. Each electric range shall be considered as requiring not less
than nine (9) 'iloir�ratts unless signed statements by the owner or his
authorized agent are filed showing actual rating.

G. Where two (2) or more feeder switches are grouped, each
switch shall be permanently marked, indicating what it controls.
H. Drop cord, unless approved for the purpose, shall not be used
for the support of more than one socket with its reflector equipment,
nor for the support of sockets fitted with enclosing globes or bowls.
In every case it shall hang freely in air.
I. Manually operated switches shall be of an enclosed, exter-
nally operated safety type. Circuit breakers shall be enclosed or
otherwise protected against accidental contact with live parts.
Switchboards, panel boards and enclosed branch circuit cutouts shall
be dead front type.
1. All receptacles shall be supplied by separate circuits having
conductors not smaller than a No.12. Each such receptacle shall be
rated at 12 amperes and not more than eight receptacles shall be in-
stalled on -any two wire circuit or on either side of a three wire cir-
cuit when overcurrent protection is supplied by fuses. Not more than
12 receptacle outlets shall be installed on any two wire circuit or
on either side of a three wire circuit when overcurrent protection
is supplied by non - temperable circuit breakers.
K. In every kitchen, dining room, breakfast room, living room,
parlor, library, den, sun room,,recreation room and bedroom, one re-
ceptacle outlet shall be provided for every twelve (12) linear feet or
major fraction thereof of the total linear (gross)'distance around the
room as measured horizontally along the wall at the floor' line. The
receptacle outlets shall, in so far as practicable, be spaced equal
distances apart. At least one receptacle outlet shall be installed
for the connection of laundry appliances. This r6ceptacle shall be
a three (3) pole type for grounding.
L. Overcurrent protection on 110 volts receptacle circuits shall
not exceed 20 amperes.
M. Lighting outlets in attics, basements, private garages and
accessory buildings to dwellings maybe supplied by receptacle circuits,
provided each such outlet is equipped with a medium base lamp holder of
the porcelain keyless type, which is part of lighting unit connected
to the permanent wiring and controlled by a switch. Such lighting out-
let and switch shall be rated as one receptacle outlet.
N. Receptacle outlets installed exclusively for the attachment of
electric clocks may be installed on lighting circuits, but not con-
trolled by switches.
0. 'Receptacle outlets shall not be installed in ironin-g board
cabinets.
SECTION 20. FIXTURE DETAILS. Each outlet for fixtures located
within reach five (5) feet horizontally or eight (8) feet vertically of
conducting floors or other conducting objects shall be controlled by wall
switches, by ceiling pull switches with insulated chain or cord, or by
pendant switches constructed of porcelain or other suitable insulating
material. All insulators in chain pulls shall be placed not more than
one (1) inch from socket or fixture. Key socket's and brass pendant
switches will be permitted in such locations if the shells are perma-
nently and effectively grounded.

'Wall switches within five .(5.) feet of conducting surfaces shall
have an insulating plate or cover and shall be permanently and ef-
fectively grounded.
SECTION 21. COPT. UTATION OF LOAdS. Current carrying capacity
for various voltages shall be computed as follows: Line voltage
between 100 and 125 shall be computed as 120 volts; Line voltage
between 210 and 250 shall be computed at 240 volts.
SECTION 22. RESPONSIBILITY. T his Code shall not be construed to
relieve from or lessen the responsibility of any party owning, oper-
ating, controlling or installing any electric wiring, electric devices
or electric material for damages to person or property caused by any
defect therein, nor shall the City be held as assuming any such
liability by reason of the inspection authorized herein, or certificate
of inspection issued as herein provided.
SECTION 23. INTERPRETATION. The language used in this Code and in
the National Electrical Code, which is made a part of this Code by re-
ference, is intended to convey the common and accepted meaning familiar
to the Electrical Industry.
The Chief Electrical Inspector is hereby authorized to interpret
and determine the intent and meaning of any provision of this Code. Such
interpretations and determinations shall be made in writing and a record
kept, which record shall be open to the public.
SECTION 24. PENALTIES. Any person, firm.or corporation violating
any of the provisions of this Code shall be guilty of a misdemeanor and
upon conviction thereof shall be punished by a fine of nc�t mare than
Three hundred Dollars (6300.00), or by imprisonment in the °.un•y Jail for
a period of not more than ninety (90) days, or by both such fine and
imprisonment.
SECTION 25. VIOLATIONS. Every,person, firm or corporation violating
any of the provisions of this %ode shall be deemed guilty of a separate
offense for each day or portion thereof during which such violation
continued and shall be punishable therefor as herein provided.
SECTION 26. PROHIBITIONS. It is unlawful for any person, firm or
corporation, either as owner, architect, contractor, artisan or other -
wise, to do or knowingly to cause or permit to be done any electrical
wiring as defined in this Code in such manner that the same shall not
conform to all of the provision of the Code.
SECTION 27. REPEAL OF CONFLICTING ORDINANCES. Ordinance No.188
(New Series), and all ordinances or parts of ordinances which are in
conflict with the provisions of this ordinance are hereby repealed.
SECTION 28. VALIDITY. If any section, sub - section, sentence,
clause or phrase of this ordinance is, for any reason, held to be
unconstitutional or legally ineffective, such decision shall not
affect the validity of the remaining portions of this ordinance.
The City Council of this City declares that it would have adopted
this ordinance and each section, sub- section, clause or phrase thereof,
irrespective of the fact that any one or more sections, sub - sections,
sentences, clauses or phrases'be declared unconstitutional or legally
ineffective.

SECTION 29. EFFECTIVE DATE. This ordinance, together with
the Ayes and Noes, shall be published for two days before its' final
passage in the Telegram- Tribune, a daily newspaper printed,;pub
lished and circulated in said city, and the same shall take effect
and be in force-thirty days after its final passage.
