ORDINANCE NO. 317 (1965 Series)
AN ORDINANCE AMENDING A PORTION CF SECTION
9100.8 OF THE SAN LUIS OBISPO MUNICIPAL CODE,
PROVIDING ADDITIONAL CONTROLS ON SUBDIVISIC14S
BE IT ORDAINED by the Council of the City of San Luis Obispo as follows:
SECTION 1. That Section 9100.8.8 c shall be and is hereby amended to read
Section 9100.8.8 c - STANDARD SUBDIVISION PROCEDURE
If the Planning Commission determines that a potential flood hazard
inundation or geological hazard exists on any portion or portions of the property, they
may require a written report setting forth the effect of such hazards on the proposed
development and the steps to be taken to minimize or eliminate said hazards. The
Planning Commission may disapprove all or any portion of the property so affected or
require protective improvements to be constructed as a condition precedent to acceptance
of the subdivision. In the event any portion or portions of the property on a Final /Tap or
Record of Survey is subject to flood hazard inundation or geological hazard, such fact
and portion or portions of the property affected shall be clearly shown on such Final Map
or approved Record of Survey by a prominent note on each sheet of such Nap wherein
such portion is shown.

SECTION 3. This Ordinance, together with the ayes and noes, shall be published
once in full, at least three days before its final passage, in the Telegram- Tribune, a news-
paper published and circulated in said City, and the same shall go into effect at the
expiration of thirty days after its said final passage-

13 in Subdivisions
At the request of the City Council the Planning Commission has studied this
problem and endorses the following recommendations submitted to them by the City
Engineer:
"Following are two provisions used by Los Angeles County (modified to fit our
circumstances) in setting up geological controls in subdivisions.
1. If the Planning Commission finds that a geological report is necessary to
determine whether the property to be subdivided is subject to an existing or
potential geological hazard, a written report stating how the geological
conditions will affect the proposed development may be required. The report
shall be prepared by a geologist experienced in engineering matters.
2. Land Subject to Flood Hazard, Inundation, or Geological Hazard.
If any portion of the land within the boundaries shown on a tentative map,
or maps, of a subdivision or approved record of survey is subject to flood
hazard, inundation, or geological hazard and the probable use of the property
will require structures thereon, the Planning Commission may disapprove the :, ,
map or maps so affected, and require protective improvements to be constructed
as a condition precedent to approval of the map or maps.
If any portion of a lot, or lots of a final subdivision or approved record of
survey map is subject to flood hazard, inundation, or geological hazard, such
fact and portion shall be clearly shown on such final map by a prominent note
on each sheet of such map whereon any such portion is shown.
I believe control at the tentative map stage would be furnished by the insertion
of the following requirements.
'Where slopes in excess of 5% accur within the area to be subdivided, a pre-
liminary grading plan, indicating the general location and magnitude of cuts
and fills may be required by the Director of Public Works.'"
