AN ORDINANCE REGULAT I1 \TG THE KEEPING OF ANI.ATALS,
POULTRY AND HOUSEHOLD PETS IN THE CITY OF SAN
LUIS OBISPO.
BE IT ORDAINED by the Council of the City of San Luis Obispo,
as follows:
SECTION 1. The City Council does hereby find and determine
that'the growth and development of the City for residential purposes
has reached such a stage that the keeping of animals within the
City, unless properly regulated as to location and sanitary con-
ditions and as to certain animals unless definitely limited in num-
ber or entirely prohibited, is detrimental to public health, safety
and general welfare and that the public interest requires that the
City Council prescribe the following rules and regulations with,
respect thereto.
SZOMIDN 2. DEFINITIONS. Wherever the word "CITY" is used
in this Ordinance it shall be construed to glean the City of San Luis
Obispo.
Wherever the word "ANTS UI LS" is used herein it shall be
construed to include horses, ponies, mules, jacks, jennies, cows,
bulls, calves, heifers, sheep, goats, swine, rabbits and all other
domestic or domesticated animals other than household pets.
Wherever the term "POULTRY" is used it shall be construed
to include pigeons, chickens, ducks, geese., turkeys and all other
domestic or domesticated fowls other than household pets.
Wherever the term "HOUSEHOLD PETS" is referred to herein
it shall be construed to include cats, dogs, canaries, parrots, and
other kindred animals and birds usually and ordinarily kept as
household net s.
SECTION 3. UNSANITARY CONDITIONS. It is hereby declared to
be a nuisance and it shall be unlawful for any person to keep or
permit to be kept upon any premises, any animals or poultry or
household pets in a. foul, offensive, obnoxious, filthy or unsani-
tary condition.
SECTION 4. ANIMIALS AT LARGE. It is hereby declared to be
a nuisance and it shall be unlawful for any person to allow or permit
animals or poultry, other than household pets; to run at large upon
any public street or place, or to trespass upon the property of
another. This provision shall not be construed as permitting the
running at large of any household pets who are restricted by the
provisions of any other ordinances of this City or by any law ap-
plicable thereto.
SECTION 5. UNNECESSARY NOISE. It is hereby declared to be
a nuisance and it shall be unlawful to keep, paintbin, or permit on
any lot or parcel of land, any animals, poultry or household pets,

which by any sound or cry shall disturb the peace and comfort of
any neighborhood, or interfere with any person in the reasonable
and comfortable enjoyment of life or property.
SECTION 6. LIMITATIONS. RABBITS— POULTRY. It is hereby de-
clared to be a nuisance and it shall be unlawful to keep or permit to
be . kept , upon any premises in said City, any rabbits or poultry:
(a) Within fifty feet of any dwelling, or
(b) If more than thirty in all of any such rabbits or
poultry are kept, within seventy —five feet of any dwelling.
It shall be unlawful to keep or permit to be kept upon any
premises in said City, more than two hundred in all, ofsuch rabbits
or poultry, except by special permit of the City Council first had
and obtained, or to keep any rooster of crowing age within one
hundred feet of any dwelling. This provision limiting the maximum
number of rabbits or poultry to two hundred in all shall n t b plus

operation as of the effective date hereof, where the average
number of rabbits or poultry ordinarily kept at any such establish-
ment exceeds said number:
SECTION 7. HORSES, CALVES, GOATS, ETC: It'is hereby declar-
ed to be a nuisance and it shall be unlawful, to keep or permit to be
kept upon any premises in the City, any horse, mule, jack, jenny, cow,
bull, calf, heifer, sheep, goat:
(a) On any lot containing less than 10,000 square feet,or
(b) In any corral or barn within seventy —five feet of any
dwelling.
SECTION 8. S77INE, HOGS, PIGS. It is hereby declared to be
a nuisance and it shall be unlawful to keep or permit to be kept
upon any premises in the City any swine, hog, or pig, whatsoever.
SECTION 9. SPECIAL PER"ITS — PUBLIC HEARINGS. In the event
that any person believes that unreasonable restrictions or unnecessary
and extraordinary hardship, or damage will be imposed upon him, from
the carrying out of the strict letter of any of the provisions of
this Ordinance, he may request a hearing thereon before the City
Council and if the City Council finds that unreasonable restrictions,
unnecessary and extraordinary hardship or damage will be imposed upon
him, then any of the provisions or regulations hereof may be modified
in harmony with the general purposes and objectives hereof to the
end that the public health, safety and welfare of the people may be
secured and substantial justice done. Any decision of the City
Council rendered after a hearing held shall be final and conclusive.
SECTION 10. EFFECTIVE DATE. This Ordinance, together with
the Ayes and Noes, shall be published for two days before its final
passage in the Telegram— Tribune, a daily newspaper printed, publish-
ed and circulated in said City, and the same shall take effect and
be in force thirty days after its final passage.
