AN ORDINANCE REZONING A PORTION OF LAGUNA
LAKE VILLAGE TRACT 322 FROM U TO R -1
BE IT ORDAINED by the Council of the City of San Luis Obispo as follows:
SECTION ONE. That Lots 1 through 52 of Tract 322, Laguna Lake Village, in
the City of San Luis Obispo, shall be and are hereby rezoned from U Land Use District to
R -1 Land Use District in accordance with the map attached hereto, marked Exhibit "A" and
incorporated herein by reference.
SECTION TWO. That the Official Zoning lva.p of the City of San Luis Obispo, as
set forth in Section 9200.5 of the San Luis Obispo Municipal. Code, shall be modified to
reflect said zoning changes.
SECTION THREE. That this Ordinance, together with the ayes and noes, shall
be published once in full, at least three days before its final passage, in the Telegram -
Tribune, a newspaper published and circulated in said City, and the same shall go into
effect at the expiration of thirty days after its final passage.

AMEND Section 9200.18.2. MAP DESIGNATIONS to read as follows:
A. Planned Development Districts shall be designated on the Zoning
Map as follows:
1. Interim:
After the preliminary plan has been approved by the Council,
"PD" with the new land use designation and identification num-
ber shall be added to the existing zoning. (i.e. R1 :PD /R. 62 -1)
2. Final:
Upon completion of the development the former zoning desig-
nation shall be deleted. (i.e. PD /R . 62-1)
AMEND Section 9200.15.3. APPLICATION PROCEDURE to read as follows:
A . Preliminary Development Plan
1. Application for a Preliminary Development Plan, accompanied
by the following plans to scale and supporting documents shall
be submitted to the Planning and Building Department with a
fee of sixty (60) dollars. Twelve (12) copies of the proposed
plot plan and a reduced tracing or transparency (8 1/2" x 11 ")
may be required by the Planning Director.
a. Location plan showing the adjoining streets in relation
to the nearest major streets; also adjoining uses and
zoning.
b. A written description of the improvements proposed.
C. A plot plan showing the location of all structures,
landscaping, parking, and other uses related to the
generaltopography.
d. Sketches showing the architectural treatment of build-
ings, signs, and other structures.
e. A time schedule for the construction of the various
phases of the development.
f. If retail uses are proposed, an economic report
showing how the uses will be programmed in relation
to the growth of the trade area which will support
them.
g. Any part of the proposal which would normally require
a Use Permit or Variance shall be indicated on the plot
plan and explained in the written description.
2. The Planning Director shall arrange a study meeting of the
Subdivision Review Board or a subcommittee of the Planning
Commission; at his discretion, to discuss the proposal with
the applicant.
3. The application, amended to include any changes recommended
and accepted by the applicant at the study meeting, shall then
follow the hearing procedure set forth in Section 9200.19.
except that the Council may approve the application by Reso-
lution.
B. Precise Development Plan
1. Within the time limits specified in the approval of the Pre-
liminary Plan, a Precise Development Plan of each stage shall
be submitted to the Planning and Building Department, ac-
companied'by the following plans to scale and supporting
documents. Three (3) copies of the plot plan shall be sub -
miffed and an 8 1/2" x 11" transparency or tracing.

a. Location of buildings and structures and uses con-
tained therein; location of exits and entrances;
height, number of floors, and gross floor area of
each building.
b. _Existing and proposed contours at two (2) foot inter-
vals.

C. Surface drainage, sewer and wa.te:f lines, fire
hydrants, and related calculations. Street lighting,
gas and electric mains.
d. Vehicular and pedestrian circulation, street con
struction plans.
e. Details of off - street parking and loading facilities.
f. Open spaces, landscaping, fences, and walls.
g. Detailed design of free- standing signs. General
indication of signs on buildings.
2. The Precise Development Plan shall be reviewed by the City
Engineer and Planning Director for conformity with the
approved Preliminary Plan and time schedule. If satisfactory,
the Plan shall then be referred to the next regular meeting of
the Planning Commission for approval. No building permit
shall be issued for any part of the development prior to ap-
proval of the Precise Plan by the Planning Commission.
3. No change, other than minor adjustments, may be made to an
approved Precise Plan until the revision has been approved
by the Commission and the Council.
DELETE The following Sections in their entirety:

AMEND Section 9200.19 AMENDMENTS to read as follows:
This Chapter may be amended by the following procedure:
A. An amendment may be initiated by:
1. Application from the property owner(s) affected, accom-
panied by a fee of Sixty Dollars ($60.00).
2. Resolution of Intention of the Council, or by
3. Resolution of Intention of the Planning Commission.
B. Public Hearing:
1. The Planning Commission shall hold a public hearing after
giving notice of the time and place by publication in a news-
paper of general circulation within the City at least ten (10)
days beforehand.
2. If the proposal involves a change to the Zoning Map, ad-
ditional notices. of the time and place of the hearing shall be
given as follows:

a. Posting each street frontage of the property to be
rezoned or the nearest street access, if the property
does not abut a dedicated street.
b. Notification by first class mail to owners of the pro-
perty affected and those within a radius of three
hundred (300) feet, as listed on the assessment rolls.
c. Omission to post or notify by mail shall not invalidate
any amendments duly adopted.
C. Action by Planning Commission:
The Commission shall submit a recommendation to the City
Council within sixty (60) days of the hearing, provided that
such time may be extended by agreement with the applicant.
D. Action by the Council:
1. Approval or Conditional Approval by Commission:
The Council shall hold a public hearing, after ad-
vertising'the time and place as required by Sub-
section B.1.
2. Denial by Commission:
The Council shall hold a public hearing only if so
requested in writing by the applicant within five (5)
days of the Commission's action.
AMEND Section 9200.21 ENFORCEIVIENr to read as follows:
A . The Director of Planning and Building shall be responsible for
enforcing the provisions of this Chapter and shall issue no permit
in conflict with these provisions. Any such permit issued shall be
null and void.
B. Any use established or building constructed or altered contrary to
the provisions of this - Chapter is hereby declared to be unlawful
and a public nuisance. Any such illegal use of structure shall be
reported to the City Council, who may order the City Attorney to
commence immediate action for the abatement thereof.
DELETE Section 9200.22 REFERENCE
AMEND Footnote 4 - notes on zoning charts as follows:
4. May be reduced to ten (10) feet on certain corner lots as shown on
diagram No. 2 and the long frontage of a lot recorded before April
1, 1965, except that a garage or carport facing the street must be
set back twenty (20) feet.
ADD Section 9200.25. ZONING DISTRM CHARTS
Sections 9200. 11, 1la, Ilb, 9200. 13, 9200. 14, 9200.15x, 15b, 15c, and
15c are hereby amended as set forth on the Zoning District Charts attached
hereto.
