AN ORDINANCE ATTENDING SECTION 14 OF ORDIN-
ANCE NO. 309 (NEW SERIES), ENTITLED "AN
ORDINANCE OF THE CITY OF SAN LUIS OBISPO,
CALIFORNIA, FIXING RATES TO BE CHARGED FOR
WATER FURNISHED BY SAID CITY TO CONSUh11RS
WITHIN AND CONSUMERS OUTSIDE THE CORPORATE
LIMITS OF SAID CITY, PROVIDING AND SPECIFY-
: ING CONDITIONS UNDER WHICH ;%TER SHALL BE
FURNISHED BY SAID CITY TO SAID CONSUMERS AND
MAKING REGULATIONS WITH RESPECT THERETO; IM-
POSING PENALTIES FOR THE VIOLATION HEREOF;
AND REPEALING ORDINANCE NO. 20 (NEW SERIES)
AND ORDINANCE NO. 205 (NEW SERIES) AND ALL
OTHER ORDINANCES IN CONFLICT HEREWITH ", AND
ADDING SECTIONS 28, 29 AND 30 TO SAID
ORDINANCE.
BE IT ORDAINED by the Council of the City of San Luis Obispo
as follows:
SECTION 1. Section 14 of Ordinance,No. 309 (New Series) , the
title of which is set forth in the title of this ordinance, is
hereby amended to read as follows:
Section 14. USE OF FIRE HYDRANTS. (a) Public fire hydrants
shall be placed, maintained and repaired by the water works depart-
ment, except as hereinafter provided in Section 28. Any damage
thereto by persons or agency other than representatives of the
fire'or water departments, shall be a claim against the person or
agency committing such damage, and the superintendent of the water
department shall t,:ke such action as may be necessary to collect
the same.
(b) Fire hydrants are provided for the sole purpose of
extinguishing fires and shall be used otherwise only as herein
provided for, and shall be opened and used only by the water and
fire departments or such persons as may be authorized to do so by
the Chief of the Fire Department or the Superintendent of the Water
Department as herein provided.
(c) All persons, firms or corporations desiring to use water
through fire hydrants, or other hydrants owned or controlled by the
City, shall be required to obtain a permit, first, from the Chief

of the Fire Department, second, from the Superintendent of the
Water Works Department who shall issue no such permit to any per-
son who has violated any of the provisions of this Ordinance or
whose indebtedness to the City for water used or damage to hydrants
or equipment is delinquent. And all such persons having permit for
use of water from fire hydrants must provide hydrant wrenches for
the operation of such fire hydrants.
(d) Permit for the use of water through the fire hydrants of
the City may be cancelled at the will of the Superintendent of the
Water Department on evidence that the holder thereof is or has
violated the privileges conveyed thereunder. Such notice of can-
cellation shall be in writing officially delivered to the persons
to be notified and shall be immediately effective and enforced.
(e) A minimum fee of Two Dollars ($2.00) shall be paid for
each permit issued to use water from any fire hydrant.
If at the time the permit is issued the applicant estimates
that he will use more than the minimum amount of water from a fire
hydrant, the Water Superintendent may install a temporary meter for
the measurement of the water used from said fire hydrant and the
consumer shall pay for such water, the rates provided for in Section
4 hereof.
SECTION 2: Section 28 is hereby added to Ordinance No. 309
(New Series) , the title of which is set forth in the title of this
ordinance, and which said section shall read as follows:
Section 28. Subdivision Water Service. Where water service
is required for new subdivisions or other unimproved areas, it will
be the responsibility of the owner or subdivider to pay the cost
of the complete installation of all distribution facilities, includ-
ing distribution mains, fire hydrants, service connections, and
necessary supply mains, extending to the nearest point of existing
service, subject to the approval of location, workmanship and
material by the City Engineer. Inspection shall be provided by the

City and the subdivider or owner billed for the actual cost there-
of. The City shall assume full ownership, control and mainten-
ance upon completion by the owner or subdivider, and acceptance by
the City.
SECTION 3. Section 29 is hereby added to Ordinance No. 309
(New Series), the title of which is set forth in the title of this
ordinance, and which said section shall read as follows:
Section 29. Twain Extensions. The Water Department will
extend its water distribution mains to new customers, other than
those in subdivisions or unimproved areas, at its own expense when
the required total length of main extension from the existing
facilities is not in excess of 100 feet per service connection. If
the total length of main extension is in excess of 100 feet per
service, the applicant or applicants for such service shall be
required to pay the amount over and above the cost of the said 100
feet of main per service; provided, however, that in no case will
the above charge be based upon a main in excess of four (4) inches
in diameter. The money so advanced will be refunded, without
interest, upon the basis of the cost of 100 feet of main for each
additional service connected to the extension for which the charge
has been made, within a period of ten (10) years, but in no case
shall the total refund exceed the original amount so advanced.
SECTION 4. Section 30 is hereby added to Ordinance No. 309
(New Series), the title of which is set forth in the title of this
ordinance, and which said section shall read as follows:

Mains. The
size of any water
main
installed
upon any
existing
or proposed city
street, lane, alley, or easement, or upon any private street, lane,
alley, or easement shall be not less than 4" diameter, except that
where in the opinion of the City Engineer a water main of lesser
diameter is justified, such smaller main may be installed with con-
sent of the City Council. All such water mains shall be installed

in suc.h locations as may be designated by the City Engineer. All
water mains and fittings of 4" diameter or larger shall conform
to AYAVA standards and shall be either cement lined cast iron pipe
class 150, or cement asbestos pipe class 150. All water mains of
less than 411 diameter shall be of such type and material as may be
approved in writing by the City Engineer.
S2CTION 5. This Ordinance, together with the Ayes and Noes,
shall be published for two days before its final passage in the
Telegram- Tribune, a daily newspaper published and circulated in
said City, and the same shall take effect and be in force thirty
days after its final passage.
