DA I N E D by the Council of the City of San Luis Obispo as follows: SECTION 1. That Section 9200.1 of the San Luis Obispo Municipal Code, entitled "Definitions, " shall be and is hereby amended to include a definition of Drive -In i eestaurants, said Section to read as follows: Section 9200.1. Definitions For the purpose of this Chapter, certain terms used herein are defined as follows: Building: Any structure having a roof. Drive -In Restaurant: Any premises with off - street parking and upon which premises are located restaurants, eating or food establishments from which pre- pared food or drink, capable of being consumed in automobiles on the premises, is sold or served and at least some of such food is so consumed. Family: An individual or two (2) or more persons related by blood, marriage or a option, plus -not more than two (2) persons, excluding fulltime servants, who are not related by blood, marriage or adoption, living together as a single housekeeping unit in a dwelling, unit. Hei n ht of Building: The vertical distance from the average level of the highest alowest point of that portion of the lot covered by the building to the topmost point on the roof. Home Occupation: Gainful employment engaged in by the occupants of a dwelling su ject to-ffe requirements of Section 9200.16.2, entitled "Home Occupations. " Hotel /Motel: A building or group of buildings, with or without kitchens, used primari y for the accommodation of the traveling public. junk Yard: The use of more than one hundred (100) square feet of the area of any lot for thee storage of junk, including scrap metals, salvage or other scrap materials, or for dismantling or wrecking of automobiles or other vehicles, or machinery, whether for sale or storage. Lot: A legally subdivided and recorded area of land having frontage on a City street, except as otherwise provided in this Chapter. Parkin Space: An accessible and usable space for the parking of automobiles off the street which c-h complies with the requirements of Section 9200.16.1, entitled "Parking Regulations. " Street: A public thoroughfare which affords access to abutting property. Yard: Required open area unoccupied by any structure except as permitted by this Meter. Yard Street: That area extending along a property line adjoining any street(s) or Buil ing etbaack Line adopted under Section 9300. Formerly "Yard Front. " (Also includes side yard on a corner lot.) Yard Other: That area extending along any property line which does not adjoin a street. Formerly "Yard Rear" and "Yard Side. " SECTION 2. That Subsection E, entitled "Yards" of Section 9200.16 of the an Luis Obispo Municipal Code, entitled "General Legulations, " shall be and is hereby amended to read as follows: / . Where four (4) or more lots in a block have been improved with buildings, the minimum required street yard for main buildings shall be the average of the improved lots if less than the street yard requirements herein. 2. Cornices, eaves, roof overhangs, trellises, beams, joists, and other similar roof projections may extend or project into required yards according to the following chart: TYPE OF YARD Street Other Yards PROJECTION ALLOWED One-third of the required yard to a maximum of five feet. Six inches for'each one foot of required yard. 3. Wherever a Building Setback Line has been established, street yards shall be measured from such line. SECTION 3. That Section 9200.25 of the San Luis Obispo Municipal Code, entitled. "Zoning District Charts, " shall be and is hereby amended as set forth on the Zoning District Charts attached hereto and incorporated by reference. SECTION 4. This Ordinance, together with the ayes and noes, shall be published once in full, at least three days before its final passage, in the Telegram- Tribune, a news- paper published and circulated in said City, and die same shall go into effect at the expir- ation of thirty days after its said final passage.
