HomeMy WebLinkAbout0381NORDINANCE N0. 3$1 (New Series) AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO ESTABLISHING SETBACK LINES ALONG BOTH SIDES OF FOOTHILL BOULEVARD FROM MT. PLEASANTON DRIVE TO SANTA ROSA STREET. BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. That the Council of the City of San Luis Obispo does find and determine that the public safety, convenience and welfare require, and it is hereby ordered that the minimum distance back from the street line for the erection of buildings, walls, fences or structures along both sides of Foothill Boulevard from Mt. Pleasanton Drive to Santa Rosa Street shall be thirty feet each side of the existing property lines. SECTION 2. No building, wall, fence or other structure shall be erected or constructed or caused to be erected or constructed, and it shall be unlawful for any person, firm or corporation to erect or construct, or to cause to be erected or to be constructed, or to begin or engage in the construction, or erection of any building, wall, fence or :other structure within the space between the setback lines described and established in Section 1 of this ordinance and the line of the street infront of the property on which said setback lines exist. SECTION 3. Any person, firm or corporation violating any of the provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction therefor shall be punishable by a fine of not more than $500.00, or by imprisonment in the jail of tie County of San Luis Obispo for a period of not more than six months, or by both such fine and imprisonment. SECTION 4. This ordinance, together with the Ayes and Noes, shall be published for two days before its final passage in the Telegram - Tribune, a daily newspaper printed, published and circulated in said City, and the same shall take Offect and be in force thirty days after its final passage. -1- pf rally Passed this day of 'by th-r, folloving vote'.
