ORDINANCE NO. 334 (1957 Series)
AN ORDINANCE ADDING A REQUIREMENT FOR
SOILS REPORTS AND TESTING IN SUBDIVISIONS
B E I T O R DA I N E D by the Council of the City of San Luis Obispo as follows:
SECTION 1. Purpose. It is hereby declared that this Ordinance is enacted pursuant
to Sections 17953 - 17957 inclusive of the Health and Safety Code of the State of California.
Because of the danger to the health and welfare of potential residents of new subdivisions, it
is necessary for this ordinance to take effect immediately.
SECTION 2. Sections 9100.8.1, 9100.8.2, and 9100.8.3 are hereby added to the
San Luis Obispo Municipal Code, to read as follows:
Section 9100.8.1. Preliminary Soil Report. Prior to the submission of the
Final Map of any subdivision, as defined in Sections 11535 and 11535.1 of the Business and
Professions Code of the State of California, and related provisions of the San Luis Obispo
Municipal Code, or any minor subdivision, as defined in the San Luis Obispo Municipal Code,
the subdivider shall file with the City Engineer a preliminary soil report, prepared by a civil
engineer who is registered by the State of California, based upon adequate test borings or
excavations. The preliminary soil report may be waived if the City Engineer shall determine
that, due to knowledge of his department as to the soil qualities of the subdivision or minor
subdivision, no preliminary analysis is necessary.
Section 9100.8.2. Soil Investigation. If the preliminary soil report indicates
the presence of critically expansive soils or other soil problems which, if not corrected, woult
lead to structural defects, a soil investigation of each lot in the subdivision or minor sub-
division shall be prepared by a civil engineer who is registered by the State of California. The
soil investigation shall recommend corrective action which is likely to prevent structural
damage to each dwelling proposed to be constructed on the expansive soil. Copies of the re-
port shall be filed with the City Engineer and the City Planning and Building Department.
Section 9100.8.3. Approval of Soil Investi tion The City Engineer and the
City Planning and Building Department shall approve the soil investigation if they determine
that the recommended corrective action is likely to prevent structural damage to each dwell -
ing to be constructed on each lot in the subdivision. Appeal from such determination shall be
to the City Council. The building permits for such lots shall be conditional upon the incorpor-
ation of the approved recommended corrective action in the construction of each dwelling.

SECTION 3. This Ordinance, together with the ayes and noes, shall be published
once in the Telegram- Tribune, a newspaper published and circulated in said City, and the
same shall take effect and be in force immediately.
