AN ORDINANCE CALLING A SPECIAL MUNICIPAL BOND ELECTION IN THE
CITY OF SAN LUIS OBISPO FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS
OF SAID CITY THE MEASURE OF INCURRING A BONDED INDEBTEDNESS OF SAID
CITY FOR THE ACQUISITION, CONSTRUCTION AND COMPLETION OF THE FOLLOW-
ING MUNICIPAL IMPROVEMENT, TO WIT: WATER SUPPLY;'DECLARING THE
ESTIMATED COST OF SAID MUNICIPAL IMPROVEMENT, THE AMOUNT OF THE
PRINCIPAL OF SAID INDEBTEDNESS TO BE INCURRED THEREFOR, AND THE
MAXIMUM RATE OF INTEREST TO BE PAID THEREON; MAKING PROVISION FOR
THE LEVY AND COLLECTION OF TAXES; FIXING THE DATE OF SAID ELECTION,
THE MANNER OF HOLDING THE SAME, PROVIDING FOR NOTICE THEREOF, AND
CONSOLIDATING SAID SPECIAL MUNICIPAL BOND ELECTION WITH THE GENERAL
MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON APRIL 9, 1957•
WHEREAS, The City Council of the City of San. Luis Obispo,
by resolution duly passed and adopted at a meeting of said City
Council duly and regularly held, by affirmative vote of more than
two- thirds of all of its members, did determine that the public
interest and necessity demand the acquisition, construction and
completion of the municipal improvement hereinafter mentioned,
and did further determine the cost of said proposed municipal im-
provement will be too great to be paid out of the ordinary annual
income and revenue of said municipality, and that said municipal
improvement will require an expenditure greater than the amount
allowed therefor by the annual tax levy and will require the in-
curring of a bonded indebtedness therefor, which resolution was
duly entered on the minutes of said meeting of said City Council,
and is now on file and of record in the Clerk's office of said
City, now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SAN LUIS
OBISPO, as follows:
Section 1. A special municipal bond election be and is
hereby ordered and will be held in said City of San. Luis Obispo
on Tuesday, April 9, 1957, at which election shall be submitted to
the qualified electors of said City the question of incurring a
bonded indebtedness of said City for the object and purpose set
forth in. the following measure, to wit:
MEASURE: Shall the City of San Luis Obispo
Wa er Supply) incur a bonded indebtedness in the
principal amount of $3,900,000 for
the acquisition, construction and completion of the
following municipal improvement, to wit: Additions and
improvements to the water supply, including dam on Old
Creek, Whale Rock Reservoir and diversion works, pipelines,
pumping stations, and connections to City distribution
facilities, take -off extensions to the existing water system
of the California Men's Colony and California Polytechnic
College, together with lands, easements, rights-of-ways,
water, water rights, and other works, property or
structures necessary or convenient for the water supply
of the City of San Luis Obispo?
The estimated cost of the municipal improvement as set forth in
said measure is the sum of $3,900,000 and the amount of the in-
debtedness proposed to be incurred for said municipal improvement
is the sum of $3,900,000 which estimated cost is the estimated cost
to the City itself and likewise said indebtedness is the amount to
be incurred by the City. The water supply project in. its entirety
will be a cooperative enterprise of the City and the State of
California. The estimated cost of the complete project is $6,928,700,
of which amount it is contemplated that the State of California
will advance approximately $3,117,400 and the balance, together with
incidental expenses, will be contributed by the City. The City
will not incur indebtedness in excess of $3,900,000 for said water
supply.

Section 2. The City Council does hereby submit to the
qualified electors of said City of San Luis Obispo at said special
municipal bond election. the said measure set forth in. Section 1 of
this ordinance, and designates and refers to said measure in the
form of ballot hereinafter prescribed for use at said election.
(a) Said special municipal bond election.shall be held
and conducted, and the votes thereof canvassed, and the returns
thereof made, and the result thereof ascertained and determined as
herein provided; and in all particulars not prescribed by this
ordinance, said election shall be held as provided by law for the
holding of municipal elections in said City.
(b) All persons qualified to vote at municipal elections
in said City of San Luis Obispo upon the date of the election herein
provided for shall be qualified to vote upon the measure submitted
at said special municipal bond election.
(c) The polls at the polling place hereinafter designated
shall be opened at seven.o'clock A.M. of said day of election and
shall be kept open.con.tinuously thereafter until seven.o'clock P.M.
of said day of election, when, the polls shall be closed (except
as provided in Section 573+ of the Elections Code), and the election.
officers shall thereupon.proceed to canvass the ballots cast thereat.
(d) Said special municipal bond election hereby called
is hereby consolidated with the general municipal election. to be
held in. said City of San. Luis Obispo on. April 9, 1957, all as re-
quired by and pursuant to law and the Charter of said City; and the
election precincts, polling places and officers of election within
said City for said special municipal bond election hereby called
shall be the same as those designated and selected by the City Council
of said City for said general municipal election as set forth in
its Resolution No. 181 (1957 Series), entitled "A Resolution Providing

passed and adopted February 18, 1957 and also pursuant to the
notice of said general municipal election. to be published on or

about February 27 1957 in the San Luis ObispoATelegram- Tribune
by the City Clerk of said City, to which Resolution and notice
of said general municipal election. reference is hereby specifically
made for a designation of the precincts, polling places and
election officers within. said City for the purposes of said special
municipal bond election.hereby' called.
(e) Only one form of ballot shall be used at said
general municipal election. and said special municipal bond election.
hereby consolidated therewith which, in addition to all other
matters required by law to be printed thereon, shall state the
Measure set forth in Section 1 hereof.
(f) Each voter to vote for said measure hereby submitted
and for incurring said bonded indebtedness set forth in said
measure shall stamp a cross (X) in the blank space opposite the
word "YES" on the ballot to the right of said measure, and to vote
against said measure and against incurring said indebtedness shall
stamp a cross (X) in the blank space opposite the word "NO" on. the
ballot to the right of said measure. On absent voters' ballots
the cross (X) may be marked with pen.or pencil.
(g) The returns of said election. shall be made out and
signed by the election officers and shall be by them deposited with
the City Clerk, together with the ballots cast at said election;
and this City Council shall meet at its usual meeting place and
canvass said returns on Tuesday,.April 16, 1957 (being the first
Tuesday after said election.) at the hour of 8:00 P.M., and declare
the result of said special bond election and the result of said
general municipal election.

Section. 3. The City Council proposes to issue and sell
bonds of said City of San Luis Obispo in. the amount and for the
object and purpose specif iedin said measure if two- thirds of the
qualified electors voting on such measure at said special municipal
bond election shall vote in. favor of said measure. Said bonds
shall be negotiable in form and of the character known as serial,
and shall bear interest at a rate not exceeding five (5) per
cent. per annum, payable semi- annually (except that interest for
the first year after the date of said bonds may be made payable at
or before the end of said year). Provision is hereby made for
the payment of the principal of and interest on said bonds as follows:
At the time of making the general tax levy after incurring the
bonded indebtedness, and annually thereafter until the bonds are
paid or until there is a sum in. the treasury set apart for that
purpose sufficient to meet all payments of principal and interest on
the bonds as they become due, the City Council of the City of
San Luis Obispo shall levy and collect a tax sufficient to pay the
interest on. the bonds and such part of the principal as will be-
come due before the proceeds of a tax levied at the next general
tax levy will be available; provided, however, that if said bonds
are authorized to be issued at said election, and it is expected that
all or any part of said bonds will be sold at such time that the
principal of or interest on such bonds will become due before the
proceeds of a tax levied after such sale would be available to pay
such principal or interest, the City Council, at the time of fixing
the annual tax levy, may levy a tax in, an amount clearly sufficient
to pay that portion. of the principal of and interest on said bonds
which it is expected will become due before the proceeds of the
next succeeding tax levy will be available. If the earliest maturity

of the bonds is more than one year after the date of issuance,
the City Council shall levy and collect annually a tax sufficient
to pay the interest as it falls due and to constitute a sinking
fund for the payment of the principal on or before maturity. Such
taxes shall be levied and collected as other City taxes and shall
be in. addition to all other taxes and shall be used only for
payment of the bonds and interest thereon.
Section 4. The City Clerk of the City of San. Luis Obispo
is hereby directed, following the introduction. and reading of
this Ordinance, to cause the same to be published at least once

in. the SAN LUIS OBISPOA TELEGRAM- TRIBUNE at least three (3) days
before its adoption, and upon the final passage and adoption of
this Ordinance, to cause the same to be published once a day for
at least seven (7) days in the SAN LUIS OBIS UMIEGRAM- TRIBUNE,
which is a newspaper published at least six (6) days a week in
said City of San Luis Obispo, and such publication shall constitute
notice of.said election. No other notice of the election.hereby
called need be given..
Section 5. This ordinance upon its final passage and
adoption shall be entered upon the minutes of this City Council and
in the Ordinance Book of said City. This ordinance, being an
ordinance calling and ordering an. election, shall take effect from
and after its final passage and adoption.
