HomeMy WebLinkAbout0390NORDINANCE NO.390 (New Series) AN ORDINANCE PROHIBITING THE PRACTICE OF FORTUNE TELLING, PALMISTRY, CLAIRVOYANCE, PHRENOLOGY, MEDIUM OR LIKE CRAFTY SCIENCE IN THE CITY OF SAN LUIS OBISPO, PRESCRIBING PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. BE IT "ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. It shall be unlawful for any person within the corporate limits of the City of San Luis Obispo toask or receive any fee, compensation, gratuity or reward for conducting or practicing fortune telling, palmistry, clairvoyance, phrenology, medium or like crafty science, provided that this shall not apply where the same is carried on as a part of an entertainment program in a permanently established theater or motion picture show in the City of San Luis abispo, nor to occasional entertainments for the benefit of charitable organizations. SECTION 2. Any person who asks or receives any fee, compen- sation, gratuity or reward for conducting or prancing fortune telling, palmistry, clairvoyance, phrenology, medium or like crafty science is hereby declared to be a vagrant; provided that this shall not apply where the same is carried on as a part of an entertainment program in a permanently established theater or motion picture show in the City of San Luis Obispo, nor to occasional entertainments for the benefit of charitable organizations. SECTION 3. Any person violating any of the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding three Hundred Dollars ($300.00) or by imprisonment in the County Jail of the County of San Luis Obispo, State of California, for not exceeding ninety (90) days, or by both such fine and imprisonment.
