ORDINANCE NO. 12Z ONEW SERIES)
AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO
PROHIBITING ABANDONMENT OF ICE BOXES AND
REFRIGERATORS ACCESSIBLE TO CHILDREN
WHEREAS, an emergency exists in the City of San Luis Obispo
in that instances have been reported in other cities of death due to
suffocation of children in abandoned, unused or unattended ice boxes,
refrigerators and other containers having air -tight doors which when
closed cannot be opened from the inside,
WHEREAS, these abandoned, unused, unattended or discarded
ice boxes, refrigerators and other containers are a constant menace
to the health, welfare and safety of children in the City of San Luis
Obispo:
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF SAN LUIS OBISPO, AS FOLLOWS:
SECTION 1. It shall be unlawful for any person, firm or
corporation to leave outside of any building or dwelling or any other
place accessible to children any abandoned, unused, unattended or
discarded ice box, refrigerator o:6 any other container of any kind
which has an air -tight door or lock which may not be released for
opening from the inside of said ice box, refrigerator or container,
SECTION 2, It shall be unlawful for any person, firm or
corporation to leave outside of any building, dwelling or any other

place accessible to children any abandoned, unused or discarded ice
box, refrigerator or any other container of any kind which has an
air -tight snap -lock or other device thereon without first removing
the said snap -lock or doors from said ice,box, refrigerator or
cont ainere
SECTION 3. Any person,f irm or corporation violating any
of the provisions of this ordinance shall be deemed guilty of a
misdemeanor and upon conviction thereof shall be fined not exceeding
$300.00 or by imprisonment for not in excess of thirty days. Each
day such violation is committed or permitted to continue, shall
constitute a separate offense and shall be punishable as such
hereunder.
