HomeMy WebLinkAbout0400NORDINANCE NO.400 (NEW SERIES) AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN -LUIS OBISPO ESTABLISHING SETBACK LINES ALONG BOTH SIDES OF SANTA ROSA STREET FROM MSE STREET T0; MURRAY STREET BE IT ORDAINED by the Council of the City of San Luis Qbispo as follows:. SECTION 1. That the Council of the City of San Luis Obispo does find and determine that the public safety, convenience and welfare require, and it is hereby ordered that the minimum distance back from the street line for the erection of buildings, walls, fences or structures along both sides of Santa Rosa Street - 'Monterey from /V-4-xX Street to Murray Street shall be forty -five feet from the centerline of said Santa Rosa Street. SECTION 2. No building, wall., fence or other structure shall be erected or constructed or caused to be erected or constructed, and it shall be unlawful for any person, firm or corporation to erect or construct, or to cause to be erected or to be constructed, or to begin or engage in the construction, or erection of any building, wall, fence or other structure within the space between the setback lines described and established in Section 1 of this ordinance and the line in the street in front of the property on which said setback lines exist. SECTION 3. Any person, firm or corporation violating any of the provisions of this, ordinance shall be guilty of a mis- demeanor, andupon conviction thereof shall be punishable by a fine of not more than $500 ,00, or by imprisonment in the jail of the County of San Luis Obispo for a period of not more than six months, or by both such fine and imprisonment. SECTION 4. This ordinance, together with the Ayes and Noes, shall be published, for t wo days before its final passage in the Telegram - Tribune, a daily newspaper printed, published and circulated in said City, and the sane shall take effect and be in force thirty days after its final passage. -1- �� 1 INTRODUCED AND PASSED TO PRINT this 5th day of April- , 1954 by the following vote: AYES Nels Beck, Kenneth W.Jones, Fred H.Lucksinger NOES: Paul W.Davis, Richard E.
