AN ORDINANCE REZONING PROPERTY LOCATED ON THE WEST SIDE
OF JOHNSON AVENUE BETWEEN PHILLIPS AND PEACH STREETS FROM
R -3 TO R -0 DISTRICT.
BE IT ORDAINED by the City Council of the City of San Luis Obispo as follows:
SECTION 1. That certain parcel of real property in the City of San Luis
Obispo located on the west side of Johnson Avenue between Phillips and Peach
Streets, more particularly described as follows:
That portion of Block 2 of Hathway's Addition to the City of San Luis
Obispo, according to map filed for record October 18, 1887, in the
office of the County Recorder of San Luis Obispo County and that portion
of Block 40 of the City of San Luis Obispo, according to map filed for
record May 1, 1878, in the office of the County Recorder of San Luis
Obispo County, all in the City of San Luis Obispo, County of San Luis
Obispo, State of California, described as a whole as follows:
Beginning at a point on the northwesterly line of Peach Street distant
thereon 120 ft. northeasterly from the most southerly corner of said
Block 40; said point being the easterly corner of the property conveyed
to Manuel T. de Souza by deed recorded January 17, 1878, in Book J, at
page 430 of Deeds; thence north 360 22' west along the northeasterly
line of the property so conveyed 300 feet to the southerly line of the
property conveyed to W. H. Nelson by deed recorded November 30, 1880,
in Book M, at page 407 of Deeds; thence northeasterly along said
Southerly line to the most southerly corner of the property conveyed
to San Luis Obispo School District, by deed dated April 9, 1923, and
recorded April 19, 1923, in Book 160, at page 244 of Official Records;
which point is 150 feet east from, and at right angles to the easterly
line of Hathway Avenue; thence north along a line parallel with said
Hathway Avenue and distant 150 feet east therefrom to the southwesterly
corner of Lot 4 in said Block 2 of Hathway's Addition; thence east
along the south line of Lots 4 and 5 in said Block 2, 100 feet to the
southeast corner of said Lot S; thence north along the east line of
said Lot S, 150 feet to the northeast corner thereof; thence east
along the north line of said Block 2, 348.5 feet more or less to the
northeast corner thereof; thence south along the east line of said
Block 2, 310 feet, more or less, to the intersection thereof with
the northwesterly line of Peach Street; thence south 530 38' west
360 feet to the true point of beginning
shall be and is hereby rezoned from R -3 (Restricted Multiple Family Residential)
to R -0 (Residential /Office). Said property is also shown on the map attached
hereto marked Exhibit A and incorporated herein by reference.
SECTION 2. This Ordinance, together with the ayes and noes, shall be
published once in full, at least three days prior to its final passage, in the
Telegram- Tribune, a newspaper published and circulated in said City, and the same
shall go into effect at the expiration of thirty days after its said final passage.
INTRODUCED AND PASSED TO PRINT by the Council of the City of San Luis Obispo
at a Regular Meeting held thereof on the 18th day of December, 1967, on motion of
Councilman Gallagher, seconded by Councilman Miller, and on the following roll
call vote:
AYES: Emmons Blake, Frank Gallagher, Arthur F. Spring, Donald Q. Miller,
Clell W. Whelchel
NOES: None.
