BE IT ORDAINED by the Council of the City of San Luis Obispo
as follows:
SECTION 1, That Sections 8100 through 8201.2 of the San Luis
Obispo Municipal Code and Ordinance No. 356 (1966 Series) shall be
and the same are hereby repealed.
SECTION 2. That the following sections shall be and the same
are hereby added to the San Luis Obispo Municipal Code:

CHAPTER 13, PART 1 - GENERAL PROVISIONS
SECTION 8100. That four (4) documents and their appendixes, three
(3) copies each of which are on file in the office of
the City Clerk of the City of San Luis Obispo, identi-
fied by the Seal of the City appearing thereon, being
marked and designated as the "Uniform Building Code,
Volume I", "Uniform Mechanical Code, Volume III' and
Dangerous Building Code, Volume IV ", 1967 Editions,
published by the International Conference of Building
Officials, and the "Uniform Plumbing Code ", 1967
Edition, published by the International Association of
Plumbing and iNechanical Officials, be and the same are
hereby adopted as the Building lRegulations of the City
of San Luis Obispo, terms of such "Uniform Codes" on
file in the office of the City Clerk, are hereby re-
ferred to, adopted and made a part hereof as if fully
set out in this Ordinance, except as amended by the
provisions of Parts 2, 3, 4 and 5 of this Chapter.
SECTION 8100.1 In accordance with Section 3140, et seq. of the San
Luis Obispo Municipal Code, the entire incorporated
area of the City of San Luis Obispo has been divided
into Fire Zones 1, 2 and 3, designated on a certain
map on file in the office of the City Clerk of the
City of San Luis Obispo, which has been adopted as the
fire zoning map of the City of San Luis Obispo for the
application of the regulations included in the Uniform
Building Code, 1967 Edition, published by International
Conference of Building Officials,
SECTION 8100.2 Except as noted in Chapter 70 of the Uniform Building
Code, the Director of Planning and Building is hereby
designated the Building Official.
CHAPTER 11 PART 2
SECTION 8120. Amendments, Uniform Building Code

SECTION 8120.1 The following sections of the Uniform Building Code,
Volume I, 1967 Edition, are hereby amended as follows:
SECTION 203(b). Delete second paragraph. Substitute
the following therefor:
Proper service of such notice shall be made upon said
owner or owners by personal service or by registered or
certified mail, provided, that if such notice is by
registered mail or certified mail, the designated period
within which said owner or person in charge is required
to comply with the order of the Building Official shall
begin as of the date he receives such notice.
SECTION 301(b). Add note #8 as follows:
8. Show garage floor elevation and curb top elevation
each side of driveway approach.
SECTION 301(c). Delete the first sentence and substi-
tute the following therefor:
With each application for a building permit, and when
required by the Building Official for enforcement of
any provisions of this Code, three (3) sets of plans,
specifications and calculations shall be submitted.
The Building Official may require plans and specifi-
cations to be prepared and designed by an engineer or
architect licensed by the State to practice as such.
SECTION 302(d). Add as follows:
Every permit shall automatically expire eighteen (18)
months after date of issue and shall be renewable at
the discretion of the Building Official by payment of
one -half (2) of the original Building Permit fee.
Exceptions:
1. Work for which a permit has been issued and which
has been continuous for the specified time, may be
extended with the Building Officialts approval.
2. Work for which a Demolition Permit has been issued
shall expire by limitation and become null and void,
if the work authorized by such permit is not com-
menced within thirty (30) days from the date of
issue and shall automatically expire ninety (90)
days from date of issue.

Renewal shall be by payment of such fee as set forth
elsewhere in this Code.
SECTION 303(a). Add as follows:
Exception:
1. Permits shall not be required for:
(a) Non - structural work valued at $100.00 or less.
All such work shall be coordinated with the
Building Department for verification that the
exception is applicable.
(b) Concrete patio slabs, driveways, parking pads
and similar surfacing, for residential proper-
ties, not intended for future erection of
structures thereon.
SECTIOIT 303(b). Delete and substitute the following
therefor:
Plan Checking Fees, 11hen the valuation of the proposed
construction exceeds $2,000 and a plan is required to be
submitted by Subsection(c) of Section 301, a plan check-
ing fee shall be paid to the Building Official at the
time of submitting plans and specifications for checking.
Said plan checking fee shall be equal to one -half of the
Buildina Permit fee as set forth in Table No. 3 -A.
SECTION 303. Add Subsection (c) to read as follows:
(c) Demolition Permit Fee: Demolition permits shall be
issued on a no fee basis for the original permit.
Demolition Permits, which have expired, shall be
renewed by payment of a $15.00 fee.
SECTION 1704, Add Exception #2. Roofs of wood shakes
or shingles having a nominal thickness of one (111) inch
at the butt may be used in buildings of Type IV and V
construction, normally requiring fire retardant roof
coverings, provided:
(a) Such shakes or shingles shall have a Class A or B
fire retardant rating.
(b) Roof shall be solidly sheathed with not less than
1/2" plywood and a layer of 1/2" gypsum sheathing

applied thereon.
(c) A roof sprinkler system shall be installed as
approved by the Fire Department and /or Building
Official. These provisions shall be applicable
in Fire Zones 2 and 3 only. Plans shall be
submitted.
SECTION 2607(d). Add as follows:
In concrete form -work, 3/411 diameter round metal stakes
only shall be permitted within required concrete foot-
ings.
SECTION 2806(a). Add as follows:
Not less than one continuous deformed steel reinforcing
bar, of at least one half ( 211) inch in diameter, shall
be placed in all footings. T�Jhere foundation walls are
used, at least one additional bar shall be placed not
less than three inches (311), nor more than six inches
(611) from the top of said walls. Bars shall be held in
place by chairs and /or tying.
SECTION 3104. New Section entitled: Slab Floors.
14here concrete slab floor on grade construction is used
and slabs are not poured monolithic with footings, there
shall be placed vertically in all perimeter footings
3/8" 0 deformed steel reinforcing bars, spaced four (4)
feet center to center. These bars shall be bent inward
and tied to the 6 x 6 - 10 /10 wire mesh slab reinforcing
prior to pouring the slab. Vapor barriers shall not
extend over bearing surfaces of the perimeter footings
or stem walls. When floor slabs and footings are poured
monolithic, the 3/811 0 vertical reinforcing may be
omitted. All slabs shall have 6 x 6 - 10 /10 wire mesh
reinf orcing.
SECTION 4409. Add as follows:
Dry rubble and debris shall be wetted down in such a
manner so as to prevent objectionable dust and particu-
late matter from being stirred up and becoming a
nuisance to the general public.

SECTION 5205(a). Add Exception #4 to read as follows:
Plastic skylights may be used in roofs of one -story
buildings of Type III -one hour and IV -one hour con-
struction, located in Fire Zone No. 1, provided the
building is not over fifteen feet (151) high and the
surrounding structures do not project above the ele-
vation of the skylight more than four feet (4t) and are
no closer to the skylight than eight feet (8t). The
skylights shall not exceed 18" in any dimension.
SECTION 7001: Add as follows:
The City Engineer shall enforce this Chapter. Where
"Building Official" appears in this Chapter, "City
Engineer" shall apply.
SECTION 7007. Add Subsection (g):
All grading in residential zones or within one thousand
(1000) feet of any hospital shall be done between the
hours of 7:00 A.M'. and 7:00 P.1--i1., except in an emer-
gency. All graded surfaces and materials shall be
wetted, protected or contained in such a manner as to
prevent dust or spill upon any adjoining property or
street.
SECTION 7012(c). Delete the first sentence and substi-
tute the following therefor:
The maximum slope of any fill shall not exceed two (2)
horizontal to one (1) vertical.

SECTION 8130. Amendments, Uniform Mechanical Code,
SECTION 8130.1 The following sections of the Uniform Mechanical Code
are amended as follows:
SECTI0N 304. Delete the $3.00 fee for issuing a permit
and substitute $2.00 in lieu thereof.
SECTION 708. Delete the first sentence of the third
paragraph and substitute the following therefor:

warm -air furnace is installed shall be readily access-
ible by an opening, fixed ladder and /or passageway as
large as the largest piece of the furnace and in no

CHAPTER, It PART 5
SECTION 8150. Amendments, Uniform Plumbing Code,
SECTION 8150.1 The following sections of the Uniform Plumbing Code are
amended as follows:
SECTION 1.1: Insert "Building Official's in the space
provided.
SECTION 1.2: Insert "Building Inspector(s)" in the
space provided. Delete the second sentence.
SECTION 1.3: Insert "Planning and Building" in the
space provided.
SECTION 1.7: Insert "three hundred dollars" ($300.00),
"City" or "County" and "three" (3) in the appropriate
spaces provided.
SECTION 1.10: Delete Subsection (a).
Part Two: Delete in its entirety.
Add new SECTION 211: Plastic Pipe:
(a) Plastic Pipe for water services may be used pro-
vided all joints and connections are either of the
ring seal or threaded type and all pipe and fit-
tings are of the same manufacture.
(b) Installation of plastic water service pipe shall
be in strict accordance with manufacturer's in-
structions.
Exception:
No solvent cemented joints shall be permitted in
the field.
(c) Fittings with solvent cemented joints made by the
manufacturer are permitted, providing a certificate
of manufacture shall have been submitted to the
Building Department prior to the installation of

the solvent cemented fittings. Said certificate
shall indicate that the fittings were manufactured
for the specific job on which they are used, and
that they have been tested for the minimum work-
ing pressures required.
(d) Plastic water service pipe shall be buried not
less than two (2) feet below the surface of the
ground.
(e) Plastic crater service pipe shall have prior
approval of the International Association of
Plumbing and Mechanical Officials.
SECTION 303: Delete Subsection(c) in its entirety and
the following is substituted therefor:
(c) Each parcel of land or lot shall have its own
separate connection to a public sewer main.
SECTION 317: Add to Subsection(d) following the first
sentence:
"A six inch layer of sand or comparable material shall
be laid in ditches to provide a leveling and laying bed
for pipe."
SECTION 323: Delete the first sentence in its entirety
and substitute the following:
"The Building Board of Appeals shall decide any appeal
arising from actions of the Administrative Authority,"
SECTION 410: New Section.
SECTION 410(a). Back -Water Traps and Valves.
If an existing plumbing outlet has been installed or
located, or if a plumbing outlet is to be installed or
located, at an elevation which, in the opinion of the
Building Official, may cause the fixture to overflow
by reason of backflow from a main line sewer, an
approved type of back -water trap or sewer valve shall
be installed between the outlet and the public sewer
in such a manner as to prevent sewage from flowing back
or backing up into any such outlet or plumbing fixture.
The trap or valve shall be installed in the basement or
in a box or manhole of concrete or cast iron or other
material approved by the Building Official and shall be

readily accessible at all times. The trap or valve
shall be placed only in the drain serving the fixture
or fixtures, that may be subject to overflow and no
sewage from fixtures not subject to overflow shall pass
through such trap or valve.
(b) City Engineer empowered to stop overflow.
If the property owner fails to install and maintain a
back -water trap or back - water valve in good working
condition, when required under this Section, the City
Engineer may order and require said plumbing fixture
to be disconnected and removed and the outlet there
plugged or capped. In the event that the property
owner fails to disconnect and plug or cap the sewer
connection within 10 days after written notice by the
City Engineer, then the City Engineer shall arrange for
such disconnection and capping; the cost of which shall
be a debt of the property owner and which may be
collected by court action or clay be declared to be a
lien by action of the City Council after public hearing
and notice to the property owner and shall be added to
and collected as part of the tax roll.
(c) Alternate right to terminate water service.
As an alternate to the procedure set forth in Section
410(b), if the property owner fails to install and
maintain a back -water trap or back -water valve in good
working condition when requested under this part, the
City Engineer may order and require termination of
water service to the parcel and all structures connected
to the sewer outlet subject to over -flow. Said water
service shall not be reinstated until the maintenance
or installation of the back -water trap or back -water
valve has been approved by the City Engineer. (Ordinance

(d) Maintenance of House Connection Sewers.
All house connection sewers, industrial sewers, private
sewage disposal systems and appurtenances thereto, now
existing or hereafter constructed, shall be maintained

by the owner of the property in a safe and sanitary
condition and all devices or safeguards which are re-
quired by this Part for the operation thereof, shall be
maintained in a good working order.
SECTION 1008(c)2. Delete the second sentence in its
entirety and substitute the following:
"Where joints are permitted, they shall be silver brazed
and fittings shall be wrought copper."
SECTION 1103: Add Subsection(c) as follows:
"No bituminous fiber pipe shall be used as a building
drain or sewer."
CHAPTER 1, PART 6
SECTION 8160. Civil Defense Shelters.
SECTION 8160.1 Permits: No person shall construct a fallout, blast
resistant or limited blast resistant shelter without
first having obtained a permit from the Building
Off icial.
SECTION 8160.2 Permits shall be issued upon application, accompanied
by standard drawings and specifications, obtainable at
no cost from the Director of Civil Defense, City Hall
Basement, 990 Palm Street. Permits shall be issued at
no cost.
Exception:
Shelters constructed as part of a new building or part
of the structural frame of a new or existing building
shall be evaluated accordingly and a permit fee shall
be paid.
SECTION 8160.3 Protective shelters, unless totally underground, shall
not encroach into any required rear, side or front yard
setback.
CHAPTER 19 PART 7
SECTION 8170. Tents.
SECTION 8170.1 Definition: "Tent" as used in this Chapter is any
structure or enclosure constructed of canvas or other
combustible fabric or similar material.

SECTION 8170.2 Permit required: No person shall erect, use or main-
tain any tent other than as provided in this part and
Article 30 of the Uniform Fire Code, without first
having obtained a permit to do so from the Council in
the manner hereinafter provided.
SECTION 8170.3 Application: Application for the erection, use, or
maintenance of any tent shall be :jade to the Council,
through the Department of Planning and Building.
Application shall be in the form of a letter, submitted
not less than twenty (20) days prior to the erection
or use of said tent. Each application shall be accom-
panied by the following; information:
1. Address of the site on which the tent is to be
erected and used.
2.
Name
and
address
of
the
owner of
said property.
3.
Name
and
address
of
the
person(s)
or firm for whom
the tent is to be erected.
4. Name and address of the person(s) or firm erecting
said tent.
5. A statementof purpose for which said tent is to be
erected and used.
6. The length of time said tent is to be maintained
and used.
7. A fully dimensioned plot plan for the site showing
the size of the tent, distances to other structures,
property lines and uses.
8. Location of available parking space.
SECTION 8170.4 Permit Fee: A permit and inspection fee, in the amount
of $15.00, shall be paid at the time of application.
$10.00 of this fee is refundable if the permit is
denied.
SECTION 8170.5 Hearing and Issuance of Permit.
Within twenty (20) days following the filing of an
application, the Council shall hear the request for
permit and shall render its decision. If the Council
shall find the issuance of the permit would not be
detrimental to the public safety, interest or welfare,

the Council may grant said permit. The application
shall otherwise be denied.
SECTION 8170.6 Duration: In approving any permit, the Council shall
specify the number of days the permit shall remain in
effect, provided however, that no permit shall author-
ize the erection and maintenance of any tent at any
location for more than thirty (30) consecutive days.
Any tent authorized under this section shall be promptly
dismantled and removed when the permit expires.
SECTION 8170.7 Flame proofing: Any canvas or other fabric used in
tents shall be flameproofed and shall meet all require-
ments of Section 30.06 of the Uniform Fire Code.
SECTION 8170.8 Exceptions:
Any tent in or under which less than ten (10) persons
may gather, or which covers an area not in excess of
two hundred (200) square feet, shall not be subject to
this part or the requirements of Article 30, Uniform
Fire Code,
SECTION 8170.9 Electrical Equipment. All electrical wiring and other
electrical equipment shall meet the requirements of the
Electrical Code of the City of San Luis Obispo.
SECTIO14 8170.10 Zoning Ordinance: into permit shall be issued for any
tent, which is contrary to the provisions of the Zoning
Ordinance of the City of San Luis Obispo,
SECTION 8170.11 Sanitary Facilities: Toilets and other sanitary facil-
ities shall be provided as required by the Building
Official and /or Health Officer,
SECTION 8170.12 Inspection. No person shall use or occupy or permit
the use or occupancy of any tent regulated by this
section, until said tent shall have been inspected and
approved for use by the Building Official, Fire Marshal
and Health Officer.

SECTION 3. This Ordinance, together with the ayes and noes,
shall be published once in full, at least three days before its
final passage, in the Telegram - Tribune, a newspaper published and
circulated in said City, and the same shall go into effect at the
expiration of thirty (30) days after its said final passage.

PUBLIC HEARING
NOTICE IS HEREBY GIVEN THAT the City Council of the City of San
Luis Obispo will hold a public hearing on the introduction of Ordinance
No. 423, an ordinance regulating the erection, construction, enlargement,
alteration, repair, moving, removal, conversion, demolition, occupancy,
equipment, use, height, area, sanitation, plumbing, and maintenance of
buildings or structures in the City of San Luis Obispo, State of California,
providing for the issuance of permits and collection of fees therefor,
declaring fire districts,.providing penalties for the violation thereof,
and repealing all ordinances and parts of ordinances in conflict therewith.
Copies 'of the Ordinance are awaiLAble for .public inspection at the
office of the City Clerk, City Hall, 990 Palm Street, San Luis Obispo.
SAID PUBLIC HEARING will be held on Monday, September 3, 1968 at
8:30 P.M., in the Council Chambers of the City Hall, 990 Palm Street,
San Luis Obispo, California.
