HomeMy WebLinkAbout04324 ORDINANCE NO. 432 (1968 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO APPROVING THE ANNEXATION TO SAID CITY OF CERTAIN UNINHABITED TERRITORY DESIGNATED THE "FAULSTICH ANNEXATION ". WHEREAS, pursuant to the provision of the Annexation of Uninhabited Territory Act of 1939, and pursuant to Resolution No. 1857 adopted by the City Council of the City of San Luis Obispo on the 7th day of October, 1968, a public hearing was held on November 18, 1968, at the City Council Chambers, City Hall, 990 Palm Street, San Luis Obispo, California, on the proposal of the City Council to adopt an ordinance approving the annexation of certain uninhabited territory contiguous to the City of San Luis Obispo designated as the "Faulstich Annexation" and which is hereinafter more particularly described; and WHEREAS, the total assessed valuation of the territory proposed for annexation is $148,190 and only three property owners owning parcels having a total assessed value of $12,180 have protested the annexation; and WHEREAS, the owners of all of the real property in the area who initiated the proposed annexation have requested and agreed that such property shall be subjected to taxation after such annexation equally with property within the City of San Luis Obispo to pay the bonded indebtedness of the City of San Luis Obispo outstanding or authorized at the date of the first publication of the notice of election for the acquisition, construction, or completion of the municipal improvements; and WHEREAS, the proposed annexation including, the legal description of the territory to be annexed had already been approved by the San Luis Obispo County Local Agency Formation Commission on August 22, 1968 by Resolution No. 68 -9; and WHEREAS, it appears that all proceedings relating to said annexation have been conducted strictly in accordance with law; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. It is hereby determined in accordance with Government Code Section 35313.2 that a majority protest to said annexation has not been made. SECTION 2. It is further ordered that the protests of M. &W. Distributing Company, owner of Parcel No. 76- 461 -02, and Marjorie H. DeSario and Marian C. Morrisor, owners of Parcel No. 76- 461 -03, be and the same are hereby overruled. SECTION 3. That the annexation of uninhabited territory contiguous to the City of San Luis Obispo designated as the "Faulstich Annexation" be and the same is hereby approved and the real property in said annexation shall be subject to taxation equally with �/ 3 �, 62 Ordinance No. 432 the property within the City of San Luis Obispo to pay the bonded indebtedness of the City of San Luis Obispo outstanding or authorized at the date of the first publication of the notice of election for the acquisition, construction, or completion of the municipal improvements. Said territory is located in the County of San Luis Obispo, State of California, and is described on Exhibit "A" hereto which is attached hereto and by such reference incorporated herein as fully as if set forth in full below. SECTION 4. This ordinance, together with the ayes and noes, shall be published once in full, at least three days before its final passage in the Telegram -Tribune, a newspaper published and circulated in said City, and the same shall go into effect at the expiration of thirty days after its final passage.
