HomeMy WebLinkAbout04351 ORDINANCE NO. 435 (1968 Series) AN ORDINANCE ADOPTING BOAT DOCK REGULATIONS FOR LAGUNA LAKE. BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. That Sections 8910 through 8910.7 are hereby added to the San Luis Obispo Municipal Code to read as follows: Section 8910. PURPOSE This chapter is intended to regulate the construction of permanent and floating docks on Laguna Lake. Section 8910.1. DEFINITIONS a. Permanent Dock - A moorage for boats which is permanently affixed to the ground and is not supported by a buoyant method. b. Floating Dock - A moorage for boats supported by a buoyant method acceptable to the City Engineer, which may or may not be attached to land. Section 8910.2. DOCK STANDARDS a. No permanent dock shall encroach into that portion of Laguna Lake which is under the jurisdiction of the City of San Luis Obispo. All such docks shall be located on private property. b. Floating docks may encroach into Laguna Lake not more than thirty (30) feet distance from the nearest property line and such floating docks shall not exceed one hundred eighty (180) square feet in area. Total allowable area shall include any ramp or gangway constructed in conjunction with the floating dock and included in the encroachment. c. No dock shall encroach beyond the projected lot lines of adjoining properties. Section 8910.3. PERMITS REQUIRED A permit shall be obtained prior to construction for all docks. Construction plans and any other plans deemed necessary by the Building Official shall be submitted in duplicate to the San Luis Obispo City Building Department for permanent docks, and for floating docks. Any plumbing or electrical work done in relation to either a floating or permanent dock shall not commence until pertinent permits have been obtained from the San Luis Obispo City Building Department. Plans to be submitted for approval shall include complete working drawings, plot plan, schematics of electrical and mechanical work, and such other plans as may be required to effect completion of the work in a manner satisfactory to the Building Official. Section 8910.4. SAFETY REQUIREMENTS a. All new construction shall be in accord with applicable codes and ordinances as adopted by the City of San Luis Obispo. �i3 � Ordinance No. 435 Page 2 b. Any permanent or floating dock or portion thereof that, in the opinion of the Building Official, is unsafe or insecure, shall be deemed a nuisance, and shall be repaired or removed by the owner of the property upon which such dock is attached, within thirty (30) days after notice in writing by the City of San Luis Obispo. After thirty (30) days, the City of San Luis Obispo may cause such dock to be removed and the cost of such removal shall become a lien against the real property. The City of San Luis Obispo may cause any dock which is an immediate peril to persons or property to be removed or corrected summarily and apply the cost as a lien against the real property. Section 8910.5. EXCEPTIONS An exception may be made by the Planning Commission to the total allowable area of a floating dock and /or the allowable distance that it may encroach into City property. An exception may be made to the standards setforth in Section 9000.2 by the Planning Commission provided: (a) That there are exceptional circumstances applying to the site, such as size, shape, or topography, which do not apply generally to land in the vicinity, (b) That the exception will not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity, (c) That the granting of such exception will not adversely affect the health, safety, or general welfare of persons residing or working in the vicinity. Such an exception may be granted by the Planning Director where a written consent from the affected adjoining property owner is furnished with application for permit. Section 8910.6. REMOVAL OF NONCONFORMING DOCKS Permanent and floating docks which do not conform to this Boat Dock Ordinance, shall, within five (5) years after January 6, 1969, be removed or made to conform. Section 8910.7. APPEALS The provisions of Section 9200.16 -H of the San Luis Obispo Municipal Zoning Ordinance shall. apply. SECTION 2. This Grdina.nce, together with the ayes and noes, shall be published once in full, at least three days prior to its final passage, in the Telegram- Tribune, a newspaper published and circulated in said City, and the same shall go into effect at the expiration of thirty days after its said final passage.. SAID PUBLIC HEARING WILL BE held on Monday, December 2, 1968, at 8:00 P.M. in the Council Chambers of the City Hall, 990 Palm Street, San Luis Obispo, California. Copies of proposed boat dock ordinance are available at the City Clerk's Office, City Hall, 990 Palm Street, San Luis Obispo. J. H.
