HomeMy WebLinkAbout0461ORDINANCE NO. 461 (1969 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO APPROVING THE ANNEXATION TO SAID CITY OF CERTAIN TERRITORY HERETOFORE DESIGNATED., "EDNA ROAD NO. 2 ANNEXATION. " Whereas, pursuant to Resolution No. 1960 (1969 Series) adopted by the City Council of the City of San Luis Obispo on July 22, 1969, a public hearing was held on September 8, 1969 at the City Council Chambers, City Hall, 990 Palm Street, San Luis Obispo California, on the proposal of the City Council to adopt an ordinance approving the annexation of certain territory contiguous to the boundaries of said city which qualifies as "uninhabited territory" as those terms are defined in Section 35303 of the California Government Code, heretofore designated as "Edna Road No. 2 Annexation"; and Whereas, the total assessed valuation of the territory proposed for annexation is $34,750 and only four property owners owning parcels having a total assessed value of $11,970 have protested said annexation representing less than one-half of the assesses valuation; and Whereas, the proposed annexation including the legal description of the territory to be annexed was approved by the San Luis Obispo County Local Agency Formation Commission on June 24, 1969 by Resolution No. 69 -5; and Whereas, it appears that all proceedings relating to said annexation have been conducted strictly in accordance with law; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis Obispo as follows; SECTION 1. It is hereby determined in accordance with Government Code Section 35313.2 that those protesting the Edna Road No. 2 annexation do not constitute a majority of the property owners in said territory. SECTION 2. It is further ordered that the protests of the owner of Assessor's Parcel No. 76- 431 -10, No. 76- 431 -13, No. 76- 441 -01 and No. 76- 441 -12 be and the same are hereby overruled. SECTION 3. That the annexation of territory contiguous to the City of San Luis Obispo previously designated the "Edna Road No. 2 Annexation" be and the same is hereby approved and the real property in said annexation shall be subject to taxation equally with the property within the City of San Luis Obispo to pay the bonded indebtedness of the City of San Luis Obispo outstanding or authorized on the date of said annexation. Said territory is located in the County of San Luis Obispo, State of California and is described on Exhibit "A" hereto which is attached hereto and by such reference in- corporated herein as fully as if set forth in full below. 4//-" Ordinance No. 461 Page 2 SECTION 4. This ordinance, together with the ayes and noes, shall be published once in full, at least three days before its final passage in the Telegram - Tribune, a newspaper published and circulated in said City and the same shall go into effect on October 8, 1969. Beginning at a point on the City Limits line of the City of San Luis Obispo, California, said point being also the Northeast corner of Lot No. 116 of the Suburban Tract, according to the map thereof filed February 7; 1906, in Book No. 1, Records of Survey, at Page 92 in the Office of the County Recorder, County of San Luis Obispo, California, said corner being also the point of intersection of the Southerly line of Orcutt Road (known formerly as County Road No. 34) and the line common to lots 116 and 117 of said Suburban Tract; Thence along the City Limits line as follows: 2. South 0° 26' East along the line common to Lots 116 and 117 of the Suburban Tract to the intersection of said line with the Northeasterly line of the Pacific Coast Railroad (abandoned); 3. Southeasterly along the Northeasterly line of the Pacific Coast Railroad (abandoned) to a point; said point being the intersection of the Northeasterly line of the Pacific Coast Railroad (abandoned) with the line common to Lots 114 and 115 of the Suburban Tract; 4. South 54° 20' West along the Southwesterly prolongation of the line common to Lots 114 and 115 of said Suburban Tract to a point on the Southwesterly line of the Pacific Coast Railroad (abandoned); 5. South 47. 25' East along the Southwesterly line of the Pacific Coast Railroad (abandoned) to a point, said point located South 470 25' East, a distance of 43.32 feet from the most Easterly corner of Lot 89 of the Suburban Tract; Thence leaving said City Limits line along the following courses: 6. South 65° 10' West, along the Southerly line of a parcel deeded to the City of San Luis Obispo by Document No. 26053, recorded and filed at the Office of the County Recorder, County of San Luis Obispo, December 29, 1966, in Volume 1420, Official Records, at Page 593, a distance of 299.66 feet to a point; 7. Continuing along the Southerly line of said parcel of land deeded to the City of San Luis Obispo by said Document No. 26053, along a curve concave to the right, with a radius of 270.00 feet, through an angle of 23° 04' 26 ", for a distance of 108.73 feet to a point of reverse curve; 8. Continuing along the Southerly line of said parcel deeded to the City of San Luis Obispo by Document No. 26053, along a curve concave to the left and tangent to the last described curve, with a radius of 230.00 feet, through an angle of 23° 04' 2601, a distance of 92.62 feet to a point, said point being located on the line common to Lots 89 and 90 of the Suburban Tract; 9. South 65° 10' West along said line common to Lots 89 and 90 of the Suburban Tract, said line being also the Southerly line of a parcel of land deeded to the City of San Luis Obispo by Document No. 15576, recorded and filed in the Office of the County Recorder, County of San Luis Obispo, July 26, 1966, in Volume 1404, Official Records, at Page 264, a distance of 168.25 feet; to a point; M. South 39" 02' 32" West, along the Southeasterly line of a parcel of land deeded to the City of San Luis Obispo, by Document No. 7945, filed in the Office of the County Recorder, County of San Luis Obispo, April 26, 1968, in 'volume 1473, at Page 625, a distance of 34.04 feet to a point on the Northeasterly line of State Highway No. 227, as widened; 11. South 670 301 West across State Highway No. 227 a distance of 84.00 feet more or less to the Southwesterly line of said State Highway No. 227; 12. Northerly along the Southwesterly line of State Highway No. 227 to its intersection with the Southerly line of Rockview Place (formerly County Road No. 271), said intersection point being a point on the City Limits line of the City of San Luis Obispo; Thence along said City Limits line as follows: 13. Continuing Northerly along said Southwesterly line of State Highway No. 227 to the Westerly prolongation of the Southerly line of Orcutt Road (formerly County Road No. 34); 14. Crossing State Highway No. 227 Easterly along said Westerly prolongation and said Southerly line of Orcutt Road (known formerly as County Road No. 34) to the point of beginning.
