AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO
APPROVING THE ANNEXATION TO SAID CITY OF CERTAIN
UNINHABITED TERRITORY DESIGNATED "VISTA GRANDE
ANNEXATION. "
WHEREAS, pursuant to the provisions of Section 35015 of the Government Code
of the State of California, territory proposed to be annexed to a city may be annexed
by the legislative body of the city without notice and hearing and without an election,
if all of the owners of the land within such territory consent in writing to such annexation;
and
WHEREAS, a petition signed by the owner of all of the real property in the area
described herein, more commonly known as the Vista Grande Annexation, have re-
quested the proposed annexation and consented and agreed that such property shall be
subjected to taxation after such annexation equally with property within the City of
San Luis Obispo to pay the bonded indebtedness of the City of San Luis Obispo outstanding
or authorized at the date of the first publication of the notice of election for the
acquisition, construction, or completion of the municipal improvements; and
WHEREAS, no written protests against the annexation have been filed; and
WHEREAS, the proposed annexation including the legal description of the
territory to be annexed had already been approved by the San Luis Obispo County
Local Agency Formation Commission on April 7, 1970 by Resolution No. 70 -6; and
WHEREAS, the Local Agency Formation Commission has authorized the City
to complete the Vista Grande Annexation without further notice, hearing or election
and it appears that all proceedings relating to said annexation have been conducted
strictly in accordance with law.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. That the annexation of uninhabited territory contiguous to the
City of San Luis Obispo designated as "Vista Grande Annexation" be and the same is
hereby approved and the real property in said annexation shall be subject to taxation
equally with the property within the City of San Luis Obispo to pay the bonded indebted-
ness of the City of San Luis Obispo outstanding or authorized at the date of the first
publication of the notice of election for the acquisition, construction, or completion
of the municipal improvements. Said territory is located in the County of San Luis
Obispo, State of California, and is described as follows:

All those portions of Lot 4 and the Southwest quarter of the Northwest quarter
of Section 2, of Lots 1 and 2 of Section 3, in Township 31 South, Range 12
East, Mount Diablo Base and Meridian, according to the Official Plat of the
Survey of said Lands approved by the Surveyor General on November 21,
1867, and of Lot 24 of the San Luis Obispo Suburban Tract, according to
map recorded February 7, 1906, in Book 1 at Page 92 of Record of Surveys,
all in the County of San Luis Obispo, State of California, described as a
whole as follows:
Beginning at a point on the northerly line of said Section 2, where the same
is intersected by the westerly line of that certain piece or parcel of land
conveyed to Antone John Bettencourt, by Deed recorded September 28, 1928,
in Book 55 at Page 160 of Official Records; thence westerly along said northerly
line of said Section 2 and along the northerly line of said Lot 1 of said Section
3 to a point distant 200 feet easterly at right angles from the easterly line
of the Right of Way of the California State Highway as said line was located
in the Deed to the State of California., dated May 19, 1927, and recorded
November 7, 1927 in Book 40, at Page 129 of Official Records; thence
southerly along a line parallel 200 feet easterly of said easterly line of said
California State Highway to the northeasterly corner of the property con-
veyed to the Seaside Oil Company, a corporation, by Deed recorded January .14,
1929, in Book 59, at Page 462 of Official Records; thence South 110 07' East
along the easterly line of said parcel and the southerly extension thereof
579.52 feet to the northeasterly corner of the property conveyed to Frank L,.
Weber, by Deed recorded August 19, 1930, in Book 92 at Page 283 of OfficiAl
Records; thence south 90 37' east along the easterly line of said parcel 137.97
feet to the southeasterly corner thereof, said point being also the northeasterly
corner of that certain piece or parcel of land conveyed to R. C. Terhune, et
ux. , by Deed recorded April 19, 1930, in Book 85, at Page 281 of Official
Records; thence south 11° 07' east along the easterly line of said parcel 78.71 feet
to the northwesterly corner of the property conveyed to Emet Biddles, et ux.,
by Deed recorded July 25, 1939, in Book 263 at Page 62 of Official Records;
thence North 890 49' East, along the northerly line of the property so conveyed
48.65 feet to the northeasterly corner thereof; thence South 0° 11 east, along
the easterly line of said Biddles' property and along the easterly line of the '
property conveyed to Octavia Augusta Martin, by Deed recorded May 7, 1934,
in Book 150 at Page 231 of Official Records and by Deed recorded October 30,
1928, in Book 55 at Page 416 of Official Records, 474.24 feet to the point of
intersection thereof with the southerly line of said Lot 24 of the San Luis Obispo
Suburban Tract; thence easterly along said last named line to the point of
intersection thereof with the westerly line of the parcel of land conveyed to
Antone John Bettencourt as above mentioned; thence northerly along said last
named line, 2656.50 feet to the point of beginning.
SECTION 2. This ordinance, together with the ayes and noes, shall be published
once in full, at least three days before its final passage in the Telegram- Tribune, a
newspaper published and circulated in said City, and the same shall go into effect at
the expiration of thirty days after its final passage.
INTRODUCED AND PASSED TO PRINT by the Council of the City of San Luis
Obispo at a Regular Meeting held thereof on the 1st day of June, 1970 on motion of
Councilman Graham, seconded by'Councilman llUer, and on the following.roll call vote:
AYES: Councilmen Blake, Graham, Miller, Spring and Mayor Schwartz
NOES: None
ABSENT: None.
