AN ORDINANCE OF THE CITY OF SAI`d LUIS OBISPO APPROVING
THE ANNEXATION TO SAID CITY OF CERTAIN UNINHABITED
TERRITORY DESIGNATED VEIGOLD ANNEjXATION. "
WHEREAS, pursuant to the provisions of Section 35015 of the Government Code
of the State of California, territory proposed to be annexed to a city may be annexed
by the legislative body of the city without notice and hearing and without an election,
if all of the owners of the land within such territory consent in writing to such
annexation; and
WHEREAS, a petition signed by the owner of all of the real property in the area
described herein, more commonly laiawn as the Weigold Annexation, have requested
the proposed annexation and consented and agreed that such property shall be sub-
jected to taxation after such annexation equally with property within the City of
San Luis Obispo to pay the bonded indebtedness of the City of San Luis Obispo out-
standing or authorized at the date of the first publication of the notice of election for
the acquisition, construction, or completion of the municipal improvements; and
WHEREAS, no written protests against the annexation have been filed; and
WHEREAS, the proposed annexation including the legal description of the territory
to be annexed had already been approved by the San Luis Obispo County Local Agency
Formation Commission on August 20, 1970 by Resolution No. 70 -11; and
WHEREAS, the Local Agency Formation Commission has authorized the City
to complete the Weigold Annexation without further notice, hearing or election and
it appears that all proceedings relating to said annexation have been conducted strictly
in accordance with law.
NOVI, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. That the annexation of uninhabited territory contiguous to the City
of San Luis Obispo designated as ' Tleigold Annexation" be and the same is hereby
approved and the real property in said annexation shall be subject to taxation equally
with the property within the City of San Luis Obispo to pay the bonded indebtedness of
the City of San Luis Obispo outstanding or authorized at the date of the first publication
of the notice of election for the acquisition, construction, or completion of the
municipal improvements. Said territory is located in the County of San Luis Obispo,
State of California., and is described as follows:

That portion of the Northeast Quarter of the Northeast Quarter of
Section 28, Township 30 South, Range 12 East, i;Iount Diablo Meridian,
in the County of San Luis Obispo, State of California, according to the
official plat of said land approved by the Surveyor General November 30,
1867, bounded by the following described lines:
Bounded northerly by the northerly line of the Northeast Quarter of the
Northeast Quarter of said Section 28:
Bounded Westerly by the course recited as "North 51 West, 2.80 chains"
in the deed to Jefferson Johnson, recorded October 31, 1904 in Book 6-:,
Page 150 of Deeds, in the office of the County recorder of said County,
and its southerly prolongation:
Bounded Southeasterly by the course recited as "thence sixteen (16) rods
more or less hi a'Southwesterly direction, on the line of a fence to a gulch"
in the deed to J. J. Johnson, recorded April 28, 1873 in Book E, page 93
of Deeds, in the office of the County Recorder of said County.
EXCEPT the interest of the County of San Luis Obispo, in the road along
the southeasterly side of said land as disclosed by deed recorded in Book
64, Page 150 of Official Records.
SECTION 2. This ordinance, together with the ayes and noes, shall be published
once in full, at least three days before its final passage in the Telegram Tribune, a
newspaper published and circulated in said City, and the same shall go into effect at
the expiration of thirty days after its final passage.
INTRODUCED AND PASSED TO PRINT by the Council of the City of San Luis Obispo
at a Regular Meeting held thereof on the 21st day of September 1970
on motion of Councilman Miller , seconded by Councilman Graham ,
and on the following roll call vote:
