HomeMy WebLinkAbout0502Ordinance No. 502 (1970 Series) Page 2 Lot 25 and those portions of Lots 29 and 30 of the San Luis Obispo Suburban Tract, in the County of San Luis Obispo, State of California, as per map filed in Book. 1, Page 92 of Record of Surveys, in the Office of the County Recorder of said County, described as a whole as follows: Beginning at the northwesterly corner of said Lot 25; thence easterly along the northerly line of said Lot 25, a distance of 118.70 feet to the northeasterly corner of said Lot 25; thence easterly along the northerly line of said Lot 29, a distance of 642.18 feet to the northeasterly corner of said Lot 29; thence easterly along the northerly line of said Lot 30, a distance of 332.97 feet; thence southerly parallel with the easterly line of said Lot 30, a distance of 670.56 feet; thence westerly 990 feet to the southeasterly corner of Lot 26 of said San Luis Obispo suburban tract; thence northerly along the easterly line of said Lot 26, a distance of 330 feet to the northeasterly corner of said Lot 26; thence westerly along the southerly line of said Lot 25, to the southwesterly corner of said Lot 25; thence northerly along, the westerly line of said Lot 25, a distance of 341.65 feet to the point of beginning.. SECTION 2. This ordinance, together with the ayes and noes, shall be published once in full, at least three days before its final passage in the Telegram Tribune, a newspaper published and circulated in said City, and the same shall go into effect at the expiration of thirty days after its final passage. INTRODUCED AND PASSED TO PRINT by the Council of the City of Nan Luis Obispo at a Regular Meeting held thereof on the 5th day of October , 1970 on motion of Councilman Blake seconded by Councilman Graham , and on the following roll call vote: AYES: Councilmen Blake, Graham, Miller, Spring and Mayor Schwartz NOES: None ABSENT: None ATTEST: ORDINANCE NO. 502 (1970 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO APPROVING THE ANNEXATION TO SAID CITY OF CERTAIN UNINHABITED TERRITO%Y DESIGNATED "SOUTH HIGUEP.A STREET ANNEXATION NO. 2. " WHEREAS, pursuant to the provisions of Section 35015 of the Government Code of the State of California, territory proposed to be annexed to a city may be annexed by the legislative body of the city without notice and hearing and without an election, if all of the owners of the land within such territory consent in writing to such annexation; and WHEREAS, a petition signed by the owner of all of the real property in the area described herein, more commonly Imown as the South Higuera Street Annexation No. 2, has requested the proposed annexation and consented and agreed that such property shall be subjected to taxation after such annexation equally with property within the City of San Luis Obispo to pay the bonded indebtedness of the City of San Luis Obispo outstanding or authorized at the date of the first publication of the notice of election for the acquisition, construction, or completion of the municipal improvements; and WHEREAS, no written protests against the annexation have been filed; and WHEREAS, the proposed annexation including the legal description of the territory to be annexed had already been approved by the San Luis Obispo County Local Agency Formation Commission on August 6, 1970 by Resolution No. 70 -10; and t,1HEREAS, the Local Agency Formation Commission has authorized the City to complete the South Higuera Street Annexation No. 2 without further notice, hearing or election and it appears that all proceedings relating to said annexation have been conducted strictly in accordance with law. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. That the annexation of uninhabited territory contiguous to the City of San Luis Obispo designated as "South Higuera Street Annexation No. 2" be and the same is he reby approved and the real property in said annexation shall be subject to taxation equally with the property within the City of San Luis Obispo to pay the bonded indebtedness of the City of San Luis Obispo outstanding or authorized at the date of the first publication of the notice of election for the acquisition, construction, or completion of the municipal improvements.
