HomeMy WebLinkAbout0520c _w ORDINANCE NO. 520 (1971 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO APPROVING THE ANNEXATION TO SAID CITY OF CERTAIN UNINHABITED TERRITORY DESIGNATED "HIGHLAND DIUVE ANNEXATION. " WHEREAS, pursuant to the provisions of Section 35015 of the Government Code of the State of California, territory proposed to be annexed to a city may be annexed by the legislative body of the city without notice and hearing and without an election, if all of the owners of the land within such territory consent in writing to such annexation; and WHEREAS, the City of San Luis Obispo is the sole owner of the real property in the area described herein, more commonly known as the Highland Drive Annexation, and has requested the proposed annexation and consented and agreed to the boundaries of said area to be annexed; and WHEREAS, no written protests against the annexation have been filed; and WHEREAS, the proposed annexation including the revised legal description of the territory to be annexed has been approved by the San Luis Obispo County Local Agency Formation Commission; and WHEREAS, the Local Agency Formation Commission has authorized the City to complete the Highland Drive Annexation without further notice, hearing or election and it appears that all proceedings relating to said annexation have been conducted strictly in accordance with law. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. That the annexation of uninhabited territory contiguous to the City of San Luis Obispo designated as "Highland Drive Annexation" be and the same is hereby approved and the real property in said annexation shall be annexed to and made a part of the City of San Luis Obispo effective April 5, 1971. Said territory is located in the County of San Luis Obispo, State of California, and is described as follows: That portion of the Northwest quarter of the Southeast quarter of Section 22 in Township 30 South, I',ange 12 East, iviount Diablo Base and Meridian, in the County of San Luis Obispo, State of California, according to the official plat of the survey of said lands approved by the Surveyor General on November 30, 1867, described as follows: Beginning at the Southwest corner of said Northwest quarter of the South- east quarter of Section 22, being also the Southeast corner of Tract 225, according to map recorded August 24, 1961, in Book 6, Page 59 of Maps; Thence North 0° 00' 44" West along the Easterly line of said tract, 148.06 feet to the Southeast corner of Lot 5 in Block A of said Tract 225; thence on a curve to the right, tangent to a line that bears South 76° 24' 10" East, with a radius of 530 feet through an angle of 6° 09' 43" for a distance of 57.00 feet; 'thence on a reverse curve to the left, tangent to last said curve, with a radius of 470 feet through an angle of 45° 13' 37" more or less for a distance of 371.00 feet more or less to the VIesterly line of the property described in the transfer to the State of California, Department of Public Works, Division of Highways, recorded July 10, 1942, in Book 324, Page 187 of Official Records; 1 Ordinance No. 520 (1971 Series) Page 2 Thence South 31° 14' 10" East along said 'Vlesterly line to a point on the Northerly City Limit line as described by City Ordinance No. 304 (New Series) 1948, Monterey Heights, Phillips Addition, Taylor Tract, etc.; thence'We sterl y along said Northerly City Limit line to the point of beginning. SECTION 2. This ordinance, together with the ayes and noes, shall be published once in full, within five days after its final passage in the Telegram Tribune, a newspaper published and circulated in said City, and the same shall go into effect immediately.
