HomeMy WebLinkAbout0521ORDINANCE N0. 521 (1971 SERIES) AN ORDINANCE REGULATING; THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REPMOVAL, CONVERSION, DEMOLITION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA, SANITATION, PLUMBING AND MAINTENANCE OF BUILDINGS OR STRUCTURES, INCLUDING EXCAVATION, GRADING AND EARTHWORK, IN THE CITY OF SAN LUIS OBISPO, STATE OF CALIFORNIA, PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR, DECLARING FIRE DISTRICTS, PROVIDING PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. That Sections 8100 through 8170.4; 8210 through 8220.11 and 9400.1 through 9400.17 of the San Luis Obispo Municipal Code shall be and the same are hereby repealed. SECTION 2. That the following Sections shall be and the same are hereby adopted as part of the San Luis Obispo Municipal Code: (Begins on Page 1) SECTION 3. This Ordinance, together with the ayes and noes, shall be published once in full, at least three days before its final passage, in the Telegram- Tribune, a newspaper published and circulated in said City, and the same shall go into effect at the expiration of thirty (30) days after its said passage. GENERAL PROVISIONS: That five (5) documents and their appendixes, three (3) copies each of which are on file in the office of the City Clerk of the City of San Luis Obispo, identified by the Seal of the City appearing thereon, being marked and designated as the "Uniform Building Code) Volume I ", "Uniform Mechanical Code, Volume II", "Uniform Housing Code, Volume III ", and "Dangerous Building Code, Volume IV", 1970 Editions, published by the International Conference of Building Officials, and the "Uniform Plumbing Code ", 1970 Edition, published by the International Association of Plumbing and Mechanical Officials, be and the same are hereby adopted as the Building Regulations of the City of San Luis Obispo, terms of such "Uniform Codes" on file in the office of the City Clerk, are hereby referred to, adopted and made a part hereof as if fully set out in this Ordinance, except as amended by the provisions of Parts 2, 3, 4, 5 & 6 of this Chapter. SECTION 8100.1 FIRE ZONES: In accordance with Section 3110, et seq. of the San Luis Obispo Municipal Code, the entire incorporated area of the City of San Luis Obispo has been divided into Fire Zones 1, 2 and 31 designated on a certain map on file in the office of the City Clerk of the City of San Luis Obispo, which has been adopted as the fire zoning map of the City of San Luis Obispo for the application of the regulations included in the Uniform Building Code, 1970 Edition, published by International Conference of Building Officials. SECTION 8100.2 DESIGNATION OF BUILDING OFFICIAL: The Director of Planning and Building is hereby designated as the Building Official of the City of San Luis Obispo. CHAPTER I - PART II SECTION 8120. MENDMENTS) UNIFORM BUILDING CODE, VOLMIE I. The following sections of the Uniform Building Code, Volume I, 1970 Edition, are hereby amended as follows: (a) SECTION 301(a). Add as follows: Exception: 1. Permits shall not be required for: - 1 - (a) Non - structural work valued at $100.00 or less. All, such work shall be coordinated with the Building Department for verification that the exception is applicable. (b) Concrete patio slabs, driveways, parking pads and similar surfacing, not intended for future erection of structures thereon. (b) SECTION 301(c). Delete the first sentence and substitute the following therefor: With each application for a building permit, and when required by the Building Official for enforcement of any provisions of this Code, three (3) sets of plans and specifications shall be submitted. (c) SECTION 302(d). Add as follows: Every permit shall automatically expire eighteen (18) months after date of issue and shall be renewable at the discretion of the Building Official by payment of one -half (1/2) of the original Building Permit fee. Exceptions: 1. Work for which a permit has been issued and which has been continuous for the specified time, may be extended with the Building Official's approval. 2. Work for which a Demolition Permit has been issued shall expire by limitation and become null and void, if the work authorized by such permit is not commenced within thirty (30) days from the date of issue and shall automatically expire ninety (90) days from date of issue. (d) SECTION 303(a) BUILDING PERMIT FEES: Add the following exception to the first paragraph: Exception: Fees for prefabricated, factory built structures and,/or components shall be forty percent (40%) of those set forth in Table 3 -A for complete factory assembled structures, and seventy percent (70%) of those set forth in Table 3 -A for componentized structures assembled at the erection site. (e) SECTION 303(b). Delete and substitute the following therefor: i PLAN CHECKING FEES. When the valuation of the proposed construction exceeds $2,000, and a plan is required to be submitted by Subsection (c) of Section 301, a plan checking fee shall be paid to the Building Official at the time of submitting plans and specifications for checking. Said plan checking fee shall be equal to one -half of the Building Permit fee as set forth in Table 3 -A. Exception: Plan checking fees for prefabricated factory built structures and /or components shall be equal to one -half (1/2) of those fees established by the exception to Section 303 (a). (g) SECTION 2629. Add a second paragraph as follows: Where concrete slab floor on grade construction is used and slabs are not poured monolithic with footings, there shall be placed vertically in all perimeter footings 3/8" deformed steel reinforcing bars, spaced four (4) feet center to center. These bars shall be bent inward and tied to the 6 x 6--1010 wire mesh slab reinforcing prior to pouring the slab. Vapor barriers shall not extend over bearing surfaces of the perimeter footings or stem walls. When floor slabs and footings are poured monolithic, the 3/8" 0 vertical reinforcing may be omitted. All building slabs shall have a minimum 6 x 6--10/10 wire mesh reinforcing. - 3 r (h) SECTION 2905(d). Add as follows: Not less than one continuous deformed steel reinforcing bar., of at least one half inch (1/211) in diameter., shall be placed in all footings. Where foundation walls are used,at least one additional bar shall be placed not less than three inches (3").s nor more than six inches (611) from the top of said walls. Bars shall be held in place by chairs and /or tying. (i) SECTION 3802(b). Add the following exception after the first paragraph: Exception: Standard automatic fire - extinguishing systems may be omitted, with the Building Officials and Fire Department's approval, in buildings used exclusively for storage or use of high value electronic equipment made of non - combustible materials, providing the building is equipped throughout with a heat and products of combustion other than heat detector system of a tested and approved design, installed to the satisfaction of the Fire Department. (j) SECTION 4409. Add as follows: Dry ruhble and debris shall be wetted down in such a manner so as to prevent objectionable dust and particulate matter from being stirred up and becoming a nuisance to the general public. (k) CHAPTER 70 OF THE APPENDIX: This Chapter shall be enforced by the Building Official or the City Engineer, except as follows: Sections 7006, 7007, 70085 7014, 70153 7017 and 7018 shall be enforced by the City Engineer. (1) SECTION 7016: New Section to read as follows: SECTION 7016: DUST PREVENTION: All graded surfaces and materials shall be wetted, protected or contained in such manner as to prevent dust or spill upon any adjoining property or street. (m) SECTION 7017: New Section to read as follows: SECTION 7017: HOURS OF OPERATION: Excavation and /or Grading shall be done between the hours of 7 A.M. and 10 P.M. except in case of urgent necessity in the interest of public health and safety, and then only with a permit from the City Engineer, which permit may be granted for a period not to exceed three (3) days or less while the emergency continues and which permit may be renewed for periods of three days or less while the emergency continues. If the City Engineer should determine that the public health and safety will ndt be impaired by the excavation or grading within the hours of 10 P.M. and 7 A.M. and if he shall further determine that loss or inconvenience would result to any party in interest, he may grant permission for such work to be done within the hours of 10 P.M. and 7 A.M., upon application being made at the time the permit for the work is awarded or during the progress of the work. (n) SECTION 7018: New Section to read as follows: SECTION 7018: STOCKPILING: When, in the opinion of the City Engineer no detriment to the neighborhood is created and the intent of this ordinance is served, the City Engineer may issue a permit to permit stock- piling of earth on a property subject to such conditions as the City Engineer may deem appropriate without payment of fees or submittal of plans and reports. All such stockpiled material shall be included within the calculation of quantities when such material is compacted. Each such permit for stockpiling will expire one year from date of issuance unless an extension is approved by the City Council prior to the expiration of said one year period. CHAPTER 1 - PART III SECTION 8130, AMENDMENTS, UNIFORM MECHANICAL CODE, UNIFORM BUIID ING CODE, VOLUME II. The following sections of the Uniform Mechanical Code are amended as follows: (a) SECTION 304. Delete the $3.00 fee for issuing a permit and substitute $2.00 in lieu thereof. CHAPTER 1 - PART IV SECTION 8140. AMENDMENTS, UNIFORM HOUSING CODE, UNIFORM BUILDING CODE, VOLUME III, (a) SECTION H -203. Delete the first sentence and substitute the following therefor: SECTION H -203. The Building Board of Appeals shall act as the Housing Advisory and Appeals Board$ in order to provide for final interpretation of the provisions of this Code and to hear appeals provided for hereunder, -4A- (h) SECTION 2905(d). Add as follows: Not less than one continuous deformed steel reinforcing bar, of at least one half inch (1/211) in diameter, shall be placed in all footings. (k) Chapter 70 of the Appendix - Delete Sections 7003, 7006, 7007, 7008, 7009, 7010, 7014 and 7015 in their entirety. CHAPTER I - PART III SECTION 8130. AMENDMENTS, UNIFORM MECHANICAL CODE, UNIFOR111 BUILDING CODE, Volume II The following sections of the Uniform Mechanical Code are amended as follows: (a) SECTION 304. Delete the $3.00 fee for issuing a permit and substitute $2.00 in lieu thereof. CHAPTER I - PART IV SECTION 8140. AMENDMENTS, UNIFORM HOUSING CODE, UNIFORM BUILDING CODE, VOLUME III. (a) SECTION H -203. Delete the first sentence and substitute the following therefor: SECTION H -203. The Building Board of Appeals shall act as the Housing Advisory and Appeals Board, in order to provide for final interpretation of the provisions of this Code and to hear appeals provided for hereunder. -4- CHAPTER I - PART V SECTION 8150. AMENDMENTS, DANGEROUS BUILDINGS CODE, UNIFORM BUILDING CODE, VOLUME IV. (a) SECTION 205. Delete in its entirety and substitute the.follow- ing therefor: The Building Board of Appeals shall act to provide for final interpretation of the provisions of this Code and to hear appeals provided for hereunder. CHAPTER I - PART VI SECTION 8160. AMENDMENTS, UNIFORM PLUMBING CODE. The following sections of the Uniform Plumbing Code are amended as follows: (a) SECTION 1.1. Insert "Building Official" in the space provided. (b) SECTION 1.2. Insert "Building Inspector(s) in the space pro- vided. Delete the second sentence. (c) SECTION 1.3. Insert "Planning and Building" in the space pro- vided. (d) SECTION 1.7. Insert "five hundred dollars ($500.00) "; "City or County "; and "six (6) ", in the appropriate spaces provided. (e) SECTION 1.10. Delete Subsection (a). Redesignate Subsection (b) as Subsection (a) and redesignate Subsection (c) as Sub- section (b). (f) PART DIO: Delete in its entirety. SECTION 303. Delete Subsection (c) in its entirety and the following is substituted therefor: (c) Each parcel of land or lot shall have its own separate connection to a public sewer main. SECTION 317. Add to Subsection (d) following the first sentence: "A six inch layer of sand or comparable material shall be laid in ditches to provide a leveling and laying bed for pipe." SECTION 323. Delete the first sentence in its entirety and sub- stitute the following: "The Building Board of Appeals shall decide any appeal arising from actions of the Administrative Authority." SECTION 410. New Section. City Engineer empowered to stop overflow. - 5 - (a) if the property owner fails to install and maintain a back- water trap or back -water valve in good working condition, when required under this Section, the City Engineer may order and require said plumbing fixture to be disconnected and removed and the outlet there plugged or capped. In the event that the property owner fails to disconnect and plug or cap the sewer connection within ten (10) days after written notice by the City Engineer, then the City Engineer shall arrange for such disconnection and capping; the cost of which shall be a debt of the property owner and which may be collected by court action or may be declared to be a lien by action of the City Council after public hearing and notice to the property owner and shall be added to and collected as part of the tax roll. (b) As an alternate to the procedure set forth in Section 410(b), if the property owner fails to install and maintain a back- water trap or back -water valve in good working condition when requested under this part, the City Engineer may order and re- quire termination of water service to the parcel and all structures connected to the sewer outlet subject to overflow. Said water service shall not be reinstated until the mainten- ance or installation of the back -water trap or back -water valve has been approved by the City Engineer. (Ordinance No. 287 - -1961 Series.) (c) All house connection sewers, industrial sewers, private sewage disposal systems and appurtenances thereto, now exist- ing or hereafter constructed, shall be maintained by the owner of the property in a safe and sanitary condition and all de- vices or safeguards which are required by this part for the operation thereof, shall be maintained in good working order. SECTION 1103. Add Subsection (c) as follows: "No bituminous fiber pipe shall be used as a building drain or sewer." CHAPTER I - PART VII SECTION 8170., CIVIL DEFENSE SHELTERS. SECTION 8170.1 PERMITS. No person shall construct a fallout, blast resistant or limited blast resistant shelter without first having.obtained a permit from the Building Official. -,6— SECTION.8170.2 APPLICATION. Permits shall be issued upon application, accompanied by standard drawings and specifications, obtainable at no cost from the Director of Civil Defense, City Hall basement, 990 Palm Street. Permits shall be issued at no cost. Exception: Shelters constructed as part of a new building or part of the structural frame of a new or existing building shall be evaluated accordingly and a permit fee shall be paid. SECTION 8170.3 YARD ENCROACHMENT. Protective shelters, unless totally underground, shall not encroach into any required rear, side or front yard setback. SECTION 8170.4 UNIFORM BUILDING CODE. Chapter 57 in the Appendix in Volume I of the Uniform Building Code, 1970 Edition, shall apply in addition to the Sections set out herein and any Civil Defense Regulations which may be applicable. Where a conflict arises between provisions, the most restrictive shall apply. CHAPTER I - PART IX SECTION 8190. TENTS. SECTION 8190.1 DEFINITION. "Tent" as used in this Chapter is any structure or enclosure con- structed of canvas or other combustible fabric or similar material. SECTION 8190.2 PERMIT REQUIRED. No person shall erect, use or maintain any tent other than as pro- vided in this part and Article 30 of the Uniform Fire Code, without first having obtained a permit to do so from the Council in the manner hereinafter provided. SECTION 8190.3 APPLICATION. Application for the erection, use, or maintenance of any tent shall be made to the Council, through the Department of Planning and Building. Application shall be in the form of a letter, submitted not less than twenty (20). days prior to the erection or use of said tent. Each application shall be accompanied by the following infor- mations 1. Address of the site on which the tent is to be erected and used. 2. Name and address of the owner of said property. 3.. Name and address of the person(s) or firm for whom the tent is to be erected. -7- 4. Name and address of the person(s) or firm erecting said tent. 5. A statement of purpose for which said tent is to be erected and used. 6. The length of time said tent is to be maintained and used. 7. A fully dimensioned plot plan for the site showing the size of the tent, distances to other structures, property lines and uses. 8. Location of available parking space. SECTION 8190.1 PERMIT FEE. A permit and inspection fee, in the amount of $15.00, shall be paid at the time of application. $10.00 of this fee is refundable if the permit is denied. SECTION 8190.5 HEARING AND ISSUANCE OF PERMIT. Within twenty (20) days following the filing of an application, the Council shall hear the request for permit and shall render its decision. If the Council shall find the issuance of the permit would not be detrimental to the public safety, interest or welfare, the Council may grant said permit. The application shall otherwise be denied. SECTION 8190.6 DURATION. In approving any permit, the Council shall specify the number of days the permit shall remain in effect, provided however, that no permit shall authorize the erection and maintenance of any tent at any location for more than thirty (30) consecutive days. Any tent authorized under this section shall be promptly dismantled and removed when the permit expires. SECTION 8190.7 FLAME PROOFING. Any canvas or other fabric used in tents shall be flameproofed and shall meet all requirements of Section 30.06 of the Uniform Fire Code. SECTION 8190.8 EXCEPTIONS. Any tent in or under which less than ten (10) persons may gather, or which covers an area not in excess of two hundred (200) square feet, shall not be subject to this part or the requirements of Article 30, Uniform Fire Code. SECTION 8190.9 ELECTRICAL EQUIPMENT. All electrical wiring and other electrical equipment shall meet the requirements of the Electrical Code of the City of San Luis Obispo. SECTION 8190.10 ZONING ORDINANCE. No permit shall be issued for any tent, which is contrary to the provisions of the Zoning Ordinance of the City of San Luis Obispo. SECTION 8190.11 SANITARY FACILITIES. Toilets and other sanitary facilities shall be provided as required by the Building Official and /or Health Officer, SECTION 8190,12 INSPECTION, No person shall use or occupy or permit the use or occupancy of any tent regulated by this section, until said tent shall have been inspected and approved for use by the Building Official, Fire Marshal and Health Officer.
