HomeMy WebLinkAbout0531ORDINANCE NO. 531 (1971 Series) f , AN ORDINANCE AMENDING THE OFFICIAL ZONE MAP OF-THE CITY OF SAN LUIS OBISPO. BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. That the following described portion of the City of San Luis Obispo as shown. on the Official Zone h1ap of the City of San Luis Obispo be reclassified as follows. Said property is also shown on the map attached hereto marked Exhibit "A" and incorporated herein by reference. From District C -N -S (neighborhood commercial - combining) to District PD R -2 (planned development- residential medium density) real property described as: Those portions of Section 36, Township 30 South, Range 12 East, Mount Diablo Meridian and Section 1, Township 31 South, Range 12 East, 1, ount Diablo Meridian, in the city of San Luis Obispo, county of San Luis Obispo, State of California, described as follows: Beginning at the Northeasterly corner of Lot S. in Block B of Tract No. 208, as shown on map recorded in Book 6, Page 49 of Maps, in the office of the county recorder of said county; thence along the boundary of said Tract No. 208; as f ollows: South 00 57' 38" East 60.00 feet, North 89° 02' 22" East 170.55 feet; South 0° 57'.38" East 40.00 feet; Southerly along a tangent curve concave Northeasterly having a radius of 20.00 feet; through a central angle of 900 an arc distance of 31.42 feet, and tangent to said curve, North 89° 02' 22" East, 274.87 feet to a point, said point being the Southeasterly corner of the property conveyed to Hacienda Hospital, Inc., by Deed recorded December 26, 1967 in Volume 1460, Page 192 of Official Records, and the true point of beginning; thence continuing North 89 ° 02' 22" East, 65.13 feet to a point; thence Easterly along a curve tangent to said last mentioned course, concave Northerly, having a radius of 3,470.00 feet through a central angle of 1° 17' 49 ", an arc distance of 78.54 feet to a point; thence tangent to said curve North 87° 44' 33" East, 260 feet more or less to the South- westerly corner of the .property conveyed to Young Cho et al., by Deed recorded September 24, 1964 in Volume 1316, Page 390 of Official Records; thence North 2° 15' 27" West along the Westerly line of the property conveyed to Young Cho et al.., 239.96 feet to a point, said point being the most Southerly corner of the property conveyed to Young Cho et al., as Parcel 1 in deed recorded December 27, 1963 *in Volume 1276, Page 459 of Official Records; thence North 230 52' 'Jest, 8.00 to a point; thence North 660 08' East, 8.00 feet to a point; thence North 230 52' West, 75.00 feet to a point; thence South 66° 08" West, 10.00 feet to a point; thence North 23° 52' West; 97.15 feet to a point, said point being the Northwesterly corner of the property conveyed to Young Cho et al., by Deed recorded September 24, 1964 in Volume 1316, Page 390 of Official I;ecords, said point also being a point in the Northerly line of Parcel 1 as conveyed to Coast Valley Properties Company, a limited partnership by Deed recorded March 6, 1963 in Volume 1228, Page 723 of Official Records; thence South 600 30' 'Jest, along said Northerly line, 360 feet more or less to a point, said point being the Northeasterly corner of the property conveyed to Hacienda Hospital, Inc., by Deed recorded December 26, 1967 in Volume 1460, Page 192 of Official Records; thence South 0° 57' 38" East along the Easterly line of the property conveyed to Hacienda Hospital, Inc., 237.85 feet to the true point of beginning. Also known as 3290 Southwood Drive. Approval is subject to the following conditions: 1. The developer shall process a subdivision map and upon submittal of subdivision map shall submit covenants providing for common use of walkways and open space on the six parcels fronting on Southwood Drive. 2. The creek bank is to be designed to a high esthetic standard. Said design to be approved by the City Engineer and Planning Director. The creek is to be retained as an open channel and in its natural state. 3. Existing eucalyptus trees shall be trimmed to remove hazard: Said trimming to be to the satisfaction of the Parks and Recreation Department. S21 Ordinance No. 531 -(1971 ries) Page 2 4. Covenants shall be recorded providing for common use of the proposed alley. 5. Developer shall show sewer line and easements along westerly property line with no structures over the easements. 6. Street trees shall be planted along Southwood Drive in accordance with the Street Tree Ordinance. 7. A detailed landscape plan showing plant materials and method of irrigation and play area shall be submitted to the Department of Planning & Building for review and approval. 8. A precise plan shall be submitted within six months from date of approval of the preliminary plan. 9. Construction shall commence within two years of date of approval of precise plan. 10. Developer shall install two City standard hydrants with street valves on six (6) inch cast iron laterals from the existing street main, one to be located immediately to the right of the east side entrance driveway, the other to be located immediately to the right of the west side entrance driveway. 11. Hydrants shall be installed and fully operable, and adequate access maintained prior to the start of any combustible building construction. 12. At any such future time that this occupancy is determined to be primarily student housing, additional fire detection and /or alarm protection may be required. 13. A 5 ft. landscaped easement shall be provided along the east and west property lines . 14. Developer shall record a pedestrian easement providing for access from Southwood to the units in the rear, as per site plan. 15. The developer shall submit evidence providing for use of swimming pool for those units fronting on Southwood Drive. 16. At such time as the precise plan is submitted, final and detailed elevations shall be submitted to the Planning Commission for approval. SECTION 2. This Ordinance, together with the ayes and noes, shall be published once in full, at least three days prior to its final passage, in the Telegram- Tribune, a newspaper published and circulated in said City, and the same shall go into effect at the expiration of thirty days after its said final passage.
