(1972 Series) AN ORDINANCE AMENDING PORTIONS OF ARTICLE III, CHAPTER 10 part 2, OF THE SAN LUIS OBISPO MUNICIPAL CODE, TO ADOPT THE 1971 EDITION OF THE UNIFORM FIRE CODE, TOGETHER WITH AMENDMENTS AND ADDITIONS THERETO; AND REPEALING ALL ORDIN- ANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. BE IT ORDAINED by the Council Of the City of San Luis Obispo as follows: 542 Y' SECTION 1,,SECTION 3120.1 of the San Luis Obispo Munici- pal Code is hereby,amended to read as follows: "There is hereby adopted by the Council of the City of San Luis Obispo for the purpose of prescribing regulations governing conditions hazardous to life and property from fire and explosion, that certain fire prevention code known as the "UNIFORM FIRE CODE" recommended by the Western Fire Chiefs Association and the International Conference of Building Officials, being particularly the 1971 edition, and the whole thereof including appendices save and except such portions as are hereinafter modi- fied by Section 3120.4 of the San Luis Obispo Municipal Code, of which, code not less than three (3) copies have been and now are filed in the office of the City Clerk of the City of San Luis Obispo, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect the provisions thereof shall supersede the Fire Prevention Code heretofore adopted by the City of San Luis Obispo and shall be controlling within the limits of the City of San Luis Obispo." SECTION 2, SECTION 3120.4 of the San Luis Obispo Municipal Code is hereby amended to read as follows: "The provisions of the Uniform Fire Code, hereinafter referred to as U.F.C., 1971 Edi- tion, are amended, supplemented, and repealed as follows:" SUBSECTION 3120.4.1 SECTION 1.205 U.F.C. is amended to read as follows: "The Chief and members of the Fire Prevention Bureau shall have the powers of a police offi- cer in performing their duties under this code, shall have the powers of a peace officer as provided in California Penal Code, Sections 830.3 (1) and shall have the authority to issue citations as provided in Sections 1250 through 1254 of the San Luis Obispo Municipal Code." (2 ) 1 SUBSECTION 3120.4.2 (a) Section 1.216 U.F.C. is amended to add the following standards to the recognized standards set forth in said actions: (1) The following is added as a standard of the American National Standards Institute, Inc.: "K61.1 Storage and Handling of Anhydrous Ammonia, 1966." (2) The following are added as standards of the Compressed Gas Association, 500 Fifth Avenue, New York, N.Y. 10036: "G-8 -1964 Piping of Nitrous Oxide." "Specifications, Properties, and Recommendations for Packaging, Transportation, Storage, and Use of Ammonium Nitrate." (3) The following are added as standards of the National Fire Protection Association: 1117 Dry-Chemical Extinguishing Systems, 1969." 1180A Protection.of Buildings from Exterior Fire, 1970." "96A Removal of Smoke and Grease - Laden Vapors from Commercial Cooking Equipment, 1971." SUBSECTION 3120.4.3 Section 8.103 U.F.C. is amended to read as follows: "A permit shall be required for the storage, handling, or use at normal temperature and pressure of more than 2,000 cubic feet of flam- mable compressed gas, 6,000 cubic feet of non- flammable compressed gas, and any use of non- (3) flammable medical gas in other than hospitals and similar facilities." SUBSECTION 3120.4 4 Section 8.109 U.F.C. is added to read as follows: "Storage, piping or use of oxygen, nitrous oxide and other non - flammable gases for medical, dental or other similar purpose in any area of any building other than hospitals shall conform to Appendix G." SUBSECTION 3120.4.5 Section 10.113 (b) U.F.C. is amended to read as follows: "Exit Signs. At every required exit doorway, and wherever otherwise required to clearly indicate the direction of egress, an exit sign. with plainly legible letters at least 6 inches high by % inch stroke and readily distinguishable shall be maintained from all areas serving the occupant load specified in this subsection. In interior stairways, the floor level leading directly to the exterior shall be clearly indicated. Group A Occupancies and Groups B, C, and 'H Occupancies with an occupant load of more than 50. All other occupancies serving an occupant load of more than 100." -SUBSECTION 312.0.4.6 Section 13.206 U.FoCe is amended to read as follows: "(a) No person shall place or keep any pest, fence,.growth, trash or other material or thing near any fire hydrant that would prevent such hydrant from being immediately discernable or in any.other manner deter or hinder the fire department from gaining immediate access to a fire hydrant." "(b) Fire hydrants on private property shall have no parking zones identified by a red painted curb, berm or stripe at least eight (4) inches wide and fifteen feet long. Readily legible, permanent, all- weather signs shall be conspicuously posted with a minimum lettering of 2 inches by �4- inch to read: "VEHICLES IN RED NO - PARKING ZONES TOWED AWAY AT OWNER'S EXPENSE. 4220.3 M. C., 22658 V.C. Police Department Phone 543 - 3131." SUBSECTION 3120.4.7 Section 13.208 U.F.C. is amended to read as follows: "Access driveways serving buildings or property shall have a vertical clearance of not less than 12 feet above the finished driveway surface. EXCEPTION: Groups I and J Occupancies as specified in the Building Code. Where auxiliary means of access or fire pro- tective measures approved by the Chief are provided, the above required clearance may be modified or waived." SUBSECTION 3120.4.8 Section 13.209 U.F.C. is added to read as follows: BUILDING ACCESS "(a) At least one exterior wall and a portion of the roof of all buildings other than dwellings shall be within the. designed reach limitations of the aerial ladder apparatus as it is parked on the closest public street or approved emergency access driveway. (b) Approved emergency access driveways (see 13.209 (a) and 13.301 (c), shall conform to Appendix H. (c) Where auxiliary means of access or fire protective measures approved by the Chief are provided, the above required access may be modified or waived." (5) SUBSECTION 3120.4.9 Section 13.301 (c) U.F.C.., is amended to read as follows: "All premises where trailer coaches., mobile homes, combustible structures, buildings or portions of buildings other than dwellings, or hazardous amounts of any combustible or hazardous materials are constructed, located, or stored, access to such premises shall be provided conforming to Appendix H, with San Luis Obispo City standard fire hydrants provided at locations, either on- site or within city sidewalk right -of -way as may be required by the Chief, and connected to a water system capable of supplying the fire flow required by the Chief." SUBSECTION 3120.4.10 Section 13.307 (a) U.F.C. is amended to read as follows: "Every apartment house three stories or more in height or containing more than 15 apartments and every hotel three stories or more in height or containing 20 or more guest rooms shall have installed therein an approved automatic or manually operated fire alarm system designed to warn the occupants of the building in the event of fire. Such fire alarm systems shall be so designed that all occupants of the building may be warned simul- taneously." SUBSECTION 3120.4.11 Section 13.308 (d), U.F.C. is added to read as follows: "Where Required. Standard automatic fire extinguishing systems shall be installed and maintained in operable condition as specified in this chapter in the following locations: EXCEPTION. Standard automatic fire extinguishing systems may be omitted, with the Building Official's and Chief's approval, in buildings used exclusively for storage or use of high value electronic equip- ment made of non - combustible materials, providing the buRding is equipped throughout with a heat and "invisible products of combustion other than heat" detector system of a tested and approved design, installed to the satisfaction of the Chief. (6) r 1. In every story, basement or cellar of all buildings except Group I occupancies when floor area exceeds 1500 square feet and there is not provided at least 20 square feet of opening entirely above the adjoining ground level in each 50 lineal feet or fraction thereof of exterior wall in the story, basement or cellar on at least one side of the building. Openings shall have a minimum dimension of not less than 30 inches. Such openings shall be maintained readily accessible to the Fire Department and shall not be obstructed in a manner that fire fighting.or rescue cannot be accomplished from'the exterior. When openings in a story are provided on only one side and the opposite wall of such story is more than 75 feet from such openings, the story shall be provided with an approved automatic fire extinguishing system or openings as specified above shall be provided on at least two sides of the exterior walls of the story. If any portion of a basement or cellar is located more than 75 feet from openings required in this Section, the basement or cellar shall be provided with an approved automatic fire extinguishing system. 2. In any enclosed useable space below or over a stairway in Groups B, C, and D occupancies. 3. In basements or cellars larger than 1500 square feet in floor area of Groups A, B, C, and D occupancies. 4. In all Group D occupancies, except jails, prisons, and reformatories, as required by California Administrative Code, Title 19, Article 9.10. 5. In Group E, Division 1 and 2 occupancies having an area of more.than 1500 square feet;. in Group E, Division 3 occupancies having an area of more than 3000 square feet; and in Group E, Division 4 occupancies more than one story in height. I- 0. At the top of rubbish and linen chutes and in (7) their terminal. room in other than Group I occupancies. Chutes extending through three or more floors shall have additional sprinkler heads installed within such chutes at alternate floors. Sprinkler heads shall be accessible for servicing. 7, In Group F, Division 2 occupancies used for, retail sales when the occupancy is over 12,000 square feet in a single floor area or more than stories in height; however the respective increases for area and height specified in Uniform Building Code Sections 506 and 507 shall be permitted. 8. In Groups .A and B Occupancies when the occupancy has over 12,000 square feet of floor area which can be used for exhibition or display purposes; however, the'respective increases for area speci- fied in Uniform Building Code Sections 506 and 507 shall be permitted. 9. Cooking equipment used in processes producing smoke or grease -laden vapors in all commercial, industrial, institutional and similar occupancies shall be equipped with approved fire extinguishing equipment and smoke and vapor collection and exhaust systems complying with NFPA Standards. SUBSECTION 312004,12 Section 13.310 (a) U.F.C. is amended to read as follows: .'General. Dry standpipes shall comply with re- quirements of this section and shall be-required in all buildings four or more s-cories in height.", SUBSECTION 3120.413 Section 13,311 (c) 8 U.F.0 s amended to read as follows. "Where wet standpipe systems are provided in buildings having a fire sprinkler system the "wet standpi.pe water supply shall be supplied by the* fire sprinkler system." SUBSECTION 3120.4.14 Section 13.314 (a) U.F.C. is amended to read. "When required. Basement pipe inlets shall be installed in the first floor of every building, ot')er than dwellings, having cellars or base - mFnts (8) EXCEPTION: Basements or cellars fully protected by approved automatic fire sprinkler systems, when approved by the Chief." SUBSECTION 3120.4.15 Section 15.101 (d) U.F.C. is amended to read as follows: "In particular installations, the provisions of this code may be altered at the discretion of the authority having jurisdiction after consideration of the special features such as topographical conditions, barricades, walls, adequacy of building exits, nature of occupancies, proximity to buildings or adjoining proper.ty.and character of construction of,such buildings, capacity and construction of proposed tanks and character of liquids to be stored, nature of process, degree of private fire protection to be provided and the adequacy of facilities of the fire department to cope with flammable and combustible liquid fires." , SUBSECTION 3120.4.16 Section 15.111 U.F.C. is amended to read as follows: "No flammable liquid with a flash point below 100 degrees F. shall be used within a building for-washing parts or removing grease or dirt unless it is used in a closed machine approved for the purpose or in a separate well- ventilated room constructed in accordance with Section 15.404, Inside Storage and Handling Rooms." _SUBSECTION 3120. 4.17 Sections 15:201 (a) and (b) U.F.C. are deleted and Section '15.201 is added to read .as follows: "The storage-of in aboveground prohibited." SUBSECTION 3120.4.18 flammable and combustible liquids tanks outside of buildings is Section 15.506 (d) U,F.C. is amended to read: "In buildings, rooms or other confined which flammable or combustible liquids no combustible waste materials shall b:2 to accumulate." (9) space in are stored, allowed r SUBSECTION 3120.4.19 Section 15.506 (e) U.F.C. is added to read as follows: "Crankcase drainings and flammable or combustible liquids shall not be dumped on the ground, into sewers, drainage ditches or storm drains, but shall be stored in tanks or tight drums outside of any building until removed from the premises." SUBSECTION 3120.4.20 Section 15:602 (b) U.F.C. is amended to read as follows: "Class I, II, and III flammable liquids shall be stored outside of buildings in closed containers having a capacity of 55 gallons maximum, or underground." SUBSECTION 3120.4.21 Section 15.602 (c) U.F.C. is deleted. SUBSECTION 3120.4.22 Section 1 .703 (a) U.F.C. is amended to read as follows: "General Provisions. Class 1 liquids shall be stored in closed containers, or in tanks located underground or in special enclosures as described in Section 15.703 (b)., Class II and III liquids shall. be stored in containers or in tanks located under- ground or in special enclosures as described in Section 15.703 (b) . i1 SUBSECTION 3120.4.23 Section 15.704 (b) U.F..C. is amended to read as follows: "Supervision. Every service. station open to the public shall have an attendant or super- visor on duty whenever the station is open for business. A qualified attendant shall remain at the immediate area of the dispen sing nozzle during the time that flammable liquids are being transferred, (1.0) SUBSECTION 3120.4.24 Table No. 15.706, U.F.C.9 . the lower left hand box, (Page 125), is amended to. read: "Special Enclosure. Inside Building.per Section 15.703 (b)." SUBSECTION 3120.4.25 Section 15.707 (a) U.F.C. is amended to read as follows: "Electrical equipment shall conform to Section 15.706." SUBSECTION'3120.4.26 Section 24.101 U.F.C. is amended to read as follows: "(a) This Article applies to oil- burning equipment except internal combustion engines, oil lamps, and portable-devices such as blow torches, melting pots, and weed burners. (b) The use of oil- burning equipment in buildings other than-dwellings shall require a permit from the Fire Depart- ment." SUBSECTION 3120.4.27 Section 27.101 (a) U.F.C. is amended to read as follows: "No waste matter, combustible material or refuse shall be burned in the open air within the City, except barbecue fires.'! SUBSECTION 3120.4.28 Section 27.101 (b) U.P.C. is amended to read as follows: "No waste matter which shall in burning, cause or create a dense cr offensive smoke, shall be burned upon any premises within the corporate limits of the City, whether in an incinerator or riot except as noted above." SUBSECTION 3120.4.29 Sections 27.101 (c) and (d) U.F.C., are deleted. (11) SUBSECTION 312004030 Section 27.105 (a) U.F,C. is amended to read as follows: "Every incinerator shall be constructed and. maintained in accordance with the require- ments of the Air Pollution Control District having jurisdiction." SUBSECTION 312004,31 Section 27,105 (b), (c), (d),.and (e) are deleted. SUBSECTION 3120.4.32 Section 27.105 (a) and (b) U.F.C. are deleted. SUBSECTION 312004,33 Section 27.107 U.F.C. is deleted. SUBSECTION 3120,4034 Section 27.112 U.F.C� is amended to read as follows: "No waste matter shall be disposed of by burning except in accordance with current City and County regulations." SUBSECTION-3120.4.35 Section 27.201 (d) U.F.C. is added to read. as follows: "All trash and /or garbage receptacles.or con= tainers within buildings shall be of solid, all -metal construction. If.not emptied at the close of each day, all such containers must be tightly covered with solid, all - metal lids.0 SUBSECTION 3120,4.36 Section 27°206 is added to read as follows: The owner, occupant or other person having under his control any property, or materials on a property, damaged by fire shall, when ordered by the Chief, immediately secure the property against entry or unauthorized access by the public, either by boarding up all openings, fencing, barricading, or other appropriate measures. Within thirty (30) days after written notice to do so has been served, all debris and /or damaged materials shall be removed from the property and proof (12) furnished that contractual arrangements have been made for demolition, replacement, or repair of all fire damaged structures re- maining on the property involved in the fire. SUBSECTION 3120.4.37 Section 27.302 (a) U.F.C. is amended to read as follows: "For the purpose of thii.s section a fire alarm shall be deemed and construed as being any act as follows: The giving, signaling or transmission, whether by telephone, spoken word or other- wise, information to the effect that there is a fire at or near the place indicated by the person giving, signaling, or transmitting such information." SUBSECTION 3120.4.38 Section 27.302 (c) U.F.C. is amended to read as follows. "it shall be unlawful for any person to tamper with or maliciously injure any fire alarm equipment maintained for the purpose of transmitting fire alarms." SUBSECTION 3120.4.39 Section 30.114 U.F.C. is amended to read as follows: "At every exit and wherever otherwise required to clearly indicate the direction of egress, an exit sign with plainly legible letters at least 6 inches high by % inch stroke shall be provided and maintained." SUBSECTION 3120.4.40 U.F.C. Article 31 -Title is amended to read as follows: "Welding and Cutting, Calcium Carbide, Acetylene and Electric Arc" SUBSECTION 3120.4.41 Section 31.101 (c) U.F.C. is added to read as follows: (13) 'All welding and cutting operation inside buildings other than occupancies approved for such operations shall require a separate permit from the Fire Department for each project." SUBSECTION 3120.4042 Section 35.108.U.F.Co is amended to read as follows: "Aisles separating high piled stock shall be not less than 8 feet in width. Aisles separating stock more than 20 feet in height shall be not less than 10 feet in width. Main aisles shall be located beneath draft curtains. Stock piles shall not extend beyond or beneath a draft curtain. Aisles not less than 44 inches in width shall be established to provide access to exits and fire department access doors." SUBSECTION 3120.4.43 U.F.C. Appendix G is attached. SECTION 3. This Ordinance,- together with the ayes and noes, shall be published once in full, at least three days before its final passage, in the Telegram- Tribune, a newspaper published and circulated in said City, and the same shall go into effect at the expiration of thirty (30) days after its said final passage. Graham, and on the following roll call vote: AYES: Councilmen Blake, Brown, Graham, Gurnee and Mayor Schwartz NOE S: None ABSENT: None ATTEST: (14) J APPENDIX G NONFLAMMABLE MEDICAL GAS SYSTEMS (IN OTHER THAN HOSPITALS) 1 SCOPE. (a) These regulations shall apply to the storage, piping or use of oxygen, nitrous oxide and other nonflammable gases for medical, dental, or other similar purpose in any area of any building other than hospitals as regulated by C.A.C. T -19 (covered, under NFPA 56 -F) and shall apply to both new and existing facili- ties within the city. (b) Piping systems shall not be•used for the distri- bution of combustible anesthetic gases. 2. DEFINITION° A piped distribution system shall be defined as consisting of a central supply with control equipment including one or more cylinders containing compressed gases or liquids, said central supply extending by means of piping to the points in the building where such materials may be required, and suitable station outlet valves at each use point. 3., SUPPLY AND /OR STORAGE: (a) Cylinders shall be designed, constructed, tested and maintained in accordance with current U.S. Department of Transporation (DOT) specifications and regualtions. ... (15 ) (b) All compressed gas cylinders in service or in storage shall be adequately secured by chains or'other suitable means to prevent falling or being knocked over. (c) Each cylinder or group of cylinders shall be marked in a readily visible mariner with.the name of the gas contained. (d) Each individual cylinder, or pair of cylinders interconnected by means of an approved rigi^ manifold, shall be equipped with an approved pressure regulating valve effectively reducing pressures to a maximum of 55 psig before entering cylinder leads ;pigtails), wall manifolds or pipeline systems. Cylinder leads, flexible hose or other connections between the cylinders and the wall manifold or pipeline supply shall be of a type approved by the Fire Chief. Check valves shall be installed to prevent the loss of gas.from a cylinder, .manifolded cylinders, or pipeline systems in the event the safety relief device on an individual. cylinder should function or cylindder connections should fail. (3) Oxygen supply systems or storage locations shall be in a separate room or enclosure with a fire resistive rating of at least one -hour. Any doors or openings from this room to the interior of the building shall be protected by a'self- closirg,ilabeled one -hour fire resistive assembly. Such rooms shall be directly vented to the outside . of the building at both the floor and ceiling levels by means of an arranament equivalent to combustion air ventilation requirements fore gas appliances. Minimum venting shall be thirty- six square inches-so located that one -half of the required venting -will be located within six inches of the floor and the other one -half within six inches of the ceiling. Rooms or enclosures for supply systems shall not °contain any type of heating unit, electric o- gas oper- ated appliance. No portion of airy electrical system, other than explosion- proof, shall be within a supply or storage room. All cylinders (16) on the premises, whether in use, awaiting use, or having been used, shall be stored in such a room. Such rooms may not be used for any other purpose. 4. PIPING (a) Manifolds and pipelines shall be searaless. type K or L (ASTM B -88) copper tubing or standard weight (schedule 40) brass pipe. Gas piping shall not be supported by other piping.but shall be supported with pipe hooks, metal pipe straps, bands or hangers suitable for the size of pipe, and at proper intervals as follows: 1� inch diameter pipe or less at 6 foot intervals, %4 inch at 8 foot, 1 and 4 inch at 10 .foot. All fittings used for connecting copper tubing shall be wrought copper, brass or bronze fittings made especially for solder or brazed connections. or approved gas tubing fittings (NFPA 56F -15, 413). Brass pipe shall be assembled with screw type brass fittings or with bronze or copper brazing type fittings. All joints in the piping, except those requiring screw connections, shall be made with silver brazing alloy or similar high melting point (at least 1000 degrees F.) brazing metal. (b) Pipelines installed in combustible partitions or in areas exposed to phvsical damage shall be protected by installation within a pipe or conduit. (c) The gas content of piping shall be readily identifiable by appropriate labeling with 'the name of the gas contained, said labeling appearing on the pipe at least once each 20 feet, in each room and each story traversed by the pipeline. (d) Station outlets shall be of an approved type, equipped with a manual or automatic shut -off valve, legibly labeled with the name of the gas involved, and suitably located or- recessed so as to avoid physical damage to the valve or control; equipment when attached. (17). (e) All piping, valves and fittings shall be of a type .supplied especially prepared for oxygen service by the manufacturer and received sealed on the job. Particular care shall be exercised in the.storage, handling and installation of all pipe and fittings to prevent contamination. Tools used in cutting or reaming sha).l- be kept free from oil or grease. Where contamination of any kind has occurred, the items affected shall be washed and rinsed as per NFPA 56 -29, 511. After installation of the piping but before installation of the outlet valves, all lines shall be blown clear by means.of oil free, dry air or nitrogen. 5. TESTS AND INSPECTION; All portions of completed pipeline systems sha'11 be subjected to a standing pressure test at not less than 150 psig with oil free, dry air or nitrogen. Each joint shall-be examined for leakage by means of soapy water. The source of test gas shall be discgnnected and the system shall remain leak -free for 24 hours. All tests shall be witnessed by, and completed systems inspected and approved by a fire department representative prior to any use. 6. ADMINISTRATION AND MAINTENANCE: (a)' All personnel involved in the administration, maintenance, use, handling, control or storage of nonflammable gases and /or the equip- ment required for their use shall be thoroughly familiar with and follow the procedures as described in NFPA Pamphlet No, 56 B, "Standard for Inhalation Therapy". (b) Each cylinder in a supply system shall be turned off at the end of each day or.operation. 18) • SUBSECTION 3.120.4.47 Appendix H is added to read as follows: APPENDIX H Emergency Access Roadways 1. INTENT It is the intent of this article to provide adequate emergency access roadways wherever necessary to allow ingress and egress of fire department fire fighting and rescue vehicles upon properties at the time of an emergency. 2. WHERE REQUIRED Public streets, or approved emergency access roadways contiguous with a public street, shall be provided so as to allow emergency vehicles to within 150 feet of all one story buildings and to within 40 feet of all multiple story buildings, (see Chart H -1). 3. SURFACE Emergency access roadway surfaces shall be all- weather hard - surfaced, (suitable for use by fire apparatus) right -of -way, unobstructed and main- tained only as access to the public street. 4.
