AN ORDINANCE OF THE CITY Oi, SAN LUIS OBISPO
CONSOLIDATING CITY LIBRAI:Y OPERATION AND
FINANCING FUNCTIONS WITH THE COUNTY FREE
LIBRARY SYSTEM.
WHEREAS, on June 20, 1972, the residents of the City of San Luis Obispo
overwhelmingly adopted a Charter Amendment which authorized the City Council to adopt
an ordinance which would transfer or consolidate City library operation and financing with
appropriate functions of the State, County or other governmental body offering to provide
library service to an area or region of which the City is a part; and
WHEREAS, this Council on August 10, 1972, unanimously approved Resolution
No. 2364 expressing the Council's intention to adopt an ordinance consolidating the
operation and financing of the City Library with the County Free Library, pursuant to the
provisions of the California Education Code, and subject to an understanding With the
County concerning certain criteria set forth therein; and
WHEREAS, City and County representatives have subsequently prepared a
document entitled "Guidelines for Library Operation V1ithin the City of San Luis Obispo ",
dated October 17, 1972, which sufficiently satisfies the criteria set forth in said
Resolution; and
WHEREAS, the County Board of Supervisors, the City Library Board and the City
and County staffs have approved said Guidelines in principle; and
WHEREAS, this Council finds and determines that it is in the best interests of
the City and its residents to consolidate City Library operations and financing with the
County Free Library system, subject to said Guidelines.
NOV-1, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis Obispo
as follows:
Section 1. The San Luis Obispo Municipal Code is hereby amended by adding to
Article II, Chapter IV thereof Section 2440 as follows:
'Section 2440. Under the authority of Charter Section 1106.5 and pursuant to the
provisions of the California Education Code, the City of San Luis Obispo hereby notifies
the Board of Supervisors of the County of San Luis Obispo that the City Library desires
to become a part of the County Free Library system for all purposes, including operation
and financing, and subject to the 'Guidelines for Library Operation Within the City of
San Luis Obispo', dated October 17, 1972, a copy of which is on file in the Office of
the City Clerk.
All provisions of Charter Sections 1105, 1106 and 1205 (c) 2 are hereby suspended
in full during the period that the City Library remains a part of the County Free Library
system, provided, however, that all taxes now or hereafter due and owing during fiscal
year 1972 -73 pursuant to the City's library tax adopted for said fiscal year shall remain
in full force and effect. "

Section 2. This ordinance shall take effect as of January 1, 1973.
Section 3. The City Clerk is hereby directed to transmit a certified copy of this
ordinance to the Clerk of the Board of Supervisors.
Section 4. This ordinance, together with the ayes and noes, shall be published
once in full, at least three days prior to its final passage, in the Telegram Tribune, a
newspaper published and circulated in said City, and the same shall go into effect on
/ January 1, 1973.

Free Library:

all other library facilities, books and equipment owned by the City at the time of consoli(latJoil

consolidation shall. determine which items; are owned by the. City.
(3). Library employees presently emplo��ed by the City on the City payroll sha11 continue to 1>e
City employees for pay and other clisbursement purposes, including retirement, health plans,
and workman's compensation benefits only, as long as their employment is continuous, but their
replacement shall be made with County employees. In all other respects including, but not

limited to, job classifications, pay scales', working conditions, hours, vacation, sick leave,
holidays, discipline and supervision, the aforementioned employees sl-w11 be considered subjecL
to the County personnel department and,;to County rules and regulations. The County will instruct
the City as to the pay scales to be paid each library employee who remains on the City payroll,
and the County shall reimburse the City', jor .tile gross amcunt of Such payroll, plus City paylilents
for retirement, compensation insurance:' and health benefits on their behalf. Payments shell he
on a monthly basis upon invoice.

(4) Effective upon the date of consolidation, the City shall establish a revolving account in L11c

disbursement obligations set forth above.' All other unexpended City revenues for library operat.ion
during the current fiscal year shall be transferred to the County as they beconle available. On the

budget for the balance of the fiscal year and shall transmit all invoices on hand to the Countv for
disbursement by the County. .Upon theeventual termination, reti.rcnlent, or transfer to the

Both parties agree to include mutual waiver of subrogation provisions in relation to propert;
losses covered by insurance and to provide each other with certificates of insu.iance evidencin'
the coverages required above.

(7) The County and City will diligently plan and work towards the construction of a common
facility to house an area library and t ie;,lieadquarters of the County- Free Library, centralized
within the City.
(8) If the City should withdraw from the; County Free Library system, ownership and clistribution
of books and equipment purchased or adde' d during the period of consolidation shall be determined
on the basis of proportionate assessed valuations of City and County during such period. The
County Free Library she] f list and inventory at the time of City withdrawal. shall serve as the
basis for such distribution,
(9) City shall provide fre:c water and sewer service and County shall provide all other utilit.ic.s.
